The petition for annexation of property into Bend Park & Recreation District, a copy of which is attached hereto as Exhibit "1" and incorporated by reference, is accepted. Section 2. A public hearing on the petition shall be held on November 20, 2017, at 10:00 a.m. at 1300 NW Wall Street, First Floor Hearing Room, Bend, Deschutes County, Oregon. Section 3. Notice of Hearing shall be given in substantially the form set forth in Exhibit 112," attached hereto and by this reference incorporated herein. In accordance with ORS 198.800 notice will be published in The Bulletin on two (2) occasions, and posted in three (3) public locations within the county. Notices shall be posted for not less than five (5) consecutive days. Written notice of the hearing shall be given pursuant to ORS 198.857. Section 4. The Deschutes County Community Development Department shall cause to be filed prior to November 20, 2017, a statement regarding (a) whether this proposed special district annexation is consistent with County Zoning Ordinances and the County's Comprehensive Plan, and (b) any service agreement between a local government and the affected district. NOTICE OF PUBLIC HEARING BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON On November 20, 2017, at 10:00 a.m., the Deschutes County Board of Commissioners will hold a public hearing to consider a petition filed by Nancy Moran for annexation of property into the Bend Park & Recreation District. This hearing will be held in the Board of County Commissioners' Hearing Room, First Floor, 1300 NW Wall Street, Bend, Oregon. All interested persons may appear and be heard. The property Petitioner proposes to annex is 7.17 acres and is located at 20990 Yeoman Road in Deschutes County. To view maps and legal descriptions of the boundaries of the proposed annexation, contact the Deschutes County Counsel's Office at 541-388-6622. The purpose of the proposed annexation is to include this land into the district boundaries to enable it to receive district services. PUBLIC HEARING ON THIS DATE? No. BACKGROUND AND POLICY IMPLICATIONS: On July 28, 2017, Nancy Moran submitted a petition to annex her property at 20990 Yeoman Road into the Bend Park & Recreation District. The annexation is a requirement of her application to partition the 7.17 -acre property into two parcels in the Suburban Low Density Residential Zone, The County Community Development Department already has approved that application. The Bend Park & Recreation District on July 27, 2017, submitted a tentative agreement to annex the property once Moran satisfies all conditions for the annexation. The Assessor's Office certified the petition on October 4, 2017 and it satisfies the requirements for filing under ORS 198.857. Pursuant to ORS 198.857(3) the Board must set a date for a public hearing. Attached is Order No. 2017-041 setting the hearing for November 20, 2017. FISCAL IMPLICATIONS: The County provides all the staff costs for all special district formations and boundaries changes. For district formations and other boundary changes that are approved, the County bills the district for the publication costs. For those that are not approved, the County bills the chief petitioners.
