DESCHUTES COUNTY BOARD OF COMMISSIONERS

June 5, 1995; 10:00-11:15 AM.
A meeting of the Board of County Commissioners was held on June 5, 1995.
Commissioners present were Nancy Pope Schlangen, Bob Nipper and Barry
Slaughter. Also in attendance were Rick Isham, County Counsel; County
Administrator Mike Maier; the media, other staff and a large number of
interested citizens.
Items discussed at this meeting will likely be on a future Board business meeting
agenda.
Discussion of signature of an intergovernmental agreement with the Oregon
Board of Parole regarding corrections services. This is an agreement to keep
everything status quo until they know what will be resolved at the State
legislature level regarding SB 1145.
Discussion of signature of a psychiatric nurse practitioner contract with the
Human Services Department.

Discussion of approval of extending, for 90 days, the level 7 program contract
with J Bar J Youth Services.
Discussion of approval of the Commission on Children and Families' 1995-97
funding recommendations.
Discussion of signature of Ordinance 95-008, amending Title 2, public library
boards of trustees, and adding new sections regarding library service districts and
district boards.
Discussion of approval of the award of a lease contract for a track -type bulldozer,
to replace the 1971 model D7 that is on its last legs. They need one at the demo
landfill as well as one at Knott Landfill. They hope that by the end of three years,
they will be able to close the demo landfill, and will only need one bulldozer at
that point.
Discussion of the replacement appointment of a Solid Waste Advisory Committee
member.
Discussion of approval of a request of a waiver of disposal fees for the Bend Lion's
Club. The group recently helped out an organization that cares for handicapped
children, and have requested a waiver of landfill fees.
Mr. Nipper said he has heard from senior citizens within the UGB who say that
those within the City of Bend get a break on disposal fees, but this does not
extend to outside the city limits. Al Driver said he is in the process of looking at
this type of program countywide.
Discussion of signature of Resolution 95-084, declaring the necessity to acquire
real property. Brad Chalfant explained that this is the first step in acquiring a
piece of property adjacent to the old water master property. They have a signed
earnest money agreement on the other two, and are trying to put the exchange
together.
Regarding the recent land sale, fourteen properties were sold and generated
about $122,000. They hope to put together another property sale later in the
yea r.

Discussion of approval of a lease of property to the Educational Services District
for space through June 1996. There was a lengthy discussion about the condition
of the building, and in particular the roof.
Discussion of one of the towers on Awbrey Butte falling, the concerns of the
Sheriff regarding communications, and the tower owner's plans for repairing it
prior to winter.
There was a long discussion regarding some areas where the Sheriff's Office does
not have coverage, and the Forest Service's plan to start using cellular phones
instead to communicate with its employees.
Discussion of approval and signature of a personal services contract for two years
between Consolidated Towing and the Sheriff's Office.
Discussion of signature of a personal services agreement with Green & Associates
for the development of the code enforcement manual.
Discussion of an appeal of the Hearings Officer's decision to approve a conditional
use permit for a non-farm dwelling for Donald Madsen. Staff gave a lengthy
overview of the item. This would be a de novo hearing. However, the applicant
did not waive the 120 day decision deadline, which is June 16. Staff does not feel
that the opponent has cause.
Discussion of signature of Order 95-098, changing the name of Mull Drive to
Beaver Drive.
Discussion of signature of a final plat for Tennis Tracks at Broken Top Subdivision.
Discussion of signature of a liquor license application for Alpine Foods in La Pine.
Discussion of signature of a final plat for Sunridge Phase I, which is adjacent to
Conestoga Hills, in the RR -10 zone.

Discussion of approval of the appointment of Jerry Miller to the Deschutes County
Planning Commission. Mr. Nipper questioned why this selection process wasn't
more extensive, as he knows someone else who was interested in this position.
Discussion of upcoming meetings: Administrative Liaison; the Clerk; Community
Development; and the U.S. Forest Service.
Discussion of Mr. Isham's representing Susie Penhollow in Court this morning.
There were two lawsuits regarding the Rimrock Resort. One was in respect to the
wording of the ballot title; the main issue was a writ of mandamus issue. Mr.
Isham went into great detail of how the cases went.
