DESCHUTES COUNTY BOARD OF COMMISSIONERS
Audio Cassette Recording Titled: WORK SESSION
November 7, 1994; 10:00-11:30 AM.
A meeting of the Board of County Commissioners was held on November 7, 1994.
Commissioners present were Nancy Pope Schlangen, Tom Troop and Barry
Slaughter. Also in attendance were the media, other staff and a few citizens.
Commissioner Tom Throop, County Administrator Mike Maier and County
Counsel Rick (sham were out of the office.
Items discussed at this meeting will likely be on a future Board business meeting
agenda:
Discussion of a public hearing on TA -94-20, a text amendment to Chapter 18,
exclusive farm use. Kevin Harrison said this is to be consistent with new State
administrative rules. This primarily has to do with farm dwellings and non-farm
dwellings on EFU land, and replacement dwellings. Some of it has to do with
whether a parcel can be provided with public services.

Commissioner Slaughter asked if there was any way to un -plat the undeveloped
lands in the eastern County around Horse Ridge, since there is no way to provide
services to those properties. Therefore, he understands the County can't allow
building permits. There are probably other areas where the same type of
problem exists.
Bruce White explained that the properties have left the hands of the original
developer, so does not think this is feasible. Perhaps a major conservancy could
try to block up some of these lands; or maybe exchanges can be arranged to get
the properties into the hands of the BLM.
Brad Chalfant stated that the Board had previously directed his office not to sell
off lands in those areas. Many were sold to out of area people in the early 60's,
they did not realize what they bought, the lots were not developed, and a lot of
the parcels have come to the County under tax foreclosure. There are some areas
where the County owns a majority of the lots.
Discussion of a public hearing regarding the right to farm ordinance. Mr. Harrison
said the Deschutes County Farm Bureau approached the Planning Commission
with a proposal that the County adopt some kind of local ordinance to reinforce
right to farm provisions in HB 3661.
The Planning Commission recommended that no separate stand-alone provision
be adopted; but that County staff do a thorough screening of existing ordinances
to make sure what they contain is consistent with State law. In particular, the
Farm Bureau wants to address issues of noise, dust, solid wastes, and so on. The
local Farm Bureau wants to make a presentation to the Board in this regard.
The biggest conflicts seem to be in the exception areas, like MUA and Rural
Residential.

Discussion of approval of a forest patrol contract, between the Sheriff's Office and
the U.S. Forest Service. Greg Brown and Darrell Davidson provided an overview
of the item.
Discussion of signature of Ordinance 94-054, adding a section regarding inventory
of impounded vehicles. Mr. Brown said there was a court ruling that requires
every law enforcement agency to have an ordinance with certain details about
how vehicles are searched and impounded. This change makes the language
more consistent.
Discussion of signature of Ordinance 94-055, amending the County Code.
Discussion of signature of a Resolution authorizing Mike Maier to approve weekly
accounts payable vouchers the week of November 14. Two Commissioners will
be gone that week.
Discussion of signature of an agreement for architectural services by BBT for the
Redmond library project. Several residents of Redmond were in attendance, and
a few spoke in support of the project.
Discussion of the management of the La Pine Industrial Park. The Board will be
visiting the site later this week. Staff distributed maps of the Park and a lengthy
discussion then took place.
Discussion of approval of a resolution to be able to start the exchange process for
the Redmond and COCC properties. This resolution sets the public hearing to
begin the process.
It has been suggested that a part-time operations manager be hired to oversee
the Industrial Park. This person would be based out of La Pine. There are a
number of issues that need to be resolved. It is difficult to supervise someone
who is located out of the area. The timing of the transition is an issue as well, due
to the current budget. Perhaps this should be made effective on July 1.

At this time, the group discussed the role of this person. There may be
opportunities to seek lottery grant funds to try to broaden the work of the
position. Someone with the appropriate real estate background would likely be
desired. He or she would probably be sharing space with CDD.
The Board would also need to clarify the role of the manager and the local La Pine
entity (LABD).
Discussion of signature of a Mylar MJP-92-5, a major partition to divide 120 acres
into three forty acre parcels, in an F-2 zone. The Board approved the Mylar at this
time.
Discussion of signature of the Kelly O'Neil land use decision.
