A meeting of the Board of County Commissioners was held on November 27, 1995. Commissioners present were Nancy Pope Schlangen, Bob Nipper and Barry Slaughter. Also in attendance were Rick Isham, County Counsel; County Administrator Mike Maier; the media, other staff and a small number of interested citizens. Items discussed at this meeting may be on a future Board business meeting agenda. Discussion of a public hearing on Order 95-137, vacating public property at Empire Drive, as part of an agreement regarding road right of way with the Gislers. This is due to a change in the general transportation plan for that entire area. Transcription of Audio Recording of a Work Session, November 27, 1995 Page 1 of 4 Discussion of a public hearing on a plan amendment to change the plan designation for certain property from agricultural to rural residential, and a zone change from EFU-TRV to MUA-10. Staff explained that this involves 105 acres. There has been little interest, but a hearing is still required. This property has exceptionally poor soils, and it is surrounded by other development, so staff feels that a zone change and plan designation change are wa rra nted. Discussion of signature of Resolution 95-147, appointing Lt. Greg Brown as project director for the Public Safety Project, and approving the expenditure of funds from the Sheriff's levy for same, with repayment from the construction fund after the sale of bonds. There is a meeting scheduled next week to discuss the construction project plans and timing. Discussion of signature of Resolution 95-148, establishing a Public Safety Project fund. Discussion of signature of Resolution 95-149, authorizing the purchase of land adjacent to the Public Safety Facility site. This is a 2.33 acre parcel directly south of the State Farm building. It adjoins the jail property, and is what they need to access the entire Public Safety complex. The cost is $1.75 a square foot and it will be worth much more once the road goes in. Discussion of signature of a sublease agreement for PageNet of Oregon for an Awbrey Butte transmission site. Commissioner Schlangen said she has received two calls from people in La Pine wondering how the work is going on the La Pine Industrial Park agreement. Staff said he is working on it, although he was gone all of last week. George Read asked that they put this off for a week while they make some final adjustments to the Manual. Discussion of signature of a conservation agreement as a condition of approval for Terry and Bonnie Lenke. Discussion of signature of a conditions of approval agreement for the Willamette Greystone site. This is a standard agreement regarding the installation and maintenance of landscaping. The Board agreed that in the future these could be delegated to the Planning Director to sign administratively. Discussion of adoption of Ordinance 95-075, amending Title 18 of Code regarding County zoning. Rick Isham said this codifies what they have already talked about and developed. Discussion of upcoming meetings: Administrative Liaison; the Treasurer; the Court Administrator; the 9-1-1 User Board; and a Solid Waste update. Mr. Isham said that they have come to agreement on the purchase of the last remaining property for the new CDD site, and the paperwork will be ready for the Board to sign this week. Discussion of the appointment of a new member to the Commission on Children & Families. Discussion of a letter from Morningstar Christian School asking for a waiver of landfill fees. The Commissioners agreed with Commissioner Schlangen response to deny this request. The School wants to raise capital for their new building, and not do this to benefit the public as a whole like the various non -profits try to do in this fashion. George Read said he asked other counties how they handle this type of request, and there doesn't seem to be any rhyme or reason to it. So either the County has to develop its own policy, or just say 'no' more often. Mike Maier said this is lost revenue to those departments, so one idea is to budget a certain amount every year for them. Discussion of who is going to represent the Board on COCAAN this coming year. Mr. Nipper said he no longer wants to do this. Discussion of a letter to Mr. Nipper regarding utilization of the recycling facility. This man threatened to sue the County because the facility is in terrible condition most of the time, and is a safety hazard.
