MJP-90-2 created this public right of way by partitioning an 80 -acre parcel into two 40 -acre parcels in Township 14 South, Range 12 East, Section 26A, Tax Lots 100 and 200. The public right of way is approximately 400 -feet long, extendng west from NW 66th Street and ends in a cul-de-sac. Subsequent land use decisions 247-16-000444MP1445-CU/446-CU and 247-16-000798-MP/799-CU/800-CU created more parcels, resulting in four total. The renaming is a condition of approval and 247- 17 -000943 -RN renamed this public right of way as Grange Court. A copy of that decision is attached. DCC 16.16.030(J) requires.a Board order to complete the naming process. FISCAL IMPLICATIONS: None, this is a local access road, not a County -maintained road. The renaming is a condition of approval of File 247-16-000798/799-CU/800-CU. STAFF CONTACT: Peter Russell, Senior Transportation Planner I. APPLICABLE CRITERIA: Title 16 of the Deschutes County Code, Addresses and Road Names: Chapter 16.16, Road Naming U. BASIC FINDINGS: 1. LOCATION: The subject road is located in the Redmond postal area, and is further described as being in Township 14 S, Range 12 E, Section 26A. The specific tax lots are 100 and 200. 2. The proposed road name, Grange Court, is for an existing local access road that extends west of NW 66th Street and was created originally under MJP-90-2. The unpaved right-of- way extends approximately 400 feet to the west of NW 66th Street. This local access road has no official name. The addresses along the road are currently based on NW 66th Street, which is a local access road. 3. Pursuant to Deschutes County Code (DCC) 16.16.030, the Community Development Department initiated the application to name this road. Due to an unusual set of circumstances, Planning Division staff is undertaking what is normally the requirement of the property owner and/or land use applicant. 4. Notice of this proposed road naming was mailed out to public agencies that provide services in this area (Central Electric Cooperative; Deschutes County Assessor; Deschutes County Road Department; Deschutes County Surveyor; Property Address Coordinator; Pacific Power and Light; Redmond Fire & Rescue Dept.; Redmond Parks and Recreation District; Quality Services Performed with Pride Redmond School District 2J; US Postal Service; and the Oregon Watermaster — District 11), as well as to the adjoining properties that have NW 66th Street as a street address. 5. The Planning Division received the following transmittals: Cody Smith, County Engineer, Deschutes County Road Department in a Dec. 15, 2017, e- mail: The unnamed road in 14-12-25B and 14-12-26A is a local access road. The road was dedicated to the public and accepted by the County by Partition Plat #1991-61. A copy of the plat is attached; the dedication and acceptance statements are shown below. Redmond Fire and Rescue replied in a series of e-mails: Clara Butler, Deputy Fire Marshal, Redmond Fire and Rescue, wrote on Dec. 12, 2017: I am going to forward this to Chief Jeff Puller but the naming needs to follow Deschutes grid and I am guessing Grange won't work. I have cc'ed Chief Puller on the email so we can get his input. Jeff Puller, Battalion Chief, Redmond Fire and Rescue, wrote on Dec. 15, 2017: I have taken a look at this Cul-de-sac and it should be named NW Jordan Ct. since it intersects near the 6200 block of NW 66th St. I do not have a map to send you to show how far the Redmond grid extends. However it extends to the boundaries of our Fire District to the South, and ends at SW Herford Ave. Extends north to the county line ending with NW Povey Lane. Roads to the East and west are numbered streets. If you turn on Fire District boundaries on dial it will be pretty close to representing how far the Redmond grid extends. I will also include a copy of the hundred blocks that correlate with the grid street names. Can be a little confusing. I am happy to help or answer question. Thank you Staff addresses Redmond Fire and Rescue's comments below under DCC 16.16.030(E) and (F). The following agencies did not respond to the transmittal notice or had no comment: Deschutes County Assessor, Deschutes County Surveyor, Redmond Parks and Recreation, Redmond School District 2J, US Postal Service, Watermaster- District 11. 6. PUBLIC COMMENTS: The Planning Division mailed notice of this application to all property owners adjoining this local access road whose properties would be affected by the road name change. As part of the notice, notification of changes to the addresses of the adjacent lots was included in the letter. Staff received no public comments. III. CONCLUSIONARY FINDINGS: A. CHAPTER 16.16, ROAD NAMING 1. Section 16.16.010. Road Namina Authority A. Deschutes County, through the Community Development Department, shall have the authority to and shall assign road names to roads requiring names as provided in DCC 16.16. File: 247 -000943 -RN 2 FINDING: Deschutes County's Planning Division prepared the road name application consistent with the requirements of DCC 16.16. 2. 16.16.020. Unnamed Roads All unnamed public and private roads and other roadways which provide access to three or more fax lots, or which are more than 1,320 feet in length, shall be assigned a name in accordance with the procedures in DCC 16.16.030. FINDING: The unnamed public road previously served two Tots which were created under MJP-90-2 which partitioned an 80 -acre parcel into two 40 -acre parcels. Under DCC 17.22.030 roads created by partition are required to be dedicated to the public. Subsequent land use decisions (247-16-000444- MP/445-CU/446-CU and 247-16-000798-MP/799-CU/800-CU) created two more parcels, which meant the unnamed road provides access to four lots. DCC 16.16.020 now applies. 