A meeting of the Board of County Commissioners was held on September 12,
1994. Commissioners present were Tom Troop and Barry Slaughter.
Commissioner Nancy Pope Schlangen was out of the office. Also in attendance
were Rick Isham, County Counsel; County Administrator Mike Maier; the media,
other staff and a few citizens.
Items discussed at this meeting may be on a future Board business meeting
agenda:
Discussion of a continued public hearing on Ordinance 94-037 and 94-038, text
amendments to the forest land section of the comprehensive plan and forest
zones. This is to implement House Bill 3661 that was adopted during the 1993
Oregon legislative session. Kevin Harrison explained that this is to be consistent
with State law. It was continued so that the Fire Districts had an opportunity to
examine the language more closely, and could provide input.

Mr. Harrison said he has not yet received any feedback from the Fire Protection
Districts, even though they had indicated this was a high priority issue. They were
supposedly going to meet about six weeks ago. It is possible that they are not
concerned with the language. He said they haven't received input from anyone
else, either.
Discussion of a public hearing on Ordinance 94-041, a text amendment to Title 18
regarding the open space conservation zone. These are related to periodic review
remand orders from LUBA. Every property owner affected by this has been
informed and none have responded.
A public hearing to consider a plan amendment and zone change for surface
mining for a parcel located near Forest Ridge, currently zoned EFU and designated
agriculture.
Discussion of approval of a waiver of a performance and payment bond
requirements for an equipment purchase for Public Works. This is not felt to be
needed and the result would be a discount of 5% of the price.
Discussion of the acceptance of two warranty deeds, relating to the Badger Road
project.
Discussion of approval of a contract to Bend Aggregate and Paving for the paving
of South Pine Street in Sisters.
Discussion of signature of a personal services contract for Jewett, Barton, Levy
and Kern as the County's new agent of record for insurance purposes.
Discussing of approval of an indemnity agreement for Central Oregon Desert
Racing Association for the 1994 Whiskey Springs 400 event.
Discussion of approval of a conservation easement and development agreement.
Discussion of approval of a notice to Mt. Bachelor, terminating an existing parking
lot lease.

Discussion of approval of several appointments to the Bicycle Advisory
Committee.
Discussing of signature of a final plat for Broken Top Phase 3-D in the Bend urban
area.
Discussion of approval of a liquor license application renewal for Four Hot
Peppers, Inc. The Commissioners took action to approve so that the company
would not be penalized $100 by the OLCC.
Discussion of upcoming meetings: Administrative liaison; Public Works; the
Auditor; and Mental Health Department.
Discussion of whether to allow someone to read a statement into the record that
relates to an issue that is under deliberations. County Counsel did not feel this
was a problem. The person spoke about a traffic signal relating to the new Wal-
Mart store. She also contacted ODOT.
She feels that this work is being done without proper permits. Her statement
went on for some time. Evidently this person lives across Badger Road, and is the
owner of the Blue Spruce Motel, close to the store. Wal-Mart wants to acquire a
piece of her property.
Commissioner Throop said this is the last acquisition and the smallest, and no one
else has had this type of issue. The property owner indicated that they think their
property is worth more than Wal-Mart intends to offer and are forcing a small
business into a situation they can't control.
Discussion and update on establishing the library district boundaries, and the
writing of the legal descriptions. They should be able to draw appropriate maps
very soon. These will be for these cities/areas: Sisters, Redmond, Sunriver, La
Pine and Bend.
