DESCHUTES COUNTY BOARD OF COMMISSIONERS
Audio Cassette Recording Titled: WORK SESSION
September 28, 1998; 10:00-11:15 AM.
A meeting of the Board of County Commissioners was held on September 28,
1998. Commissioners present were Nancy Pope Schlangen and Bob Nipper.
Commissioner Linda Swearingen was out of the office. Also in attendance were
Rick Isham, County Counsel; the media, other staff and a small number of
interested citizens.
Items discussed at this meeting may be on a future Board business meeting
agenda.
Discussion of the final hearing and consideration of signature of Order 98-148, the
Keller annexation into Rural Fire Protection District #2 in the Terrebonne area.
There had to be some corrections to the legal description on the maps prior to
signature.
Discussion of a continued public hearing on the Sisters and Deschutes County
urban growth management agreement. This was to allow further review by
Counsel. Arlu Deco lost its appeal at the State level.

Discussion of a public hearing on the adoption of Ordinance 98-063, amending
Title 18 and establishing zones. Staff explained this is mostly housekeeping to be
consistent with state law. Dave Leslie went into detail on the issues.
Discussion of a situation with Bend Aggregate, which has been using part of the
County's land for operations. This occurred because of an ODOT realignment that
temporarily caused issues for the company.
Discussion of signature of an agreement with the Humane Society of Central
Oregon. Commissioner Nipper asked what they would charge by the pound to
make 'crispy critters'. They lease the ground for $1 a year. There were concerns
about not having any checks or balances on what animals they take in and
whether charges are merited.
Discussion of signature of a personal services contract with the Bend Recycling
Team. This is a continuation of last year's contract with a few adjustments and
additions.
Discussion of signature a purchase agreement with DB Consulting for imaging
software for data processing. It includes a statement that this software will be
Y2K compliant. There was a lengthy discussion as to what information should be
made easily available to the public via the various software programs, and
whether this would impact revenue.
Discussion of signature of a sub -grant agreement with Bend Metro Park and
Recreation District.
Discussion of adoption of Ordinance 98-065, changing code reference format
within Code. This is a housekeeping matter to make non -substantive changes as
necessary.
Discussion of signature of an Order authorizing the refund of taxes.
Discussion of a lawsuit against the County at the federal level. Some of the issues
have already been litigated.

Attorney Joe Robertson will be representing the County in this situation. The
Board should meet with him collectively in case a decision needs to be made.
The Board decided to meet with him in executive session instead of meeting
individually.
Discussion of whether the County will be able to acquire land from the BLM for
the regional problem solving project.
Discussion of an upcoming meeting with Sisters and the public to discuss Squaw
Creek water rights.
Discussion of a variety of upcoming meetings.