3. 16.16.030. Procedures for Naming New Roads A. Application. 1. The naming of a road may be initiated by the Community Development Department, Planning Commission, the Board, or by application of adjacent property owners, developers, or public agencies which may be affected by road names. FINDING: This application was initiated by the Community Development Department's Planning Division. 2. An application to name a road shall be submitted to the Community Development Department and shall include, at a minimum, the following: a. Name of applicant; b. Location of road by description and or map; c. Legal status of road, if known; d. Proposed road name, with two alternate proposed names; e. Reason for name request; f. Petition(s) attached, if any, and g. Fee, if any, as established by the Board. FINDING: Deschutes County is the applicant for this public right-of-way which is 60 feet wide and extends approximately 400 feet to the west of NW 66th Street, a local access road. The right-of-way was dedicated to the public under MJP-90-2. Comments submitted above by Cody Smith, Deschutes County Engineer, detail the legal access of this road. The proposed road name is Grange Court with Harrow Court and Farmstead Court as alternates. The reason for the name request is the road, which ends in a cul-de-sac, now provides access to more than three tax lots and must be named per DCC 16.16.020. B. Notice of a proposed name assignment shall be sent to all persons owning property abutting the affected road or having an address on the affected road. Such notices shall be sent within 10 days of the receipt of an application, if any, or other action initiating the proposed road name assignment. File: 247 -000943 -RN 3 FINDING: Staff initiated the application and mailed notice to the affected property owners on Nov. 29, which was within the required time period. C. Persons receiving notice under DCC 16.16.O3O(B) shall promptly notify any tenants or other occupants of the affected property of the proposed road name assignment. FINDING: This is not a requirement of the Planning Division, but the notice sent to the property owners referenced this language. D. Any person receiving notice under DCC 16.16.030(B) above may comment in writing on the proposed name within 10 days from the date of notice. FINDING: This is not a requirement of the Planning Division, but the notice sent to the property owner referenced this language. E. Standards 1. General. The proposed road name shall: a. Be limited to a maximum of two words. b. Not duplicate existing road names, except for continuations of existing roads. c. Not sound so similar to other roads as to be confusing. d. Not use compass directions such as North, East, South, etc., as part of the road name. e. Not use designations such as Loop, Way, Place, etc., as part of the road name. f. Improve or clarify the identification of the area. g. Use historical names, when possible. h. Reflect a consensus of sentiment of affected property owners and occupants, when possible, subject to the other standards contained in DCC 16.16.030. FINDING: Planning Division staff prepared the application with assistance from the Property Address Coordinator. The submitted names comply with these standards. NW Jordan Court, as suggested by Redmond Fire and Rescue, would not. A Jordan Road exists east of Sisters and north of US 20, extending east to George Cyrus Road. There already is a Jordan Court, which is a cul- de-sac, just south of Terrebonne and west of US 97 in 14-13-28. That cul-de-sac would not provide a continuation of an existing road. Staff therefore rejects NW Jordan Court due to the requirements at DCC 16.16.O3O(E)(b) and (c). 2. Particular Roads. The proposed road name shall also conform to the following standards: a. North/South roads shall be called "roads" or "streets." b. East/West roads shall be called "avenues." c. Roads dead -ending in a turnaround 1,000 feet or less from their beginning points shall be called "courts." d. Roads of reduced right-of-way or curving roads of less than 1,000 feet shall be called "lanes" or "terraces." File: 247 -000943 -RN 4 e. Curving roads longer than 1,000 feet shall be called "drives" or "trails." f. Roads that deviate slightly from the main course of a road with the same name, are less than 1,000 feet in length, shall be called "places." g. Roads that are four lanes or more shall be called "boulevards." h. Historical roads shall be called "market roads." 1. Roads running at oblique angles to the four points of the compass, less than 1,000 feet in length, shall be called "ways." (See Appendix "D," attached hereto.) j. Roads that begin at and circle back onto the same road, or that are circular or semicircular, shall be called "circles" or "loops." FINDING: Planning Division staff prepared the application with assistance from the Property Address Coordinator. The submitted names comply with these standards. F. Staff Review and Road Name Assignment: The Community Development Department shall review road name applications and shall assign road names under the following procedure: 1. Verify legal status of road with the County Clerk's office and Road Department. 