DESCHUTES COUNTY BOARD OF COMMISSIONERS
Audio Cassette Recording Titled: WORK SESSION
March 3, 1997; 10:00-12:00 (2 tapes).
A meeting of the Board of County Commissioners was held on March 3, 1997.
Commissioners present were Nancy Pope Schlangen, Linda Swearingen and Bob
Nipper. Also in attendance were Rick Isham, County Counsel; County
Administrator Mike Maier; the media, other staff and a large number of
interested citizens.
Items discussed at this meeting may be on a future Board business meeting
agenda.
Discussion of the adoption of Ordinance 97-009, resulting from Measure 11, the
Crime Bill Law, related to SB 1145. This requires that every County have a
supervisory authority. Sheriff Brown recommended that in Deschutes County,
this be a supervisory board that consists of one Commissioner, the Director of
Administrative Services, and the Sheriff. This board will decide the sanctions of
the Measure 11 inmates.

Discussion of a standard agreement to buy jail beds back from the State for SB
1145 offenders. The State rate is about $55 per day.
A presentation by Debra McMahon from the City of Bend regarding the work of
the Design Review Committee. This resulted in the City Council adopting the
design review ordinance. She went into detail about the makeup of the
Committee and the process they followed. A slide presentation was given.
The focus of their work were: improved parking design; better building
articulation; better building architecture; better landscaping; and improved
signage.
There is a strong desire to limit signs along roads, and to be sure that parking lots
work safely for pedestrians. Sign height and widths would be more restrictive
than what is in place today. Buildings cannot be big and 'faceless'. Overall, things
can be more attractive without infringing on the rights of the owners or
developers.
A very lengthy discussion followed regarding the overall policies and procedures.
Discussion of approval of Ordinance 97-006, amending Title 18 to add a provision
for rock crushing. Staff said this will be another phase of design review regarding
setbacks and use of materials at a crushing site. The details of the requirements
were explained at length.
Discussion of signature of a contract with David Evans & Associates to perform a
study of the underground fire at the Bend demolition landfill site. Al Driver said
that this firm has the experience to deal with this issue.
Rick Isham said it is going to be expensive just to get to the basics of the problem.
Four or five years ago, the cost was determined to very high, and it is going to be
more as time goes on.

Commissioner Nipper asked about the success rate of putting out the fire 100%.
Mr. Driver said they have this type of experience, but he doesn't know if anyone
can ever get it done 100%. Only time will tell if the fires are really 100% out.
Commissioner Nipper wants to know for sure that this is not a result of volcanic
activity of some kind. Mr. Driver stated that they are pretty sure that it is within
the demo pit and started about 1972. They used to burn that site so that's when
it originated.
This study should give the County an idea of what it would take to actually put out
the fire. Mr. Isham said that he has looked down in the hole, and there are whole
trees in there along with other wood.
Discussion of signature of Resolution 97-027, initiating the Riverwoods Circle local
improvement district. It is just a 500 -foot long cul-de-sac. This is the first one
since they changed the policy regarding the formation of local improvement
districts. A lengthy discussion occurred regarding adding more roads to the
system and whether this should be limited.
Discussion of approval of an out of state travel request for data processing
personnel to attend a computer symposium.
Discussion of approval of a personal services contract with Chick Construction
Company for the relocation of a manufactured home. This is to move the
structure from the public works compound to the lot on Lafayette and Hill Street.
It is a 1992 manufactured home, and the City requires a roof pitch that it does not
have.
Discussion of approval of a radio transmission and receiving site lease agreement
on Awbrey Butte.
Discussion of the strip of land that is commonly thought of as Marshall Avenue,
which runs through the parking lot, was never formally dedicated.

Ownership seems to be with Oregon Trunk Railway and a defunct development
company. Staff is trying to clean this up so there are no issues with access. A
Resolution will authorize eminent domain proceedings to acquire the property.
Discussion of the Gill property exchange, which was scheduled for earlier in the
year.
Discussion of signature of an intergovernmental agreement with the City of
Redmond regarding Aspen Creek, which is a manufactured home park being
developed inside the urban growth boundary. The City is considering annexing
this area. This transfers permits from the County to the City.
Discussion of approval of a partition plat regarding property located on Pinehurst
Road.
Discussion of signature of an intergovernmental agreement with the State of
Oregon to contract regarding prison beds.
Discussion of approval of an interim wireless facilities Ordinance, to regulate
siting. Damian Syrnyk explained that this is a draft Ordinance and he would like to
go over it in more detail at the business meeting. The public meeting has already
been held.
Commissioner Nipper would rather discuss it before then and not take up
valuable time at the business meeting.
Discussion of approval of the decision of the Western PCS conditional use
application. It incorporates and adopts the Hearings Officer's decision and adds
the Board's findings. It has to be mailed by Thursday. It was decided that this
issue would be continued until 9:00 AM tomorrow so they can make a decision
and get it signed in a timely fashion.

Discussion of signature of Resolution 97-018, transferring appropriations within
the current budget.
Discussion of approval of lottery grant agreements that were awarded in late
1996. These are for the Bend Industrial Airport Park, Central Oregon Economic
Development, the Historical Society, High Desert Arts Gathering, the Redmond
Boys & Girls Club, REDAP, School to Work Alliance, and the Sisters School to Work
Program.
Discussion of approval of an appointment and a reappointment to the Special
Transportation Fund Committee.
Discussion of approval of the appointment of Toni Anderson to the Public Safety
Coordinating Council.
Discussion of the approval of the appointment of Corey Smith, and the
reappointment of Greg Brown, to the Local Alcohol and Drug Planning
Committee.
Discussion of the approval of the appointment of Joan Jacobsen and Lois Linton to
the 4-H Extension County Service District Advisory Board.
Discussion of approval of the appointment of Frank Deggendorfer and Ernie
DeCorte and the reappointment of Harper Johnstone to the 4-H Extension County
Service District budet committee; and the reappointment of Tony Hill as an
alternate.
Discussion of approval of the appointment of Brian Albertini to the Regional
Quality Workforce Council.
Discussion of approval of increasing an Assistant County Counsel position from
part time to full time, effective April 1. Mr. Isham gave justification for the
change. This is important since Mr. Isham going on extended leave around the
end of the month.

He would also like to be able to start a recruitment for a possible vacancy; this
would be necessary if the current Assistant County Counsel decides against going
full-time.
Mr. Nipper brought yap the issue of dogs and dog control issues, due to a recent
case that was very public. Reporter Barney Lerten of The Bulletin spoke about an
article the paper published; and that the Oregonian printed another story that
was longer.
This had to do with creating a local option, and some details about how these
kinds of cases would be handled. Commissioner Schlangen said it would be best
to close the meeting at this point.
