A meeting of the Board of County Commissioners was held on August 11, 1997. Commissioners present were Nancy Pope Schlangen, Bob Nipper and Linda Swearingen. Also in attendance were Rick Isham, County Counsel; County Administrator Mike Maier; the media, other staff and a large number of interested citizens. Items discussed at this meeting may be on a future Board business meeting agenda. Discussion of a public hearing on Ordinance 97-038, proposed design review standards for Title 19 of Code, the Bend Urban Growth Boundary zoning ordinance. Paul Blikstad explained the item, which adopts city standards. This relates mostly to commercial properties along Highways 97 and 20. Discussion of a public hearing on Order 97-114, for consideration of the annexation of Wickiup Junction into the La Pine Special Sewer District, and setting a final hearing date. This involves the Larkspur Trail. This is property that the County took in foreclosure, and it connects the trailheads. Discussion of signature of a sublease assignment for an Awbrey Butte transmission site. Discussion of approval of a request for out of state travel for two employees to attend a child support conference in Montana. Commissioner Nipper asked why two need to attend. He was advised that both need this training for certification purposes. One is the prosecutor out of the District Attorney's Office. It is also mostly funded from a federal grant. Discussion of approval of a personal services contract with Direct Consulting, and approving a capital outlay expenditure for medical records software and hardware. Staff gave a lengthy explanation of the item. Discussion of approval of the award of a contract to Bend Aggregate and Paving for the North Pine Street reconstruction project, in Sisters. Discussing of signature of Orders 97-109, 97-110, 97-111, and 97-112, authorizing the refund of taxes. Discussion of approval of a contract with Asset Valuation Services, for inventory and appraisal services. Marty Wynne provided an overview of the services offered by this company, and the reasons he wants the contract approved. They will barcode everything in the County that needs to be coded, such as equipment and furniture. It will be for anything valued $500 or more. The County will buy the software and can utilize it into the future. Transcription of Audio Recording of a Work Session, August 11, 1997 Page 2 of 4 Discussion of adoption of Ordinance 97-060, amending PL -20, the Comprehensive Plan, relocating Burgess Road and Highway 97 at Wickiup Junction. Commissioner Nipper noted that no matter what they do, there is going to be someone in La Pine who is not happy with it. Discussion of the adoption of Ordinance 97-054, amending the Bend Urban Area General Plan to designate certain property for surface mining. This property is located west of Century Drive, just east of Broken Top, and would be for 4-R Equipment. This would be an expansion of their existing site. Discussion of the adoption of an Ordinance amending the Bend Urban Area General Plan map. Discussion of the adoption of an Ordinance amending the Bend Urban Area zoning map. Discussion of the adoption of Ordinance 97-058, adopting Code Section 1.16.045, private right of action. Staff explained that this says that if the County determines it is not going to take enforcement action on one of its own Ordinances, a citizen has a right to do so. A citizen, Fran (?) explained that she has a real problem with this. These are people who don't know the law and this kind of thing could cause a lot of problems. There is a high potential for abuse that would create even more of an issue. If you have an ordinance in place and are not willing to enforce it, then you should get rid of the ordinance. This is like asking people to arrest someone for a crime because the police don't have enough time to do it. A lengthy, somewhat heated discussion followed. Discussion of the adoption of Ordinance 97-061, amending Code regarding the County Clerk. Discussion of signature of a liquor license application renewals for Hampton Station, Lucky's Tavern, Quail Run Golf Course, Dancing Boots in Tumalo, and the Gourmet Cowboy Cafe, and Rock Springs Guest Ranch. Discussion of signature of an Order transferring funds within the current fiscal year budget. Discussion of the appointment of Norm Wiggins to the Special Road District #1 board of directors. Discussion of upcoming meetings, including budget priorities.