2. Check proposed road name(s) to avoid duplication or confusing similarity with other existing road names, with those on approved preliminary land divisions and with those approved for future use. 3. Perform a field check, when necessary. 4. Assist the applicant or other affected person(s) to find alternate names when required. 5. Notify appropriate persons, departments and agencies of the road name application, and request comments. 6. Review and consider all comments submitted. 7. Assign a road name in accordance with the standards set forth in DCC 16.16.030(E) above. FINDING: Planning Division prepared the application with assistance from the Property Address Coordinator, reviewed relevant previous land use decisions and DIAL information, and contacted both the County Clerk's office and the Road Department. Staff also made a site visit on Dec. 8. From the transmittals, only Redmond Fire and Rescue objected to the name, Grange Court, as it was inconsistent with that agency's naming conventions. Staff notes according to DIAL measurements, the closest point of the road to the closest Redmond boundary is approximately 3.28 miles in a straight-line distance. The affected local access road is in the rural county and is outside the Redmond City Limits, Urban Growth Boundary (UGB), and Urban Reserve Area (URA). The affected local road is therefore in the area governed by Title 18 (County zoning) and not Title 20 (Redmond Urban Area). The future Grange Court is not in an area planned for future urbanization by the City of Redmond. The County Transportation System Plan (TSP) does not show any future roads in this area, meaning the street naming grid for the City of Redmond will not be extended to this area. The current Joint Management Agreement (JMA) between Deschutes County and City of File: 247 -000943 -RN 5 Redmond (Deschutes County Doc. 2007-110) is moot on the topic of addressing and only applies to the Redmond UGB and URA. For these reasons staff in its review has considered, but dismissed, Redmond Fire and Rescue's objection to the name Grange Court. G. Notice of Staff Decision. Following assignment of a road name by the Community Development Department, notice of the road name assignment shall be sent to all persons entitled to notice under DCC 16.16.030(B). FINDING: Staff will mail notice of the decision to the entitled parties. H. Appeal. Affected property owners and occupants shall have the right to appeal the assignment of a road name by the Community Development Department. Such appeals shall be conducted in accordance with the provisions of the Deschutes County Development Procedures Ordinance, except where the provisions of DCC 16.16.030 conflict with the procedures ordinance, in which case the provisions of DCC 16.16.030 shall apply. Affected property owners and occupants shall have 10 days from the date of the staff decision in which to file an appeal. Issues on appeal shall be limited to whether the Community Development Department correctly applied the criteria set forth herein. FINDING: Staff will abide by this section, should a timely appeal be filed by an entitled party as defined by this section. 1. A road name assignment becomes final when no further right of appeal established herein is possible. Within 10 days of the road name assignment becoming final, the Board shall sign an order establishing the road name as assigned by the Community Development Department. FINDING: The road name assignment will became final under a Board Order. J. The affected property owners and occupants shall have 180 days from the date of the Board order of road name assignment to begin using the road name. FINDING: This is not a requirement of the Planning Division, but the decision will reference this language. K. Notice of Decision. Following the order of the Board naming a road, the Community Development Department shall: 1. Notify the applicant requesting the road name of the action 2. Send copies of the order naming the road to the following: a. Road Department b. Assessor's Office and Tax Office c. Postmaster d. Planning Department e. County Clerk's office f. Affected telephone and other utilities File: 247 -000943 -RN 6 g. Affected fire department(s) h. Local school district(s) i. Emergency services, i.e., police, fire, 911, etc. 3. File the original order naming a new road with County Clerk 4. On a monthly basis, the Community Development Department shall publish a list of changed road names in a newspaper of general circulation designated for the purpose of the Board. FINDING: Staff shall provide the required notices to the required entities. 4. 16.16.040. Procedures and Standards for Changing Existing Road Names. FINDING: The road has no existing name; therefore this requirement does not apply. IV. CONCLUSION: Based upon the above findings, it appears that all relevant criteria and standards established for a road name of this type have been satisfied. V. DECISION: APPROVAL, subject to the following conditions of approval. VI. CONDITIONS OF APPROVAL: 1. Deschutes County Road Department will coordinate the posting of a new road sign with the Property Address Coordinator. 2. Deschutes County Community Development Department will notify the affected public agencies of this new road name. 3. The property owners along this road will be notified of this name assignment. VII. DURATION OF APPROVAL: This decision becomes final ten (10) days after the date mailed, unless appealed by a party of interest.
