A meeting of the Board of County Commissioners was held on October 26, 1998. Commissioners present were Nancy Pope Schlangen, Bob Nipper and Linda Swearingen. Also in attendance were Rick (sham, County Counsel; County Administrator Mike Maier; the media, other staff and a Targe number of interested citizens. Items discussed at this meeting may be on a future Board business meeting agenda. Discussion of signature of Order 98-151, vacating a portion of Hood Street in Sisters. Discussion of signature of an Order initiating the vacation of a 12 -foot utility easement that is not needed. This resulted from the completion of a lot -line adjustment. Transcription of Audio Recording of a Work Session, October 26, 1998 Page 1 of 6 Discussion of a meeting the City of Bend had where they were not supportive of accepting roads into the City, even though by agreement with the County they were to do this once the area was annexed. Commissioner Nipper wants to be sure the County is no longer liable. Staff told him that he has been misinformed by someone. Mr. Nipper wants this put out in a press release so that it is clear to everyone. There was a long, lively conversation about his frustration with dealing with the City of Bend on a number of issues. Discussion of signature of an intergovernmental agreement between the State of Oregon and the County for gambling addiction treatment services. There was a long discussion about how to handle addiction in general, and specifically gambling. Staff went into detail about how this type of program works. Mr. Nipper is frustrated that they encourage people to go out and play video poker, and then the County has to treat them for gambling addiction. Discussion of the KIDS Center and its recent reorganization, and a new contract with the County. Discussion of signature of Resolutions transferring appropriations of various funds in the current budget. Discussion of General Policy P-1398, the investment policy guidelines, as amended. Discussion of signature of a memorandum of understanding with the City of Redmond regarding 19th Street. Discussion of approval of a letter bond to guarantee public improvements. Rick (sham gave an overview of the purpose of the document. Mr. Isham said that this just updates Code as required, in three places. Discussion of signature of Resolution 98-105, declaring the County's intent to issue obligations to reimburse the County for certain expenditures. Mr. (sham went into a lengthy explanation. Discussion of signature of Orders authorizing the refund of taxes. Discussion of approval of declaring the intent to exchange properties for Health and Human Services, and for the Becky Johnson Center. Discussion of approval of reappointing Ray Litton to (?) — did not state. Discussion of approval of the reappointment of Darrell Wilson and Bob Slawson and the appointment of Deb Krager to the Special Transportation Fund Advisory Committee. Discussion of Mr. Nipper's comments regarding Debra Hogan's request for the County to set up a countywide transportation safety committee. Commissioner Swearingen said she sat on the City's for five years and not much of anything happened. Ms. Hogan has a personal agenda, especially regarding Erikson Road and Neff Road. An appropriate letter will be sent to Ms. Hogan. Discussion of signature of a Resolution approving an economic development grant for the project fund. The Board expressed frustration with how hard it is to deal with the State. Discussion of approval of a grant received for the Healthy Start program. Discussion about a surfacing mine that was not rezoned totally. The lots are not contiguous, and they have been advised. Commissioner Swearingen feels that they should have been advised of the two lot separately to avoid confusion. Staff feels that the notice that was sent out was enough. A long, heated discussion then ensued. Transcription of Audio Recording of a Work Session, October 26, 1998 Page 3 of 6 Discussion of waiving Al Lindenhall's fees for the lot of record decision, as requested by Commissioner Swearingen. His neighbor, Gordon Gregory, was allowed to build. Mr. Lindenhall tried to follow the law and ended up paying more for it. Dave Leslie feels that Paul Blikstad's decision in 1988 was correct. It was not part of a subdivision because it was done two days before the other lots were formed. They need to look at the recording dates before changing anything. A lengthy and somewhat heated discussion ensued. Commissioner Swearingen said that perhaps the subdivision lots did not follow the law, but the County subsequently issued building permits, so has some responsibility. Commissioner Nipper brought up an issue regarding a number of septic feasibility permits issues in the La Pine area during the winter months. He wants to know how this could happen, when many of those lots are probably not really buildable. He wants to know what is being done proactively about this, when someone who owns one of those lots retires and comes for a building permit to build a home, after buying the lot and paying taxes on it maybe for years. Mr. Leslie said this is a big part of the regional problem solving project. They did send out 12,000 notices to owners of lots that could be a problem. The water table is now seven feet higher than it was just five years ago in some places. Even though the feasibilities were granted, because of water temperature, mottling did not show up in the test holes, which is how they make the determination. Now there is obviously a problem. They have better data now. Conventional wisdom now has it that about 1.5 acres is a sustainable density with a sand filter system, and two acres with a standard system. So this is probably going to be the buildable minimum lot size in the future. Some will be subject to transfer development rights to compensate them. The amount might be about $6,300 on undeveloped lots. There are 1,800 in the high water area and about half of them never applied for a septic system. About 400 people responded to the 12,000 letters sent out. Many people who own the property did not even have plans for it yet. Most are valued at well under $5,000 per lot. This is going to be the biggest test area for new sewer or septic technology in the country. The hope is that the citizens and property owners will appreciate all of this and will work with the County and other agencies to make the best of a difficult situation. Discussion of approval of the joint management agreement with the City of Sisters. A lengthy discussed ensued. Discussion of issues with the Water Resources Board regarding the use of groundwater. As their briefing paper is written, it would make it almost impossible to allow new destination resorts or other big developments. A long, heated discussion occurred. Mr. Isham was surprised not by the decision, but by how quickly it was issued. The Board feels that this is a deliberate act through the Governor's Office to try to control growth in the State. They gave the last big batch of water rights to Water Resources and the Tribes, so they can say there just isn't any more water, so no growth can happen. Or, water will simply just cost more. This could affect the well for the La Pine Industrial Park and its subsequent development. Discussion of setting up a meeting with the 9-1-1 County Service District as soon as they know who wins the election next week. Commissioner Swearingen did a lot of edits to the draft Ordinance and wants it to not be so specific. A long conversation then took place.
