DESCHUTES COUNTY BOARD OF COMMISSIONERS
Audio Cassette Recording Titled: BUSINESS MEETING
June 20, 2000; 10:00-12:15 PM (2 tapes).
A meeting of the Board of County Commissioners was held on June 20, 2000.
Commissioners present were Dennis Luke, Linda Swearingen and Tom DeWolf.
Also in attendance were Rick Isham, County Counsel; County Administrator Mike
Maier; the media, other staff and a large number of interested citizens.
A lengthy presentation of a report from the Citizens' Advisory Committee on the
outdoor lighting ordinance. George Read said this was created to help CDD
implement the ordinance in a proactive manner.
It was adopted in 1994, and the biggest issue is getting previously installed lights
into compliance.
He and members of the Committee went into detail regarding the ordinance,
activities to implement it, information from other areas of the country, and
additional plans for future action.

Discussion between the Board and staff regarding a public hearing to consider
adoption of the 2000-2001 fiscal year fee schedule. Susan Mayea presented the
latest version. A few department representatives explained some changes to
their departments' newest fee schedules.
At this time, the public hearing was opened for testimony. William Kuhn said he
will be bringing to the Commission in the next few weeks evidence of a lack of
sufficient funds to handle code enforcement, and the general inspection division.
He thinks either fees need to be raised more to handle this, or make general
funds available for CDD. He went on at length about the situation he wants to see
resolved.
No other testimony was offered, so the hearing was closed.
LUKE: Move adoption of the fee schedule, with the changes as presented by
staff.
DEWOLF: Second.
The vote was unanimous in support.
A public hearing to consider adoption of Ordinance 2000-017. Dave Leslie of CDD
suggested that the hearing be opened but continued to a date certain. It is
possible that an ordinance is not required, but they should proceed in this fashion
in case it is.
The hearing was opened at this point. Being no testimony, the hearing was
continued to July 26.
A public hearing to consider adoption of a text amendment, to add an eight -level
plan for forest lands. Damian Syrnyk spoke about the proposed ordinance,
exhibits, correspondence that has been received, and the file in general.
Dave Hunnicutt of Oregonians in Action testified. He is representing his client,
Mr. Watts, who may be negatively impacted by this ordinance. He had
suggestions of additional language for the County to add.

Lee Kuhn said she lives across the road from the property being discussed, and
wanted to clarify some of the information that she feels is incorrect. She said
there are 26 ponderosa pines on the three adjacent properties. She feels this
constitutes a forest in the 40 acres. She and her husband have planted an
addition fifty pine trees. She went into great length into other details regarding
the local lands and her fear of the area becoming over -developed.
William Boyer of Jordan Road in Sisters testified that he feels the County is doing
this to allow people to build more houses because there was a threat of a lawsuit
against the County. There was a heated discussion between the Commissioners
and Mr. Boyer regarding this comment.
Howard Paine of the Alliance for Responsible Land Use in Deschutes County, also
known as Arlu Deco. They are opposed to this ordinance and don't think it is
proper to change its laws in reaction to a lawsuit. He went on in detail about his
opinion
Commissioner Swearingen said there are perhaps a total of 76 parcels affected by
this change. If it is apparent that there is a problem, the County should fix the
problem.
William Kuhn again testified at length, complaining about how the County has
handled his particular situation. He was asked to not read what he has already
submitted in writing. He complained that he should get at least as much time as
everyone else has had to talk. Commissioner Luke said it is too bad the rules were
not in place when Mr. Kuhn built his house, because he would not be living there
now.
Eventually the hearing was closed but the record was kept open until July 5 for
written comments.
Signature of an amendment to a personal services agreement with Maple Star
Oregon. Luke moved approval, DeWolf seconded; passed unanimously.
Consideration of adoption of the consent agenda. Luke, DeWolf, unanimous.

Consideration adoption of Resolution 2000-036, adopting the Deschutes County
budget for fiscal year 2000-2001. DeWolf, Luke, unanimous.
Consideration of adoption of Resolution 2000-037, making appropriations within
the new budget. DeWolf, Luke, unanimous.
At this time, the budget and appropriations for the 4H -Extension County Service
District were unanimously adopted.
The budget and appropriations for the 9-1-1 County Service District were
unanimously adopted.
The new fee schedule for the 9-1-1 County Service District was unanimously
adopted.
The budget and appropriations for the Sunriver Service District, Black Butte Ranch
County Service District and the various Library Districts were considered and
unanimously adopted.
Consideration of approval of weekly accounts payable vouchers for the County,
4H -Extension County Service District, and for the 9-1-1 County Service District.
Unanimously approved, subject to review.
Consideration of signature of letters of appointment to the Project Impact
Steering Committee. Unanimously passed.
Consideration of signature of a personal services agreement with the Humane
Society of Central Oregon. Mike Maier said this is the annual contract, with some
minor changes. The cremation amount has gone up to 75 cents per pound as
well. Unanimously passed.
Consideration of a decision on Appeal A-007, File MP -003, regarding the
Cook/Gentry land use issue. Staff explained the draft decision. Luke: Move
reversal of the Hearings Officer's decision, allowing this to go forward with the
conditions specified by the Fire Marshall. DeWolf seconded. Unanimously
passed.

Discussion of the Four Winds issue. The bid did not arrive on time and the Board
wants to know if it should be opened or disregarded, depending on whether there
were extenuating circumstances. Susan Mayea said it was due at 4 PM but they
claim they had been sent to the wrong building. However, all the other bidders
showed up at the right location and on time, and it was clearly printed on the bid
documents.
Commissioner Luke said they did not follow the specifications like the other
bidders had. He does not think their bid should be considered. Commissioner
Swearingen feels the bid should be rejected or that would open the County up to
a lawsuit from the others who did what they were supposed to.
Luke voted to reject the bid; seconded by DeWolf; unanimously supported.
