A meeting of the Board of County Commissioners was held on August 1, 1994. Commissioners present were Tom Troop and Barry Slaughter. Commissioner Nancy Pope Schlangen was out of the office. Also in attendance were Rick Isham, County Counsel; County Administrator Mike Maier; the media, other staff and a few citizens. Items discussed at this meeting may be on a future Board business meeting agenda: Discussion of a public hearing on Ordinance 94-042, an amendment to Title 22 of the procedures ordinances relating to the appeals process. The will enable the Board to send certain cases directly to LUBA, which will save the applicant and other parties, as well as the County, a substantial amount of money and time. Transcription of Audio Recording of a Work Session, August 1, 1994 Page 1 of 4 Discussion of a public hearing on Ordinances 94-037 and 94-038, text amendments to the forest lands section of the comprehensive plan, to implement HB 3661 relating to forest lands. Kevin Harrison explained these are text amendments resulting from language in HB 3661. Two new administrative rules were adopted that relate directly to land use. These are a farm rule and a forest rule. (He went into great detail about the effects.) The Board can make limited rulings regarding this issue. Discussion of a decision on NUV-94-2, an appeal. Discussion of approval of an out of state travel request for Terry Newall of the Health Department, to attend a prevention and training center in Seattle, to learn more about sexually transmitted diseases. It is a two week course. Discussion of approval of an indemnity agreement for the Newberry Explosion 5K run -walk event. Discussion of approval of a warranty deed for Brooks Resources for right of way on Mountaineer Way, and a bargain and sale deed for same. This road comes off Mt. Washington Drive and goes into Cascade Middle School. Discussion of approval of the dedication of right of way on Brookswood Boulevard. Discussion of acceptance of a warranty deed from INNCO (The Hampton Inn) for right of way on Butler Market Road. Discussion of the award of a construction contract to Bend Aggregate and Paving for the Comanche and Seminole LID's in Deschutes River Woods. Discussion of work being done on some Redmond streets by Pavement Protectors, to seal some cracks. The County is providing the material and the company is doing the actual work. Discussion of a possible prescriptive easement process for Dusty Loop Road, to establish it as a public way or a County road. Discussion of developing a code enforcement task force. George Read explained that the Board is supposed to help select the member. He would like to include someone from County Counsel, the Sheriff's Office, the Courts, the Board of Realtors, the builder community, and some citizens. Letters should go out by Wednesday. Discussion of approval of an agreement with David Evans & Associates regarding developing a landscaping plan for the County Services Building. This requires a city permit. Discussion of approval of liquor license application renewals for Cafe Sante, Deschutes Fly & Tackle, and La Pine Station. Discussion of an agreement with ODOT regarding the new Wal-Mart store. This relates to the traffic signal at Highway 97 and Badger Road. The County is to pay for half of the utility cost associated with operating the signal. Dan VanVactor, attorney, feels this changes the store's permit, but County Counsel disagrees. Mr. VanVactor was allowed to speak briefly about his concerns. It is important to his clients, the Franklins, who have issues with the acquisition of rights of way for this project. (He went on in detail.) Ms. Francis then was allowed to speak at length. The Board insisted that this needed to be addressed when all three Commissioners are present. Mr. VanVactor indicated that he would be filing an injunction by mid -week against the County, ODOT and Wal-Mart. Discussion regarding approval of a teen pregnancy grant as presented by the Commission on Children & Families. Discussion of a permit for a High Desert Museum event, the Sagebrush Rendezvous and Festival. This requires a beer and wine license. Discussion of a decision on an Eagle Crest land use issue.
