DESCHUTES COUNTY BOARD OF COMMISSIONERS
Audio Cassette Recording Titled: WORK SESSION
February 27, 1995; 10:00-12:00 PM (2 tapes).
A meeting of the Board of County Commissioners was held on February 27, 1995.
Commissioners present were Nancy Pope Schlangen, Bob Nipper and Barry
Slaughter. Also in attendance were Rick (sham, County Counsel; County
Administrator Mike Maier; the media, other staff and a few citizens.
Items discussed at this meeting will likely be on a future Board business meeting
agenda:
A presentation of a Criminal Justice Advisory Council report on the facilities needs
of Juvenile Community Justice. Presiding Judge Steve Tiktin explained the work of
the Council, and presented a master plan of their recommendations. He went
into great detail about the facilities needs for Corrections, in particular for
Juvenile Justice.

The primary focus should be to provide detention beds. These would serve a
variety of needs. The system should be centralized to provide better care and
economy. They hope this can go on the ballot soon, but they do not want to
compete against the measure for the libraries.
Commissioner Slaughter emphasized how much he supports the work of the
Council, and that they have come up with a great final no-nonsense product, one
that he hopes the voters will support.
The group spoke at length as to whether to include other law enforcement needs,
including much-needed courtroom space, in the request for this type of facility,
the timing of the levy, and how they should deal with the overall elections
process.
Discussion of a public hearing on the transfer of real property to the Bend Metro
Park and Recreation District.
Discussion of a public hearing on Ordinance 95-010, amending Title 17 to allow
for systems development charges for parks within the Central Oregon Park and
Recreation District. Staff explained the item in detail.
Discussion of a public hearing on the appeal of file A-94-21, appealing the
Hearings Officer's denial of land use for Dan and Paula Lawyer. This is a
conditional use permit for a non-farm dwelling.
Discussion of authorization to waive the bidding process and take quotes for
widening the asphalt on Stevens Road, between 27th Street and Ward Road. Staff
explained that this is a minor project, to add a little pavement to bring the width
up. It would be an informal bid and they would still take the lowest bid.
Commissioner Nipper said he is uncomfortable doing this. The public complains
that the department does a little bit of work in one location, goes to another, and
it takes a long time to get a job done. He does not like this happening.

He feels they should have gotten it all done at the same time. (There was a long,
heated discussion at this time.)
Discussion of approval of contracts with David Evans and Associates for
engineering work at the southwest landfill. There was a discussion about having
these contracts be exempt from the bidding process since they are continuations
of existing contracts.
Discussion of signature of Resolution 95-038, approving findings by the Solid
Waste Department exempting from competitive bidding requirements, a contract
with David Evans and Associates for cover rehabilitation of the southwest landfill;
and signature of a personal services contract for same.
Discussion of signature of Order 95-034, amending a previous order regarding a
public hearing on the Apache Road/Lakeview Road local improvement district.
Staff explained that the notification for the public hearing was sent out with the
wrong location.
Discussion of the Galen Road LID, and the hearing being delayed to meet the
timeframe for proper notification.
Discussion of approval of funding for the bicycle map for the area.
Discussion of approval of a grant application for $4,000 to the Rimrock Trails
Adolescent Treatment Center.
Discussion of approval of Ordinance 95-012, repealing sections of Code Title 4, to
be consistent with the State.
Discussion of approval of Ordinances 95-007 and 95-017, amending the
comprehensive plan and Title 18 to implement House Bill 3661. Even though the
legislature may change this or approve other related bills, the County is required
to implement what has already been passed.

Discussion of approval of the adoption of the Knapp decision. This was for an
application for three 10 -acre homesite parcels on Indian Ford Road.
This came before the Board last year, and only two Commissioners were available
to vote on it. This resulted in a split vote. One of those Commissioners was Mr.
Throop. The attorneys finally have drafted the decision after all this time, and it is
up to the two other Commissioners, Schlangen and Slaughter, to make the
decision. Mr. Nipper will not be participating.
Discussion of signature of a personal services contract with Oregon Psychological
and Consulting Associates.
Discussion of approval of the reappointment of Roberta Berry and John Pragnano
to the Local Alcohol and Drug Advisory Committee.
Discussion of approval of an out of state travel request for the Health
Department.
Discussion of approval of the appointment of Richard Fairwell to the Newberry
Estates Special Road District board of directors.
Discussion of approval of appointments to the 1995-96 Extension/4-H County
Service District budget committee.
Discussion of signature of plat MP -93-11, Orlando, to create two 13.5 acre parcels
in the RR -10 zone.
Discussion of signature of a final plat, MP -93-31.
Discussion of signature of Orders 95-040 and 95-041, authorizing the refund of
taxes.
Discussion of signature of a final plat for Painted Ridge at the Broken Top
Subdivision.

Discussion of a problem with the State Highway Division, taking soil from the
demolition landfill but not securing, covering or wetting the loads, so that dirt is
flying everywhere on the roads on the way to the parkway.
Unfortunately, the City of Bend never adopted an ordinance on how Toads are
supposed to be transported. Mr. Isham stated that if this is not going to be
enforced, the County should just repeal its ordinance.
Blowing dust is an ongoing problem at the demo landfill, and all this activity is
making it worse for the nearby residents.
Mr. Nipper said that he knows a trucker, Mike Daly, who has been in business a
long time, but he and others are not physically able to climb up on their trucks to
cover their Toads. Mr. Isham stated that those who want the job need to comply
with the provisions of doing so.
Mr. Nipper said he wants to come up with a program to work with the
contractors. Maybe they can have adult corrections inmates do some of this work
for them. Otherwise this drives up the cost of the fill. Mike Maier said that the fill
dirt is already very cheap. He feels this is a private sector issue. The Hap Taylors
and others could get together and figure out something that is mutually beneficial
for them. The County does not have to make it easier for some of them.
Ms. Schlangen said the County would have to transport them, supervise them,
feed them at the site and generally act as employers of these inmates.
Mr. Nipper wants to call a meeting of the contractors in the area and see if they
can work something out with them. Mr. (sham stated that they have been hired
by the State so the County can't tell them what to do. He wants to see the load -
covering ordinance either enforced or repealed.
A long, heated conversation continued. A meeting of some kind will be
coordinated, which will likely include the City.

Discussion regarding increasing the transient room tax. Mike Maier said he needs
some direction of what to do next. He feels the proposal needs to be delivered to
the City of Bend tomorrow. He then went over the outline of the proposal at
length.
He would like to see a large portion of the increase go towards the expenses of an
event center, should this pass at the polls. He feels this would protect the
County's interests. The Board was supportive.
Commissioner Slaughter asked that County Counsel work more diligently on the
right to farm ordinance. He feels this has languished far too long already, and he
wants to deal with it.
