DESCHUTES COUNTY BOARD OF COMMISSIONERS
Audio Cassette Recording Titled: WORK SESSION
October 3, 1994; 10:00-12:00 PM (2 tapes).
A meeting of the Board of County Commissioners was held on October 3, 1994.
Commissioners present were Nancy Pope Schlangen, Tom Troop and Barry
Slaughter. Also in attendance were Rick (sham, County Counsel; County
Administrator Mike Maier; the media, other staff and a few citizens.
Items discussed at this meeting may be on a future Board business meeting
agenda:
Discussion of a public hearing regarding the Jan Ward development (Mountain
High) decision, including the lack of cooperation from the City of Bend. A lengthy
conversation took place.
Discussion of a decision on the jail award appeal.
Discussion of signature of Resolutions 94-101 and 94-102, approving no parking
zones on Butler Market Road, Hamby Road and Swalley Road. These came about
from petitions from residents, regarding dangerous road situations.

Discussion of approval of a lease -purchase agreement with Motorola for radio
equipment for the 9-1-1 Service District, which is an upgrade that will allow them
to interface with the new 800 systems the cities and other agencies are using.
This is already part of the budget.
Discussion of the second readings and adoption of Ordinances 94-037 and 94-038,
text amendments to the forest land section of the comprehensive plan and forest
zones. Paul Blikstad and Rick (sham spoke at length, in particular about how to
deal with replacement dwellings. The City of Sisters is especially supportive of
moving forward with the Ordinances.
Discussion of approval of the award of seven dump truck contracts to John Lucas
Truck & Equipment. The main fleet needs to be replaced and this had been
planned for several years. Some old equipment will be kept and used for other
purposes, and some will be donated to various agencies. There is no trade-in
value.
Discussion of approval of a training request for five equipment operators. This
would allow training to take place at the same time, at a regularly scheduled
location and event. Some staff will be taking part in setting up the event, in
another part of Oregon.
Mr. Slaughter is disappointed that this is not happening in Bend, and wants to see
it held locally in the future.
Discussion of the La Pine Industrial Park and approving the CCR's for the two
parcels that were recently reacquired due to foreclosure. There has been a
request by the Economic Development Board to sell a piece of property there, but
first do a lot line adjust to make the parcel smaller. It would be for a pet boarding
and care facility, which is something that is approvable in the zone. The Board
was supportive.
Staff updated the Board on other activity within the Industrial Park.

Citizen Matt Day asked to speak, and submitted a three-page letter to the Board.
He said he would like to participate in some ways with the ideas being discussed
about a new solid waste landfill. The Board had indicated that private enterprise
would be invited into the process, but this was omitted from the County's
advertising. He wants to be involved, and has some alternatives to present. He
feels he owns a favorable site for a future landfill.
His group could do a turn -key operation for the County. If the County requires
ownership, a portion of the site could be sold to the County. However, he wants
to go into contract with the County to address all the permitting, develop an
operational plan, and be the operator for thirty years.
Staff explained that they are open to working with the private sector, and has
made this clear to every Realtor in town and others, and through the media.
There is no RFP happening at this point. The property has to be at least 350 acres
and meet other general criteria. They won't deal with an operational plan and
other factors at this time. This is a complicated issue and needs to be dealt with
carefully over time.
Bruce Ricks, who works for Hooker Creek, stated that his background is in solid
waste and engineering. He was concerned about how the ads were written. He
was advised that when they talked about a "County" facility in the media and
advertisements, that this meant it needs to be within Deschutes County and not
elsewhere. The County has not made decisions about operators or ownership at
this point.
Mr. Day went into great detail about what he is willing to offer.
Discussion of whether the Board has the discretion of turning over certain land
use decisions directly to LUBA. Bruce White said the Board adopted an Ordinance
in early August that allows them to do this. Commissioner Schlangen had
forgotten this. No appeals have been filed since then.

Discussion of one person's complaints against various horse operations on EFU
land. This is in the hands of CDD. Mr. (sham noted that he thought the Board had
decided some time ago to not be involved in taking enforcement action on
operations in the EFU zone. Mr. White said there is a separate meeting set up to
discuss this further.
Bruce White asked the Board thinks about County involvement in the Warm
Springs Public Advisory Group. The County is involved because this is in regard to
reserve water rights. He is not clear on how the County should handle this
situation. A long discussion ensued. Mr. Slaughter suggested that the cities
should be involved, and there needs to be representation of the water resources
and irrigation groups as well.
Discussion of upcoming meetings.
