DESCHUTES COUNTY BOARD OF COMMISSIONERS

March 13, 1995; 10:00-11:15 AM.
A meeting of the Board of County Commissioners was held on March 13, 1995.
Commissioners present were Bob Nipper and Barry Slaughter. Commissioner
Nancy Pope Schlangen was out of the office. Also in attendance were Rick Isham,
County Counsel; County Administrator Mike Maier; the media, other staff and a
large number of citizens.
Items discussed at this meeting will likely be on a future Board business meeting
agenda.
Discussion of a report from the Deschutes Coalition for Human Dignity.
Representatives gave an overview of the work they are doing and hope to do in
the future. They handle the discrimination reporting hotline. This Coalition
began after the fight against Measure 9, when concerned citizens wanted to help
counter bigotry and oppression in all of its forms — sexism, racism, religious and
homophobia. (The representatives went into detail, and there was a lengthy
discussion at this point.)

Discussion of a public hearing on Order 95-027, providing for the transfer of an
interest in real property to the Bend Park & Recreation District, and signature of a
bargain and sale deed. Brad Chalfant said that this involves a lot line adjustment
at the demo landfill to reconfigure the lot lines.
Discussion of a public hearing on Ordinance 95-015, amending PL -20, the
Deschutes County Comprehensive Plan map; and Ordinance 95-016, amending
Title 18 of the Zoning map. Paul Blikstad gave an overview of the proposed
changes relating to a 1.76 acre parcel in La Pine, located directly across the street
from the Sheriff's substation. The parcel has been rezoned rural industrial; the
same as the parcels on three sides, which were rezoned to rural industrial last
year.
Discussion of public hearing on TA -94-25, amending Title 17 of Code regarding
subdivisions; signature of Ordinance 95-021, repealing chapter 17 and adopting a
new chapter 17 regarding road dedications.
Discussion of a public hearing on Community Event Center bonding. Rick Isham
said there seems to be little interest in this issue.
Commissioner Nipper complained that the let one person speak at a recent
hearing for almost an hour. He asked if there is a way to limit this kind of
testimony. Mr. Isham said that the Board can set a timeframe for testimony,
based on the agenda or any other reason. If they need to speak for more than
five minutes, they can always submit their testimony in writing. And a sign-up
sheet detailing this is suggested.
Discussion of signature of a local agency agreement for the enhance program
project with the Oregon Department of Transportation. Larry Rice said this has to
do with Ferguson Road. The planning has taken almost two years. They obtained
a $50,000 bicycle grant, and got it; and applied for a multi -modal transportation
and efficiency grant and that also was approved.

The County will buy the right of way from 15th to Ferguson so the road can be
substantially widened, for bike lanes and sidewalks. ODOT will do the bid process,
while the County will do the design. It will cost the County about $44,000 out of a
$467,000 project. This will link those residential neighborhoods with the new
school.
Commissioner Slaughter said he has a problem with what they are planning to do,
and suggested that it is time to consider bike paths that are removed from the
roadside for safety reasons. Mr. Nipper stated that he thinks this would
dramatically increase the cost. Mr. Blikstad indicated that Federal, State and City
transportation standards require bike lanes be integrated with the roads in order
to receive funding.
Mr. Slaughter said there are lots of towns in Oregon and Idaho where this is being
done, and he would like to see this idea pursued on the local level. Mr. Isham
pointed out that in some places, this is being done with abandoned railways,
called 'rails to trails'. However, this takes the place of sidewalks, and Bend has
abandoned this because of conflicts with bicyclists and pedestrians. Oregon law
considers bicycles motor vehicles as well.
Staff will find out what kind of funding might be available for this kind of a project
so that it can be considered for future improvements.
Discussion of signature of Resolution 95-042, rescinding Resolution 94-058 which
adopted a new preferred solid waste disposal site alternative, and directed staff
to proceed. Al Driver stated that the new Resolution provides direction via a
policy statement for staff to proceed in the landfill disposal and recycling program
system. The next goal is for staff to provide a flow chart with time frames and
action items, along with costs.
Discussion of signature of Resolution 95-044, recommending approval of a
Oregon Business Development Loan project for Mini -Minter. This small company
in Sunriver makes miniature implantable transmitters to measure the core
temperature of small animals, and the effect of drugs on laboratory animals.

Discussion of approval of two Orders to refund taxes.
Discussion of signature of a final plat for the Painted Ridge subdivision at Broken
Top.
Discussion of an upcoming meeting with the City of Bend regarding street SDC's
and the Urban Growth Boundary.
