A meeting of the Board of County Commissioners was held on December 11, 1995. Commissioners present were Nancy Pope Schlangen, Bob Nipper and Barry Slaughter. Also in attendance were Rick Isham, County Counsel; County Administrator Mike Maier; the media, other staff and a large number of interested citizens. Items discussed at this meeting may be on a future Board business meeting agenda. Discussion of a public hearing on proposed Ordinance 95-071, amending Title 22, the Development Procedures Ordinance. George Read gave an overview of the main features of the Ordinance. Most are not big changes, but just comply with what is already being done. A long discussion ensued. Discussion of a public hearing to consider a remand from the Land Use Board of Appeals regarding SP -93-127, a surface mining site plan for Cascade Pumice. Staff explained that the parties have reached agreement and this can move forward. Transcription of Audio Recording of a Work Session, December 11, 1995 Page 1 of 5 Discussion of whether to hear file A-95-27, an appeal of the Hearings Officer's denial of SP -95-62 regarding the Rose mining pit. Dave Leslie said that this has to do with allowing for watering of loaded trucks coming out of the site, instead of tarping the loads. Another issue is a request to use specific equipment to sort material on site. These were previously considered at the original site plan review in 1992. At the time, this was a very controversial issue overall. The Board can reopen these issues if it feels this is appropriate. However, staff feels that the Board should deny review and let the Hearings Officer's decision stand as written, since this is an old issue being brought up once again by the applicant. Discussion of a public hearing on a plan amendment to amend the plan designation from agricultural to rural residential; and a zone change from EFU- TRB to MUA-10. Discussion of a public hearing on Ordinance 95-076, amending PL -18, the Redmond Urban Area Comprehensive Plan; and Ordinance 95-082, amending Title 20 regarding the Redmond grid street policy. Staff said that Redmond needs to tighten up its policies and the County is helping with this. Discussion of a public hearing on A-95-20, an appeal of the Hearings Officer's decision on SP -95-60 for the Church of Latter Day Saints. Damian Syrnyk explained the main points in detail. Discussion of signature of a disclaimer for the Terrill land dispute. Mr. Terrill was renting a property 20 miles east of Bend that abuts County property. Apparently, he had an oral agreement to purchase the property from the owner. The County, as well as some of the others, are not interesting in accepting this property, and need to let the Court know. Discussion of signature of Order 95-161, vacating a portion of Snow Creek Lane outside Sisters. This is a routine matter and is based on the developer having to change the road to avoid some large rock outcroppings. Discussion of signature of Resolution 95-154, authorizing the sale of the County's two RISC 6000 computers. These were at the 9-1-1 office but did not work as hoped. They hope by selling these computers they will have enough additional funds to hire a couple of dispatchers. There is some interest from other areas regarding the purchase of these computers. The original cost for both was over $133,000, and they are worth about half of that now. Discussion of approval of the continuation of a contract with J Bar J Youth Services using Youth Investment Level 7 funds. Scott Johnson provided an overview of this agreement, which the CCF Board supports. Discussion of approval of funding projects in La Pine, Redmond and Sisters using Title 4B funds. Staff said this is using federal funds, but details are being worked out at the federal legislative level. Discussion of approval of an agency report regarding a Newberry geothermal energy pilot project. This document simply confirms that the County does require a permitting process for the site. Discussion of signature of a final partition plat for Lorelei Lewis and Barb Myers. Discussion of signature of Order 95-171, assigning the name of Abbot House Lane to an unnamed road. Discussion of signature of Order 95-167, authorizing the refund of taxes. Discussion of approval of the reappointment of Phyllis Downey to the Lazy River Special Road District. Discussion of signature of a final plat for a three -lot partition of property owned by Klass Development. Discussion of signature of an intergovernmental agreement with the Library County Service District. Discussion of approval of reappointments to the Deschutes Basin Resources group. Discussion of signature of Pacific Power's electric service contract for the Redmond Library County Service District. This will allow for three-phase service for the building. Discussion of signature of a maintenance agreement between Ameritech Library Services and the Deschutes County Library Service District. Discussion of upcoming meetings: BOCC staff meeting; Public Works; 9-1-1 County Service District; Risk Management; Data Processing; and the Health Department. Discussion of a work session with Community Development regarding a Plan Amendment and Zone Change. Discussion of a meeting with the Superintendent of the Oregon State Police.
