2017-713-Minutes for Meeting August 14,1995 Recorded 10/19/2017Recorded in Deschutes County CJ2017-713 Nancy Blankenship, County Clerk Commissioners' Journal 10/19/2017 4:54:43 PM ti .':: 2017-713 Deschutes County Board of Commissioners Bend, Oregon DESCHUTES COUNTY BOARD OF COMMISSIONERS Audio Cassette Recording Titled: WORK SESSION August 14, 1995; 10:00-12:00 PM. A meeting of the Board of County Commissioners was held on August 14, 1995. Commissioners present were Bob Nipper and Barry Slaughter. Commissioner Nancy Pope Schlangen was out of the office. Also in attendance were Rick Isham, County Counsel; County Administrator Mike Maier; the media, other staff and a large number of interested citizens. Items discussed at this meeting will likely be on a future Board business meeting agenda. Discussion of signature of a personal services contract with Geoff Hyde, M.D. Human Services Director Frank Moore said that Dr. Hyde provides most of the psychiatric consults for adults. Mr. Nipper said that County Counsel is trying to refine criteria for independent contractors, which may eventually affect the language of these types of agreements. Catherine Morrow explained that these are transportation growth management grants, and they are due to be submitted this week. One is to develop a code that deals with traditional type developments, to shorten the process. Steve Jorgenson said the second grant is for an alternative version of one that was presented and approved before, but never happened because of ODOT's hesitance at the time regarding the Redmond bypass. This will relate only to problem areas along Highway 97, outside of the city limits. Commissioner Nipper asked George Read about previous studies and funds that were available in 1991 when ODOT was considering work around the Sisters and Highway 20 area there. Mr. Read said that the City of Sisters has been debating what to do, and the County has taken a back seat on what is happening there since much of it would be within the City. There will be some coordination at the County level once the City has adopted its transportation system plan. Discussion of whether to hear Appeal A-95-15, of the Hearings Officer's decision on a plan amendment and zone change application #PA -95-1 and AC -95-1. Damian Syrnyk explained that this is regarding a property within the Bend urban area. Dale Korish is the applicant, and has applied for a plan amendment to the Bend general plan as well as a zone change for property at the intersection of Parrell Road and Murphy Road. Mr. Syrnyk went on at length as to how this change would affect both the City and the County. This is a complicated issue with a lot of factors to consider. Transcription of Audio Recording of a Work Session, August 14, 1995 Page 2 of 5 Some in the neighborhood objected due to increased traffic, and the fact that this might include multi -family dwellings. The zone change would allow for connection to the sewer system. Bruce White said that the Board may not have any authority to decline review even if it wanted to. There was a lengthy discussion regarding sewer, water, LUBA and other factors Discussion of signature of an indemnity agreement for the Good Earth Day parade and event this weekend, in Terrebonne. This is the tenth anniversary of this event. Discussion of signature of an agreement with ATEZ, Inc., for removal of asbestos from the Jessie Hill School Building/Redmond Public Library. Mike Viegas said that Paulsen Environmental prepared all the documents for the asbestos removal, at a cost of over $15,000. Also, all of the painted surfaces in the building are lead-based paint, so that has to be removed or covered. The material for both projects can be disposed of at Knott Landfill. Commissioners Nipper and Slaughter complained that decades of students have gone through the school with no bad effects, as far as they know. They asked if they are being forced into doing this mitigation. Mr. Viegas said that there is peeling of paint on the walls and there is no way to ignore it. Discussion of signature of an indemnity agreement for the Eagles -Chuck Austin Memorial Run, in September. This is their tenth year. Commissioner Nipper complained that the process has not yet been updated. He feels that they allow for public access to privately owned land. Bruce White pointed out that they have a lot of other issues that they assumed are more pressing to the Board and have not had time to analyze all the potential aspects of changing the conservation easement process. The language is in the Ordinance but not in the individual documents for several years. It is a very complicated issue because Oregonians in Action is watching what they do due to the Dolan case. They feel that this is a taking of individual rights, and that there should be compensation to the property owner. No one in the State has yet adopted ordinances to deal with the ramifications of the Dolan case. A lengthy, somewhat heated, discussion ensued. Discussion of signature of liquor license renewal applications for Marcello's, Vic's Tavern, and the Deschutes River Trout House. Discussion of signature of the final plat for Crosswater, Phase III. Discussion of signature of the final plat for MP -94-1, a partition to divide a twenty -acre parcel into two ten -acre parcels in an RR -10 zone. Mr. Nipper wants Dennis Maloney to come in and do a kick-off presentation of the Public Safety Complex. Discussion of upcoming meetings: meeting with Dennis Maloney; BOCC staff meeting; meeting with Newberry Habitat for Humanity in La Pine; Building Services and Property Management; Sheriff's Department; District Attorney; and a meeting with the State Department of Energy. Franscription of Audio Recording of a Work Session, August 14, 1995 Page 4 of 5 Bruce White noted that every year after the State legislature meets, there is a time period following the adoption of new laws in September that affect what the County does. There are a number of new land use laws, and some affect County documents that have recently changed. The light rail bill that was just passed also affects local EFU rules immediately, and no one even has a copy of the law yet. There are also changes that will affect other departments besides Community Development. Mr. Nipper stated that there will be a suggestion box conveniently placed and all employees will be encouraged to participate. Mr. Nipper said that there are rumors going around in Departments regarding a dress standard. He wants to see a policy developed and will bring this up at the next Department Head meeting.
