A meeting of the Board of County Commissioners was held on January 22, 1996. Commissioners present were Bob Nipper and Barry Slaughter. Commissioner Nancy Pope Schlangen was out of the office. Also in attendance were Rick Isham, County Counsel; County Administrator Mike Maier; other staff and several citizens. Items discussed at this meeting will likely be on a future Board business meeting agenda: Discussion of signature of an agreement with the City of Sisters regarding the housing of city prisoners in the County jail. This arrangement covers housing prisoners in exchange for office space in Sisters. Discussion of signature of Resolution 96-016, declaring the intent to transfer real property to Central Oregon Community College and setting a hearing date. Transcription of Audio Recording of a Work Session, January 22, 1996 Page 1 of 5 Discussion of approval of the retention of a consultant for the new landfill site selection. Timm Schimke provided an overview of the item, which involves doing an analysis of the two sites for a final selection. They do want to augment some of the geologic information provided by the property owners. They also need to do some cultural and archeological surveys of each, and explore endangered plant or wildlife issues. Mr. Maier expressed concern about how long each of these analyses might take. Mr. Schimke felt certain that they could be completed in two or three months. The Board questioned why this needs to be done, since the property owners have provided some information already. Mr. Schimke explained that they want a single consultant to evaluate both sites on an equal basis. He also would like to see impartial information and not something provided by the property owners, who obviously have a vested interest in being selected. Commissioner Slaughter wants to make the process as fast as possible. Mr. Schimke wants to make sure that they are absolutely certain about whether or not a site is selected. Mr. Nipper said he is in support of doing it right. Mr. Schimke was advised to proceed. Discussion of signature of a declaration of dedication of a portion of Olney Street right of way to the City of Bend. Discussion of signature of Lee's Revisionist Bible College doing business as Cascade Praise Cathedral Church. This is a continuation of the occupancy of this group being a tenant in the old armory building. It is a month to month agreement at this point. Discussion of signature of Resolution 96-012, adopting the final assessments for the Squaw Creek Local Improvement District. Discussion of the adoption of the final assessments for the Apache and Lakeview Roads Local Improvement District. Tom Blust explained that they had some issues with LID's last year, so have changed the process somewhat to make it more educational for the residents. Mr. Nipper complained that once roads are improved, the speed of vehicles seems to go up. He wondered if the County has the legislative ability to reduce the posted speed limit. Mr. Blust advised that the State is responsible for doing this. Mr. Nipper wants County Counsel to work on something to take to the State to allow the County more local control. Mr. Slaughter pointed out that this takes formal action of the entire legislature because it would affect all locations in the State. Bruce White said that this would have to be prioritized with other things the department has to do. They do not usually, as a department, try to push through legislation, although the Commissioners can exert some pressure to make changes at that level through their regular political interactions with the legislators. It is also possible that this would create additional liability for the County, if it ever came to pass. There is also an enforcement issue. They can do lots of posting of signs but need to have the ability to enforce as well. Speed limits are set within cities, depending on the area. Outside of the city limits, there is no overall State law that provides for this except the basic rule on State highways. Commissioner Slaughter does not support trying to do this. It could create bigger problems at the local level that they are not equipped to handle. The State is in a much better position to handle this kind of situation. Commissioner Nipper said he wishes the media was present since he and Mr. Slaughter are disagreeing, and for once are not yelling at each other. Mr. Blust said this will accommodate a widening project to add bike lanes and sidewalks, from 15th Street to 27th Street. This action also sets a hearing date. Mr. Blust provided a lengthy explanation for the benefit of the newest Commissioner. Discussion of signature of an agreement with the Inn of the 7th Mountain Association of Unit Owners, dismantling the sewage treatment facility. Discussion of signature of Order 96-014, transferring cash within the 1995/96 budget. Discussion of scheduling a Board decision on an appeal of the Wal-Mart garden center. This has to do with the Franklin versus Wal-Mart situation that has dragged on for some time. To complicate the issue, the Wal-Mart property is now in the process of being annexed into the city limits. Mr. Slaughter would like to delay a decision and let the annexation go forward. Mr. Isham said that they should go ahead and make a decision now. A date was set for later in the week for a final decision. Discussion of signature of a final plat, 96-3, for Garnet Rice. Discussion of signature of Order 96-011, authorizing the refund of taxes. Discussion of signature of an amendment to a contract with DGT Sales, Inc. for roof inspection services for the ESD building. Discussion of an upcoming news conference. Discussion of upcoming meetings: budget; the Redmond Airport; and a meeting with legislators, at which the Board would like to let them know of the County's support of SB 1145. The Board, public safety and all the leadership within the County want the legislators to know this. They have heard, and are concerned that Representative Dennis Luke is against this Senate Bill, and the Board would like to know why. Other legislators are supportive. A lengthy conversation then ensued.
