A meeting of the Board of County Commissioners was held on December 18, 1997. Commissioners present were Nancy Pope Schlangen and Linda Swearingen. Commissioner Bob Nipper was out of the office. Also in attendance were Rick Isham, County Counsel; County Administrator Mike Maier; Sheriff Greg Brown, the media, other staff and a few interested citizens. This meeting had to do with the financial ramifications of the new 'kicker' tax rebate program. Discussion of certification regarding the Sheriff's budget amounts under Measure 50. It was noted that the State used to take the old tax base and add 6%. They are doing it differently now. A lengthy discussion occurred regarding the 'black box' and how the numbers are computed. They used a formula for 1995-96. This has to do with the new 'kicker' measure. The legislature may not help due to the impact on the schools. It doesn't do any good to go to the Attorney General to ask for an opinion, because it appears that it is clear on its face and they did exactly what the law has stated. A legal injunction will not provide the County with any relief at this point. Gresham County has the same problem, and there are eight other counties that have new levies and the same problem will probably come up. The State just doesn't want to deal with it. Measure 50 did not exist when the County put together its levy. So there was no way to adjust for it. A permanent rate is mostly for the convenience of the State, and this did not benefit the taxing districts or taxpayers. There was a long discussion about whether the tax collector could withhold turning in funds until this is worked out legislatively. A long, heated discussion about this issue occurred. The County can hold some of the taxes for a period of days before disbursing it to the schools and other taxing districts. This would be done in the hope that the State will figure out the impacts to the counties and find some kind of resolution to the problems this is causing. The County will send letters to the taxing district, asking if it is okay for the County to hold onto the tax funds until it is known exactly what can be disbursed, according to the new law. There was a discussion about disbursing what would normally be disbursed, and holding back the rest until this is worked out. The Treasurer is concerned about legal ramifications if he does not do what the law says he needs to. However, there will be costs involved in managing this huge change and the certification method. A letter will be sent to the legislature detailing the problems this has created, and ask for some kind of creative solution. The meeting was adjourned until December 24, 1997.
