Order Approving Annexation into the Bend
Park & Recreation District * ORDER NO. 2017-042

WHEREAS, a petition by Nancy Moran requesting annexation of property into Bend Park &
Recreation District ("District") was duly accepted by the Deschutes County Board of County
Commissioners ("Board") on October 25, 2017; and
WHEREAS, the Deschutes County Assessor's Office verified that a sufficient number of real
property owners within the areas to be annexed signed the petition; and
WHEREAS, the Board held a public hearing on November 20, 2017, to determine whether, in
accordance with the County Comprehensive Plan and County Zoning and the criteria prescribed by
ORS 197.175 and 198.850, the affected area would benefit by annexation of said territory into the
District, and there being no objections presented at the hearing; now, therefore
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
HEREBY ORDAINS as follows:
Section 1. The Petition for Annexation referenced in Order No. 2017-041 is hereby
incorporated by reference.
Section 2. The property identified in Order No. 2017-042 corresponding exhibits is annexed
and included in the District.
Section 3. The annexation meets the applicable County zoning and County Comprehensive
Plan criteria described in Exhibit "C," attached to the petition hereto and by this reference
incorporated herein.
Section 4. A copy of the signed Order will be forwarded to the Oregon Department of
Revenue, Oregon Secretary of State Archives Division, Deschutes County Assessor's Office and
County Clerk's Office, and the District.
Section 5. The purpose of this District is to provide parks and recreation services.

RE: Land Use Compatibility / Moran Petition for Annexation into Bend Park &
Recreation District
The materials contained in Order 2017-041 are consistent with Title 18, Deschutes County
Zoning Ordinance, Title 19, Bend Urban Area Zoning Ordinance, and Title 23, Deschutes
County Comprehensive Plan. There are no local land use regulations or policies that specifically
address the Bend Park and Recreation District and annexation.'

RECOMMENDATION & ACTION REQUESTED:
Motion: Approval of Order No. 2017-042.
BACKGROUND AND POLICY IMPLICATIONS:
On October 25, 2017 the Board accepted a petition to annex property at 20990 Yeoman Road into the Bend
Park & Recreation District and set a public hearing for November 20, 2017. The annexation is a requirement
of the landowner's application to partition the 7.17 -acre property into two parcels in the Suburban Low
Density Residential Zone. The Community Development Department already has approved that application.
Bend Park & Recreation submitted a letter agreeing to annex the property once the landowner completes all
requirements. Attached is a memo from Peter Gutowsky, Deschutes County Planning Manager, stating his
opinion that the annexation is consistent with the County's Zoning Ordinance and Comprehensive Plan.
FISCAL IMPLICATIONS:
The County provides all the staff costs for all special district formations and boundaries changes. For
district formations and other boundary changes that are approved, the County bills the district for the
publication costs. For those that are not approved, the County bills the chief petitioners.
