DESCHUTES COUNTY BOARD OF COMMISSIONERS
Audio Cassette Recording Titled: WORK SESSION
September 8, 1997; 10:00-11:45 AM.
A meeting of the Board of County Commissioners was held on September 8, 1997.
Commissioners present were Nancy Pope Schlangen, Bob Nipper and Linda
Swearingen. Also in attendance were Rick Isham, County Counsel; County
Administrator Mike Maier; the media, other staff and a large number of
interested citizens.
Items discussed at this meeting may be on a future Board business meeting
agenda.
Discussion of approval of a request to award a contract to David Evans &
Associates for monitoring and general engineering services regarding the landfill.
There were 37 requests for information but only three firms submitted a
proposal. One was slightly lower in price, but they are located in Eugene and that
is a concern.

Commissioner Swearingen said she has a problem with not going with the low
bidder as long as they can perform at the same level. Commissioner Schlangen
said they rated the firms on a variety of factors, and not just price. Work on the
east side can be very different than that on the west side of the mountains, which
is where the one firm had all of its experience.
Al Driver said they often have to meet with the DEQ on short notice, and this
could be an issue. He went into detail on the bid process and what is expected of
the firm.
Commissioner Nipper said he is very sensitive to the perception regarding low bid.
He agrees with Commissioner Swearingen that there need to be clear criteria as
to why a bid would be rejected. This will be discussed later today and reviewed
by others to see if it is warranted.
State Senator Neil Bryant briefly discussed the community investment program
with the Board, with private citizens helping with decisions in this regard.
A special proclamation was read about a positive role model, a local young man
who reached a high level of performance by becoming a member of the National
Football League, Ryan Longwell of the Green Bay Packers. He was named as an
honored son of this community.
Senator Neil Bryant will be meeting with Mr. Longwell and the Board asked him to
present the proclamation to him.
Discussion of approval of Resolution 97-127, adopting the Community Youth
Investment Project. Dennis Maloney offered some comments about this new
project.
Discussion of signature of an amendment of the cooperative Forest Service law
enforcement agreement. This allows the County to purchase some additional
radios and other equipment.

Discussion and acknowledgment of the retirement of Terry Silbaugh from the
Sheriff's Office. He was very involved in Search & Rescue activities.
Discussion of signature of Resolution 97-119, accepting a petition to vacate a
portion of Strickler Avenue, an alley in Tumalo. George Kolb explained that this
item is not ready for approval.
Discussion of approval of the award of a contract for the realignment of Burgess
Road. Mr. Kolb said three firms acquired documents, and two of them bid on it.
The low bidder was R.L. Coats.
Discussion of signature of a grant agreement for detox residential services. Frank
Moore said this is for the Rest Care detox facility that is now coming on line in the
Redmond area.
Discussion of approval of an agreement with the Opportunity Center for
supported employment, transportation and residential needs.
Discussion of approval of an agreement with CORIL for transportation and
supported employment.
Discussion of approval of an out of state travel request for Dan Haldeman.
George Read stated that this is program put on by the University of Washington
engineering department to demonstrate new technology, ways to deal with
nitrogen loading and other issues facing the County right now. The State DEQ
people will be there as well.
Discussion about Clerk Susie Penhollow's trip to Bosnia to help with their
elections process.
Discussion of signature of an Order transferring cash within various funds of the
current budget.
Discussion of signature of a lease to upgrade the County's new IBM computer
system.
Discussion of approval of a codification contract with Sterling Company regarding
Code.

Discussion of the adoption of an Ordinance adopting section 1.16.045, private
citizen rights action. There was a long, heated conversation about this issue. It is
hoped that this would rely more on mediation. Citizen Fran Franklin feels that
this is to relieve the County of doing its job on things it doesn't want to address as
it should.
Commissioner Nipper said that citizens came to the Board and asked that the
County try to get the owner of a property on 93rd Street to clean it up. It was a
code violation. Now it is worse than it ever was. If the County can't correct a
problem, how can it expect a private citizen to do it? The owner has been in court
many times, and yet the problem still persists. He is worried about citizens
feeling like they have to take things in their own hands since the County won't do
its job. This is potentially a dangerous scenario.
Discussion of approval of a personal services contract with the Humane Society of
Redmond. A lengthy discussion ensued.
Discussion of a meeting with departments and their recommendations regarding
strengthening the employee parking policy. This means having stickers on
vehicles. There will not be a charge because that affects the status of the
County's public properties. However, this might help keep people from using
parking spaces when they are not employees or aren't visiting the County on
legitimate business.
The Board indicated that they would like to have reserved spaces since they come
and go often during the day. This will be discussed later in the day.

lease with Bend Aggregate.
