A meeting of the Board of County Commissioners was held on March 23, 1998. Commissioners present were Nancy Pope Schlangen and Bob Nipper. Commissioner Linda Swearingen was out of the office. Also in attendance were Rick Isham, County Counsel; County Administrator Mike Maier; the media, other staff and a small number of interested citizens. Items discussed at this meeting may be on a future Board business meeting agenda. Discussion of ratifying signatures on the City of Redmond site plan agreement for improvements. Discussion of a public hearing on the adoption of Ordinance 98-001, amending PL - 20. This is a plan amendment and a zone change for a portion of Midstate Electric Cooperative property in La Pine. This will make the uses now in place more consistent, as commercial. Transcription of Audio Recording of a Work Session, March 23, 1998 Page 1 of 5 Discussion of a public hearing on Order 98-040, a petition to withdraw territory from the Vandevert Acres Special Road District. There needs to be 15% of the electorate willing to put this to an election. Discussion of the award of a contract to Century West Construction regarding inspection and testing services for the new Fairgrounds. Discussion of approval of the award of a contract to R. L. Coats Company for the reconstruction of Reed Market Road, after which time the project will transfer to the City of Bend. Discussion of approval the construction and improvements to the parking lot in the Smith Rock State Park area. Commissioner Nipper said he got a call from Andy Andrews regarding Dodds Road, and the fact that it says 'no through trucks', but the Sheriff's Office says they can't enforce it because the signs are the wrong color. Staff said it is almost impossible to enforce this because they can't have a deputy sitting there all day. He will be talking with the State Weighmasters about weight loads, and what can and can't be done. Staff feels that it might be in Andy Andrews' own mind exactly how many trucks are creating a problem. Discussion of improvements to Skyliner Road. Staff said they can't do a lot there until after the snow is gone. Discussion of speed signs being located on Mt. Washington Road by the developer, which are being enforced by the City police. Staff said that perhaps the City authorized the signs and hired the developer to install them. Frank Moore said this is for an employee who is going to be a presenter at the event. Discussion of approval of a contract with Dr. Jeff Hyde for mental health services. The same applies for Dr. Morrison. The rate is consistent with that of ABHA, which is $100 per hour. Discussion of Mr. Nipper's observation that the penitentiary is dealing with a large number of people with mental health as well as criminal issues. Staff agreed that there are more people with mental health issues in jail than there are in mental institutions. Many of them are just being stabilized for their condition and not really helped long-term. Discussion of a potential grant for youth mental health services; mostly dealing with substance abuse issues in those youth. This will require coordination between the Local Public Safety Coordinating Council and the Commission on Children & Families. Mr. Nipper would like to discuss what they are doing with the Juvenile facilities, in the hope that they can do some mental holds there. He said that he did not feel that way before but has changed his mind. He now sees a significant need for this type of care. Discussion of consideration of signature of Order 98-043, related to leaving the record open on the realignment of Nelson Road, at the request of the City of Bend. This allows for a rebuttal period. It will be open until April 8. Mr. Nipper said that he met with some of the people involved, but that nothing was discussed that was different than he has already heard. Rick Isham said he is worried about a procedural error regarding ex parte contact, if this ends up in an appeal. Mr. Nipper said someone should have told him not to go to the meeting in question. He will just disclose this conversation at the hearing so no one should care. This is for some equipment at Public Works that has not been used for some time. Discussion of whether to hear Appeal A-98-2, a conditional use permit on a dwelling in the F-2 forest use zone. Staff explained that this is an application for a temporary dwelling, and went over the history of the property. Most of this property is adjacent to others that is divided into smaller parcels zoned F-1. The only real difference between F-1 and F-2 at this point is that F-1 does not allow destination resorts. State rules have changed since this was first put in place in 1972. The zones have grown very similar. There are a lot of temporary dwellings in the area, probably most without any kind of permits. Mr. Nipper complained that many people say that when they try to get something done, the County can't find the records. And by the time they do, the laws have change. A lengthy, heated conversation ensued. Commissioner Nipper indicated that he'd like to go out and tour the area. Commissioner Schlangen said she thought she saw the area, but might have been lost, so isn't sure. This issue was put off for a week. Discussion of approval of an Order transferring funds within the budget. Discussion of signature of two Orders authorizing the refund of taxes. Discussion of approval of the appointment of Michael Hinton to the Housing Authority. Discussion of vacancies on the Deschutes County Province Advisory Committee for the Fort Rock Ranger Station. Mr. Nipper said he does not want to be involved; neither does Commissioner Schlangen. She suggested finding someone else to represent the County. There are already several meetings at AOC that same day. Commissioner Swearingen has been involved but they want all three Commissioners there.
