DESCHUTES COUNTY BOARD OF COMMISSIONERS

December 4, 1995; 10:00-11:15 AM.
A meeting of the Board of County Commissioners was held on December 4, 1995.
Commissioners present were Nancy Pope Schlangen, Bob Nipper and Barry
Slaughter. Also in attendance were Rick Isham, County Counsel; County
Administrator Mike Maier; the media, other staff and a large number of
interested citizens.
Items discussed at this meeting may be on a future Board business meeting
agenda.
Discussion of a public hearing on an appeal of the Hearings Officer's decision of
approval of the Wal-Mart garden center site plan. Paul Blikstad said the appeal
was filed after the 120 days, so has no standing. This also was processed as a land
use action instead of a building action. The operator of the Blue Spruce Motel
property continues to fight Wal-Mart in any way she can.

Since this is in question, and the Board agreed to a hearing, it will be held, but
staff does not expect a lot of public interest.
Discussion of signature of Ordinances 95-078 and 95-079, changing the plan
designation and zoning on 9.47 acres from RL to RS. This is located off 18th Street
in northeast Bend. All infrastructure is in place, and staff and the Hearings Officer
feel this is an appropriate zone change for the area.
There was no formal appeal, but on the last day a letter was received from a
citizen who had questions. Under the procedures ordinance, there is no way to
deal with what he has proposed, which is to vacate the decision. There is no
hearing planned so no testimony will be taken.
Discussion of signature of a lease -purchase commitment letter with First
Interstate Bank. Rick Isham stated that this is to provide funding for asphalt
distribution equipment for the Road Department.
Discussion of signature of Order 95-172, confirming the land sale auction. Brad
Chalfant said this accepts the high bids at the sale and closes the sale, so that
deeds can be prepared. The County sold 18 of 27 properties, at a value about
$222,000.
Discussion of the adoption of Ordinance 95-083 regarding an extension of a
permit for the development of River Meadows subdivision.
Discussion of the adoption of the Code Enforcement Manual. A conversation took
place regarding some minor revisions that were done.
Discussion of signature of the final plat for James Knapp, regarding a minor
partition to create three ten -acre parcels in an RR -10 zone.
Discussion of the appointment for Don York to the Fall River Estates Special Road
District board of directors.

Discussion of the reappointment of Pete Miller, Bruce Abernethy, Carolyn Miller
and Ed Meierjeski to the Deschutes County Human Services Advisory Board.
Discussion of Chair signature of a grant contract with the Oregon State Library for
the internet infrastructure grant project for the libraries.
Discussion of signature of a conservation easement as a condition of approval for
James and Kelly Young. James Lewis said this is a standard conservation
agreement but was signed prior to the new wording.
Discussion of signature of Order 95-166, authorizing the refund of taxes.
Discussion of signature of Resolution 95-152, declaring the intent to transfer real
property to the City of Redmond. This is the long-running exchange regarding the
airport and COCC.
The problem was with the City getting funds together for the survey work. Staff is
still waiting for the legal description to be written, but this should be done within
a couple of days.
The County will hold a hearing and then acquire the property, after which time
there will be a transfer to COCC.
Discussion of a letter from the La Pine Industrial Group, requesting a change of
membership. A lengthy conversation took place regarding the Industrial Park, the
La Pine Economic Development Board, and the County's involvement. The plan is
to turn it over to the La Pine Industrial Group at some point for them to manage,
although the County will still retain ownership.
There was a lengthy discussion about strongly encouraging citizens of the town of
La Pine to incorporate so they would have more say in what happens in their
community.

Discussion of upcoming meetings: A joint City of Bend/County meeting at City
Hall to talk about new 'big box' stores.
Discussion of other meetings: an executive session under real property
transactions; Administrative Liaison; County Clerk; Community Development;
Department Heads; Health Department; Library board of trustees; and the
Commission on Children & Families.
Discussion of systems development projects. One is Sun Pointe Development off
Eagle Road. Most of the permits were taken out before the adoption of SDC's. .
Mr. Isham is still working with the City of Bend on SDC's. He probably won't get
this resolved until after the first of the year.
Discussion of a meeting with Community Development and Legal Counsel
regarding Code Enforcement and the community service program.
Discussion of a Public Safety Facility construction kick-off meeting.
Discussion of a dinner meeting with the cities of Redmond and Sisters at Eagle
Crest.
