A meeting of the Board of County Commissioners was held on September 25, 1995. Commissioners present were Nancy Pope Schlangen, Bob Nipper and Barry Slaughter. Also in attendance were Rick Isham, County Counsel; County Administrator Mike Maier; the media, other staff and a large number of interested citizens. Items discussed at this meeting will likely be on a future Board business meeting agenda. Discussion of a public hearing on the formation of the Ponderosa Pines East Special Road District, and signature of Order 95-139. Discussion of signature of an intergovernmental agreement with the State of Oregon for the JOBS program. Julie Dotson said this is a continuation of an existing agreement for the rest of the fiscal year, for the Redmond and Bend JOBS program, which has to do with providing psychological support. Ralph Delamarter provided a brief overview. This will help provide access to the internet for staff and for the public. The grant needs to be submitted before Monday next week. Commissioner Nipper wants to meet with Data Processing staff and the Librarian to discuss whether this is a necessary expenditure of funds, and to make sure it is not a luxury item that is necessary at this time. He wants the entire Board to be involved. Discussion of signature of a power lien easement for Central Electric Cooperative within Squaw Creek Canyon Estates. This is for a routine upgrade to service in the area. Discussion of signature of Resolution 95-127, proclaiming October 1-7 as National Housing Week. Discussion of the appointment of Larry Patterson to the Deschutes County Public Safety Coordinating Council. This is to add an additional city administrator, per the State. Discussion of signature of a final plat to divide a sixteen -acre Redmond parcel into three parcels. Discussion of signature of a final plat for MP -95-12, to divide a ten -acre parcel within an RL zone. Discussion of signature of Orders 95-123 and 95-124, authorizing the refund of taxes. Discussion of signature of Order 95-144, declaring the results of the Bend Library bond election. Transcription of Audio Recording of a Work Session, September 25, 1995 Page 2 of 6 Rick Isham said that he has been speaking with bond counsel to decide the best way to generate some operating capital until actual sale of the bonds, and the effect of this on the budget. He said this meeting needs to be continued to later in the day so the Board can vote. This is the last day to make any budget adjustments. Discussion of a pending decision on A-95-15, an appeal of the Hearings Officer's decision on PA -95-1 and ZC-95-1 for the Korish case. Damian Syrnyk provided an overview of the item and the new documents submitted into the record on this matter. Mr. Nipper said that when listening to some of the people who object to the development, that they like their open space and want it to stay that way; and don't think that anyone else should be allowed to build in the area. There was never a real sense of this being legitimate. He feels that there needs to be affordable housing available, including for senior citizens, and this property is suited towards that. But no one wants 'that element' in their neighborhood. This seems patently unfair. He does not think there would be an adverse impact to the area. Mr. Slaughter observed that there are already a number of multi -family dwellings in that general area, so he doesn't understand the attitude of some people, either. Staff indicated that the area is already urban in nature, and if sewer had been available at the time of zoning, it would have been designated for more urban uses. The law does not allow school enrollment to be considered as a reason to decline approval. A lengthy, heated discussion occurred about land use issues and how to deal realistically with growth. Commissioner Schlangen wants to delay this decision until more land use work is done by the City. She feels that there needs to be more shown as to the need for affordable housing, and how much of it. Discussion of signature of liquor license renewal applications for the Inn of the 7t" Mountain, and Hot Peppers in Sunriver. Discussion of signature of a Mylar for Floyd Acres Farm subdivision. Discussion of signature of a Division of State Lands grant to delineate wetlands in the La Pine and Wickiup Junction areas. It will be helpful for people who own properties there, and it will help to do this before the County starts doing the inventory of the area. A contractor has been selected by the State and the County will be assisting with the project. Discussion of approval of an out of state travel request to attend a conference. Brad Chalfant would like to attend the Land Trust Alliance conference in October. He can get continuing education credits by attending this event. Discussion of upcoming meetings: Administrative Liaison; Treasurer; 9-1-1 County Service District; Joint City of Bend/County meeting regarding transportation issues; and a meeting with Court Administration. Discussion of a public hearing regarding La Pine water issues, to be held at the La Pine Fire Hall. A request from staff regarding the road department winning local awards, and how to send two County representatives to the national conference in Colorado. There was a long discussion about how to get there using public transportation. The employees want to drive back with their spouses. The County policy won't allow them to use their own vehicles out of state on County time. They would have to take vacation time, or pay for their wives to use public transportation as well. A long discussion ensued regarding how to compensate. Mike Maier suggested allocating a certain dollar amount towards the event and it can be used in a logical way. Mr. Nipper wants the Board to do something to recognize a youth who is becoming an Eagle Scout. Ms. Schlangen asked about all the others who need recognition as well. They have never done this all the time she has been in office. She wants to him to keep this at a personal level. (A somewhat heated discussion occurred.) Ms. Schlangen said they received a notice from the Department of Energy regarding geothermal, and wants to make sure the Board gives its approval, since the Board's capacity is as special advisory. There was a brief discussion about involvement with the Board of Equalization, and a governing body pool needs to be appointed for this purpose. They need to place advertisements for people to be appointed. Mr. Slaughter had a call from an irate citizen who was worried about a crew sitting in their truck for more than an hour on American Lane. He found out they are temporary employees from Express Personnel Services. He talked with Larry Rice about it. The meeting was r �,tjrned until 1:30, at which time they will reconvene to take action. The meeting began again at 1:35 PM. Transcription of Audio P( cc')rding of a Work Session, September 25, 1995 Page 5 of 6 Staff explained it was continued so the Board could consider whether to levy taxes for the Bend Library District. He has talked with bond counsel and staff, and it was decided that they will immediately issue a bond anticipation notice that won't require a tax levy. They will sell the bonds in May and pay the anticipation bonds back. They will then have the full confidence of the $8 million for the District. That will give three years from May to extend the repayment. The Board then spoke at length about bonding for the new Community Development building. Ms. Schlangen brought a letter from an attorney representing a few citizens regarding the Ferguson Court issue. She wants a letter to be sent out by the Board regarding their complaints. 1 certify that the above is a true and accurate record of a meeting, as reproduced from a cassette tape identified as Minutes of a Meeting of the Deschutes County Board of Commissioners, held on September 25, 1995.
