DESCHUTES COUNTY BOARD OF COMMISSIONERS
Audio Cassette Recording Titled: WORK SESSION
September 29, 1997; 10:00-11:45 AM.
A meeting of the Board of County Commissioners was held on September 29,
1997. Commissioners present were Bob Nipper and Linda Swearingen.
Commissioner Nancy Pope Schlangen was out of the office. Also in attendance
were Rick Isham, County Counsel; County Administrator Mike Maier; the media,
other staff and a Targe number of interested citizens.
Items discussed at this meeting may be on a future Board business meeting
agenda.
Discussion of approval of Resolution 97-120, declaring October 1997 as National
Disability Employment Awareness Month. Lin Gardner from the State spoke on
behalf of the declaration. A long discussion ensued.
Commissioner Swearingen moved signature of the Resolution, and Commissioner
Nipper seconded it. It was unanimously approved.

Discussion of a public hearing to consider submitting a Community Development
block grant application to the State Economic Development Department for
construction of the La Pine public water system.
Susan Mayea said one hearing has been held, and a second one is required. They
closed out the Terrebonne project, so are now allowed move on to the La Pine
grant application. The total project is estimated to be a little over $6 million.
Discussion of signature of a local agency agreement for the rail -highway crossing
program project for NE Maple in Redmond, and the Burlington Northern -Santa Fe
Railroad. Tom Blust said this is a federal and state program for replacement or
upgrading of railroad and highway crossings.
Discussion of signature of Resolution 97-131, accepting a petition to vacate a
portion of Hunnell Road, accepting the engineer's report, and signature of Order
97-143, setting the public hearing date for the vacation. This is an old right of way
that was discovered with all of the new development happening in that particular
area.
Discussion of approval of a request for out of state travel for Debra Rossword (?)
for Ready -Set -Go training.
Discussion of signature of Order 97-140, authorizing the refund of taxes.
Discussion of signature of an intergovernmental agreement with and the 9-1-1
County Service District for GIS services. Mike Maier said the Board had discussed
this a couple of weeks ago. Staff said that they have not been able to provide
total services to the public since they cannot recover the true cost of providing
those services.
There is a section of Oregon statute that allows them to form an agreement with
another agency so that they can charge reasonable and fair market value for
these services. Therefore, there is an agreement drafted to include 9-1-1.

Discussion of signature of an intergovernmental agreement with the City of Bend
to enforce the City's vehicle forfeiture ordinance. This is a renewal of what is
already being done. The County will be doing all of the legal work for the City, for
a fee.
For some reason, Sheriff Greg Brown feels that it would be much better if the
County had control of this program. This will eliminate some communications
problems.
Discussion of signature of a professional services agreement with Joseph
Robertson for attorney services.
Discussion of signature of a contract with the Humane Society of Redmond. Mike
Maier gave an overview of the item. The agreement is similar to the one with the
Humane Society of Central Oregon. They will also cremate animals that are not
adopted at a rate of 7 cents per pound. HSCO charges 50 center per pound to do
this.
Animal control will need to take animals from all areas to Redmond. This does
create some problems because of the distance for both the officers and those
people wishing to reclaim their animals.
Mr. Maier said they are looking at working with some people in La Pine who wish
to provide an outlet for found animals.
Discussion of the Animal Task Force meeting. Commissioner Swearingen said this
is the first meeting, and they will look at ways to deal with various animal
problems in the area.

Discussion of approval of the appointment of Bruce Bond to the Black Butte
Ranch County Service District board of directors.
Discussion of an agreement with Patrick Gisler regarding the 2.5 acre property
zoning issue. Mr. Gisler and his attorney, Dan Van Vactor, came before the Board.
Mr. Van Vactor explained there is a continuing problem that did not find a
solution through the Court of Appeals.
They did not accept the legal argument that was proposed and supported by the
Board. This resulted in Mr. Gisler having to appeal to the Supreme Court or doing
the alternative, a legal fix.
He went into detail at length about the situation, which affects about 200 acres of
SR -2.5 land.
Commissioner Nipper said this is not a new issue, and wasn't fully discussed years
ago when it should have been. The applicant wants the Board to indicate support
in writing, in some fashion.
Staff said that this is partially under the jurisdiction of the City of Bend, so to take
that course would probably create as many problems as it would solve. It would
not require a hearing but the City doesn't have time on its docket until sometime
after the first of the year.
Discussion of approval of the appointment of Garth Cook to the Redmond Urban
Area Planning Commission. George Read said that Mr. Cook is an employee of
Environmental Health, and he has a question about this if the County is involved
in an issue.
There could be potential for a conflict of interest, and he would have to disqualify
himself. The City has already appointed him. This was removed from the agenda
until more information can be obtained.
