DESCHUTES COUNTY BOARD OF COMMISSIONERS
Audio Cassette Recording Titled: WORK SESSION
September 18, 1995; 10:00-11:45 AM.
A meeting of the Board of County Commissioners was held on September 18,
1995. Commissioners present were Nancy Pope Schlangen, Bob Nipper and
Barry Slaughter. Also in attendance were Rick Isham, County Counsel; County
Administrator Mike Maier; the media, other staff and a large number of
interested citizens.
Items discussed at this meeting may be on a future Board business meeting
agenda.
Discussion of signature of Resolution 95-117, declaring October 1995 as National
Disability Employment Awareness Month. Frank Moore from Human Services
provided an explanation of the events and people involved, and who will be at the
next Board business meeting when the Resolution is read.

Commissioner Schlangen asked how Deschutes County is rated in its involvement
with these kinds of services, and Mr. Moore provided a lengthy explanation.
Discussion of signature of the 1995-97 Dispute Resolution program grant
agreement. Brad Mulvihill gave a lengthy overview of the program and the
amount of the grant, which remains much the same.
Discussion of approval of an extension to the Youth Investment agreement with J
Bar J Youth Services. Scott Johnson provided an explanation of the reasons for
the extension.
Discussion of signature of a financial segregation agreement for Linda Foster,
regarding a non-farm parcel in Terrebonne. This is to allow for the owner to
finance property. These are routine in nature.
Discussion of signature of whether the Board should hear appeal A-95-17
regarding a use variance application for Duck Delivery Produce. Paul Blikstad
stated that this has been heard and appealed several times. Commissioner
Schlangen said she is not interested in hearing it again.
The use had occurred for eight or nine years but the owner was aware that this
was not an allowed use during that time. The property is located just outside the
city limits.
It went from a building where they raised and slaughtered rabbits to a cold
storage building for produce brought over from the valley. The rabbit business
was approved as a farm use, but the storage use is not allowed per current land
use code. It could be used for other things, including as a home building site, so
this was found to not be a hardship.
Mr. Slaughter indicted that there are many other businesses being run in that
general area. He has a problem with why they can't store produce if they are
allowed to kill bunnies.

Staff indicated that the Board can overrule the decision and make a change to
ordinance if they wish. Duck Delivery leased the property and began doing
business in 1981. At some point a code enforcement complaint was made by a
neighbor.
Commissioner Nipper would like to know what the Planning Commission decided.
Mike Maier said that it probably is not the storage that is an issue, but the
delivery trucks.
Chuck Shassburger (?) of the Planning Commission said that this is a commercial
use. Mr. Nipper is worried about putting a company out of business. He knows
that the Board did not agree unanimously before he joined the Commission, and
wants all the information he can get before making a decision.
Discussion of signature of a conservation agreement for John Norris and Diane
Heinzelman for a garage on land adjacent to the Little Deschutes River. Paul
Blikstad this is using the new form that was developed at the instruction of the
Board, to address Nolan case concerns. These are no longer considered to be
easements.
Discussion of signature of the final plat for MP -94-36, a partition to divide a forty -
acre parcel into two parcels in the EFU-TRB zone.
Discussion of signature of a final plat to divide a sixteen -acre parcel into three
parcels in Redmond.
Discussion of upcoming meetings: Administrative Liaison; Library Board of
Trustees; Community Development; Community Corrections; Assessor; Property
Management; Building Services; the Sheriff; the District Attorney.
Discussion of an upcoming work session regarding code enforcement efforts.

Commissioner Schlangen brought up a couple of legislative alerts. One is the flow
control bill that was delayed, and the Board will fax a letter to the representatives
on this.
Mr. Slaughter stated that he already sent a letter. Mr. Nipper requested that
when one of the Commissioners does this, it might be determined that he or she
is representing the entire Board, and they want to be kept aware of what each
one is doing.
This also occurred regarding federal funding to leverage the USDA rural
development grants. Commissioner Schlangen said she had sent a letter already
but that it would be a good idea for the Board to send one with the signature of
all.
Mr. Nipper said that the Public Safety Coordinating Council is up and running now,
and assignments have been handed out to the judges and others regarding giving
presentations to civic groups and other organizations. Dennis Maloney and
Sheriff Brown are also intimately involved in the Council.
They gave their first presentation to the Kiwanis Club last week and it was well
received. They have been going out in teams so that all questions could be
answered.
This is a hot issue and he believes it will be one that really needs everyone firmly
on board. Judge Steven Tiktin is the judge involved at the local level.
Commissioner Schlangen said the League of Women Voters asked her to make a
presentation, but she thinks perhaps the Judge would be better suited since he is
involved in this group.
The work that they have been tasked to do is critical, and it is important that the
public understand how serious they are taking issues relating to overall public
safety.
