A meeting of the Board of County Commissioners was held on May 17, 1996. Commissioners present were Nancy Pope Schlangen, Bob Nipper and Barry Slaughter. Also in attendance were Rick Isham, County Counsel; County Administrator Mike Maier; the media, other staff and a few citizens. This was a special meeting with the Solid Waste Department. Director Al Driver came before the Board. He said there is a joint meeting on this issue with the City of Bend Council next week. He hopes this meeting will set the tone for that one. The meeting is to talk about the financial implications of the plan to operation, processing and marketing of recyclable materials. Several documents have been prepared by various County departments. The current operator, CRT, indicated it needs additional funding to continue its work. Transcription of Audio Recording of a Work Session with the Solid Waste Department May 17, 1996 Page 1 of 4 The consensus seems to be that the County does not have sufficient information from the recycling company to advise the Board one way or the other. They cannot recommend to the Board whether it is appropriate to provide financial assistance for the program. There is an opinion that the group look for other funding sources than the County or the city. These could be broad sector funding, grants or other sources. No one seems to know if there have been any efforts undertaken in this regard. One option is for the County to assume all responsibility for the recycling center, as was discussed about a year ago. This would mean an operations agreement with CRT (Conservation for Central Oregon). He went into some detail on this idea. Another option is for the County to modify its ordinance to require all materials be submitted to the center without reimbursement. They are not sure if this could be called flow control, and whether it is legal. Ownership is the big question with this. The other option is to leave things as they are, and if CRT can't make it, the County closes the door and relinquishes the license. Bend Garbage has the first right of refusal. There are some mandated recycling items. However, all the parties involved could sit down and talk about it more, and develop a profit margin index that would float with the retail prices in the real world. There would be a bottom number than they would not be allowed to go below. Ms. Schlangen asked how this would affect the items that the self -haulers bring in. Mr. Driver gave a long explanation of this. There is no charge but there is a cost for operations. Some items have value while other items don't, and this changes all the time. There was a lengthy discussion about operating on a margin. It should be high enough to cover costs that take into account how the markets are operating overall. Mr. Driver said the departments involved in the study all agree that they do not have enough information to make a recommendation to the Board. Ms. Schlangen said that she is concerned about the potential legal ramifications of this issue. She also noted that if the County decides to take it over, that it seems that no plans have been developed as to how this would take place. Mr. Driver said if it was up to him, he doesn't really want to take this over. He feels it is better off in the private sector. Most counties leave this in the hands of the private sector. Some items are mandated as well. A lengthy, heated discussion of how the operation is now and should be handled then took place. Commissioner Schlangen is concerned about the program going backwards if this is not handled properly. Mr. Nipper is concerned that the income statements don't correlate well, and he would like to see an audit or similar work done to find out what is really going on with CRT. He thinks that they do not need to hire someone to do this; that Marty Wynne, as Finance Director, should be in charge and is qualified to do whatever it takes. Mr. Maier said that Mr. Wynne was hired as Finance Director, but not as a financial auditor for the Solid Waste recycling issue. Mr. Slaughter feels that this should be done by an impartial and independent auditor. Mr. Wynne said he needs some more questions answered before he can say that an outside audit is necessary. Mr. Isham stated that they might need to hire some outside legal help, especially when it comes to determining what work is mandated. Mr. Driver feels that this aspect is already pretty clear. As a nonprofit, they should be the best qualified to run this operation. The Board will leave it up to Mr. Wynne to decide which direction might be the best way to go regarding additional help. There can be no decision until more work is done.
