DESCHUTES COUNTY BOARD OF COMMISSIONERS
Audio Cassette Recording Titled: WORK SESSION
December 18, 1995; 10:00-12:00 PM.
A meeting of the Board of County Commissioners was held on December 18,
1995. Commissioners present were Nancy Pope Schlangen and Bob Nipper.
Commissioner Barry Slaughter was out of the office. Also in attendance were Rick
Isham, County Counsel; County Administrator Mike Maier; the media, other staff
and a small number of interested citizens.
Items discussed at this meeting may be on a future Board business meeting
agenda.
Discussion of the new Deschutes Basin Land Trust. Dave Leslie and Win Francis
spoke about what they have done and what they have planned. They have filed
their Articles of Incorporation and the By-laws as a nonprofit. They want the
community know what they are doing and to get some interest from people who
want to encourage their work.

They are working on establishing a board of directors and a work plan. They
need a broad group of people on the board with appropriate expertise in many
things. They intend to remain completely neutral. A lengthy presentation and
discussion ensued.
Discussion of a public hearing on Ordinances 95-080 and 95-081, amending the
Comprehensive Plan regarding surface mining site No. 404. Dave Leslie said this
will add material to the inventory of mineral and aggregate resources, and will
provide an ESEE for the site to the east operated by Matt Day, to incorporate a
winter operating program developed by Fish & Wildlife.
This will allow some blasting of rock as well. The Board had called this one up,
which is why it is now before the Board.
Discussion of a public hearing on Ordinance 95-077, amending Title 18,
prohibiting accessory structures until the primary use is established or applied for.
This is part of the Code Enforcement Manual, so the Ordinance needs to be
consistent. It does provide for ramadas and carports that do not have four
enclosed sides.
Discussion of a public hearing on file A-95-20, an appeal of the Hearings Officer's
decision on SP -95-60 for the Church of Latter Day Saints. The parties are trying to
reach an agreement, but they may still be negotiating at this time.
Discussion of an appeal #A-95-23, of the Hearings Officer's denial of a 46 -lot
subdivision on Morningstar Drive. Paul Blikstad provided an overview of the
issue.
The Hearings Officer denied this on one point, since the road between this
subdivision and Wishing Well subdivision needs to be wider so that there is better
access provided.

Staff is recommending that the Board hear this appeal, because there are
extenuating circumstances. A lengthy discussion ensued.
Discussion of signature of Resolution 95-156, an intent to vacate a portion of a
frontage road, and signature of Order 95-176, accepting the engineer's report and
setting a date for a public hearing. This has to do with off-site improvements that
were required of the developer of Broken Top subdivision, connecting Mt.
Washington Drive to Century Drive. All the work is completed and this action can
now be taken.
Discussion of signature of a sublease agreement for La Pine Community Campus,
Inc.
Discussion of signature of an agreement between the Health Department and
Central Oregon AIDS Support Group.
Discussion of signature of an intergovernmental agreement with the Bend Library
County Service District. This will be discussed at length at the special joint
meeting later in the week.
Discussion of signature of an assignment of sublease agreement between High
Lakes Broadcasting and Jay Man Productions regarding an Awbrey butte
transmission site.
Discussion of signature of an annual U.S. Forest Service law enforcement
agreement with the Sheriff's Office.
Discussion of approval of an out of state travel request for the Community
Policing Consortium.
Discussion of signature of an assignment of a food service contract with Service
America. Lt. Greg Brown explained the item at length.
Discussion of signature of an Order establishing the final assessment for the
Squaw Creek local improvement district, and setting a hearing.

Discussion of signature of Ordinance 95-072, regarding County -owned property.
Brad Chalfant brought up the problem regarding public lands, public access and
maintaining the lands. There are times when this is not appropriate, or certain
activities are not appropriate. He is drafting an Ordinance regarding how to
address this ongoing problem. Some of this language was developed when there
was a huge problem of the Rajneeshees. However, there are ongoing issues with
squatters on property and other illegal type uses.
Discussion of signature of Orders 95-168 and 95-169, authorizing the refund of
taxes.
Discussion of approval of the appointment of Alice Pickett to the Central Oregon
Workforce Quality Committee.
Discussion of approval of the reappointment of Elwin Ross to the Deschutes Basin
Resource Committee.
Discussion of approval of the reappointment of James Kendall to the Vandevert
Acres Special Road District board of directors.
Discussion of signature of a plat for MP -95-45 and MP -95-46.
Discussion of signature of a plat for Wyndemere Phase V, a subdivision located in
the City of Bend.
Discussion of signature of a plat for Wyndemere Phase VI, a subdivision located
within the City of Bend.
Discussion of signature of a conservation agreement with Keith and Helene
Schaefer.
Discussion of signature of Resolution 95-155, transferring appropriations within
the 1995-96 Budget.

Discussion of upcoming meetings: executive session regarding real property
negotiations; Administrative Liaison; the Library board of trustees; Community
Corrections; Community Development; the Assessor; the Sheriff; Property
Management and Building Services; the District Attorney; the Health Department;
and the Solid Waste Advisory Committee.
Discussion of a Solid Waste public information meeting.
Discussion of a citizen and agency public safety facility update scheduled for
January 9, 1996.
Discussion of a 9-1-1 County Service District meeting.
Commissioner Schlangen said she is hearing from people about the La Pine
Economic Development Board. They are now calling themselves Industrial Group,
Inc. She asked what is going on in La Pine. Mr. Isham said that Mr. Chalfant has
been dealing with them. It is unclear who is doing what, but he believes this
involves mostly the same people.
Commissioner Nipper said he has been talking with some members of the Budget
Committee, and they all agree that Linda Swearingen does a good job on this
committee, they are worried about a conflict of interest.
Commissioner Schlangen said she doesn't hold a County office so nothing can be
done. Mr. Nipper is worried because she is going to run for Commissioner. He
thinks she should step down from the Budget Committee. Ms. Schlangen said
that Ms. Swearingen has been doing a good job on the Committee for three years.
She suggested that perhaps he should talk to Ms. Swearingen.
Mr. (sham said he would have to review this matter. They need to have cause for
this to happen.
Mike Maier reminded the Board of their upcoming retreat.

Discussion of granting the authority for either Commissioner Slaughter or
Schlangen to approve vouchers the week of Christmas. Commissioner Schlangen
said that both of them will be here, so they can go ahead and hold a business
meeting on Wednesday.
