DESCHUTES COUNTY BOARD OF COMMISSIONERS
Audio Cassette Recording Titled: WORK SESSION
February 3, 1997; 10:00-12:15 PM (2 tapes).
A meeting of the Board of County Commissioners was held on February 3, 1997.
Commissioners present were Nancy Pope Schlangen, Bob Nipper and Linda
Swearingen. Also in attendance were Rick Isham, County Counsel; County
Administrator Mike Maier; the media, other staff and a large number of
interested citizens.
Items discussed at this meeting may be on a future Board business meeting
agenda.
Discussion of a public hearing on Ordinance 97-007, a text amendment to Code.
The final public hearing on the formation of the La Pine Water District, and
signature of Order 97-016, approving the formation of the District. Susan Mayea
provided a staff report and showed the District boundaries on a map.

The Wickiup Junction area has been left out at this point because there is a land
use issue to be dealt with first. Besides, it is not known how many people are
actually residents there since it is primarily commercial.
Chair Schlangen opened the public hearing at this time. Dennis Carter, Chair of
the Sewer Board, indicated that he feels this needs to be brought to a vote. A
water system is needed but it should be a choice of the people who live in the
area. He thinks not enough people know the details.
Commissioner Swearingen explained that they held a hearing in La Pine previously
to gauge how people felt about it. There was no opposition at that time. The
second hearing had only one person testify against it, who was concerned about
the fees. So it is surprising that at this time some people indicate they are against
it. The estimated costs were explained previously, that it would be estimated at
about $19 or $20 per month.
There was a lengthy discussion about the boundaries, costs and other factors.
There is no tax base or it would have to have gone to the voters. If La Pine would
finally incorporate, the citizens would have more of a say in what happens in their
area.
Commissioner Swearingen said there are limits to what the County should do for
a city function. The citizens need to decide for themselves about things like this.
The State feels that these are part of the function of a city as well.
Rick Isham said a port district does provide for water systems and similar
infrastructure. However, the port district failed. George Read added that this is
one thing that they are trying to address in the regional problem solving process,
which is not unique to this area.
A lengthy, headed discussion occurred about not having enough water sources to
put out large fires, contaminants in the water table, and other things that should
be addressed by a city entity. The County really doesn't want to have to do all of
these things for La Pine, and no other community demands the same level of
involvement. They need to work towards self-determination.

However, in the meantime, the County is the governing body and has to do what
is best for the citizens there. Commissioner Nipper said the tendency in La Pine is
for people to just vote against something, even if it is the best thing for them. He
doesn't know how to overcome this attitude unless the City incorporates and
takes the County out of it.
This discussion went on for an hour and a half. Ultimately the Board continued
the hearing until 4 PM this same day in the hope the Clerk could verify signatures
of those who submitted a petition, so that the Board can decide whether this can
be approved now or has to go to an election.
Discussion of a public hearing concerning the standards for filling and other
activities.
A public hearing on a proposed supplemental budget.
Discussion of the acceptance of the dedication of a portion of 19th Street in
Terrebonne.
Discussion of signature of a dedication of a right of way for the Public Safety
Complex property.
Discussion of signature of a joint operations plan for the Deschutes National
Forest for the Sheriff's Office to provide law enforcement services. This will cover
six days a week.
Discussion of approval of an intergovernmental agreement with Jefferson County.
Sheriff Brown said that it is almost complete.
Discussion of approval of a request for out of state travel for the Sheriff's Office,
for the Sheriff's technician to deal with training with the Motorola Corporation
regarding the new radio system. The hope is that ultimately this will be part of a
tri -county system.
Discussion of approval of an out of state travel request for Jeff Kern, the Surveyor,
to attend a conference in San Jose.

Discussion of signature of Order 97-022, transferring cash within the current fiscal
year budget.
Discussion of signature of a final decision on Appeal A-96-17 for Devins.
Discussion of approval of a final partition map, for two parcels on Craven Road.
Staff spoke about the Ward Road Cellular One cell tower appeal. The applicant is
trying to make some changes to some of the application, including the location of
the tower on the site. Otherwise, the decision date is set for next week.
Discussion of approval of authorizing George Read or Eric Swanson to sign change
order #2 for additional rock removal for the new Community Development
building, along with a few other changes. He gave a lengthy update of the
progress of the project.
Discussion of signature of a final plat for the Mountain Peaks subdivision, within
Bend.
The Board briefly discussed upcoming meetings.
Later in the day, the following occurred:
Bruce White informed the Board that the Clerk was able to certify a total of 52
signatures regarding the La Pine Water District formation, which is more than 15%
of the voters. Therefore, due to Oregon law, this is a request for the matter to go
to an election. An order has been prepared to put this on the ballot, and on the
same election they would elect a District board of directors. There is a March
deadline to file this document.
The Commissioners feel that they have done all they could, and it is now up to the
citizens.
The public hearing was closed. Mr. Nipper moved signature of the Order, which
was seconded and unanimously approved.
