Also present were Tom Anderson, County Administrator; Erik Kropp, Deputy County Administrator; David Doyle, County Counsel; and Sharon Keith, Board Executive Assistant. Dr. Berry reviewed the services provided by Marianne Straumfjord. BOCC BUSINESS MEETING JUNE 18, 2018 PAGE 2 OF 10 Commissioner Baney inquired on the contract term ending noting in the contract shows the term end is June 20, 2018. DeAnn Carr, Deputy Director explained the purpose of this contract amendment is actually to provide amendments to services provided through the end of the fiscal year and a new contract will soon be brought forward for further consideration. PUBLIC HEARING: Regarding Proposed FY 2019 Fee Schedule Consideration of Board Signature of Resolution No. 2018-012, Adopting the FY 2019 Fee Schedule for Deschutes County Chris Partain, Finance Department presented the item for consideration. Based on the discussions at a recent Work Session, a revision was made to the fee schedule for the Environmental Health department. Commissioner DeBone opened the public hearing. Carol MacBeth. Central Oregon LandWatch provided testimony and spoke on the fee for land use appeals and made a proposal to remove those fees. Ms. MacBeth reported Central Oregon LandWatch is appealing the 2013 fees and now appealing the 2018 fees through Land Use of Board Appeals. Discussion held on the appeal status and process. Commissioner Baney noted she would be open to a discussion on where other counties are capturing their fees and costs. Assistant Legal Counsel Adam Smith spoke on criteria of land use fees and average and actual cost of services. Community Development Department Planning Manager Peter Gutowsky spoke on the process of costs relative to administrative decisions that are appealed. The Board expressed support of the fee schedule as presented. PUBLIC HEARING: Consideration of Board Signature of Resolution No. 2018-022 Deschutes County FY 2019 Budget Adoption Wayne Lowry, Finance Director presented the item for consideration. County Administrator Anderson commented on the proposed budget as recommended by the County Budget Committee. Commissioner DeBone opened the public hearing. Andrew Doyle and Tom Crabtree presented testimony on behalf of the local public defender's office. Mr. Crabtree explained the request made for funding the Public Defense office and provided statistics to outline their request. Mr. Doyle commented on the funding request of $383,000 and the critical work the public defender's office is responsible for. Commissioner DeBone inquired if they contract directly with state of Oregon and this would be a supplemental funding. Commissioner. Henderson is puzzled with the state failing to support the courts and public defense services. Commissioner Baney noted the important role of the public defender's office. Commissioner DeBone thanked all departments and staff for their commitment of work with the budget process and closed the public hearing. Commissioner Henderson requests communications to allow for discussions earlier in the year. Commissioner Henderson spoke on the County's ability to cut property taxes and hopes to do more next year. Motion Carried CONVENE AS THE GOVERNING BODY OF THE COUNTYWIDE LAW ENFORCEMENT DISTRICT PUBLIC HEARING: Consideration of Board Signature of Resolution No. 2018- 023, Countywide Law Enforcement District FY 2019 Budget Adoption Wayne Lowry Finance Director noted this is the larger of the two Sheriff's Office taxing districts. The max rate for this district is $1.25. Commissioner Baney noted at the time of 2006 the intention was that this rate was going to draw down. Commissioner DeBone explained this is the countywide rate for jail services. Commissioner DeBone opened the public hearing and hearing no public testimony the hearing was closed. Board of Commissioners Business Meeting Agenda Monday, June 18, 2018 Page 4 of 4 MEMORANDUM (Updated as of 06/14/2018) DATE: June 14, 2018 TO: The Deschutes County Board of County Commissioners FROM: Tom Kuhn, Community Health Manager Eric Mone, Environmental Health Supervisor SUBJECT: FY 2019 Environmental Health Fee recommendations The following details outline the proposed fee increases and comparison to comparable communities for Fiscal Year 2019. During our May 9, 2018 Work Session to provide our FY 2019 Fee recommendations, it was suggested by the Commissioners that we create a fee schedule that is variable (not a flat increase across fees) and which aligns with fees from other counties. Following this guidance, we have created a new proposed structure, which demonstrates comparable fees with other counties. A comparison of fees was made with seven other counties, consisting of Targe, medium, and small jurisdictions. These counties were chosen based on size, fees, and consistency of the fee schedule; some counties had very high fees in some categories and very low fees in others. Please keep in mind that this is not a complete list of all Oregon county fees, and that it was an attempt to provide a solid cross-section of fees from across the state. Proposed fee increases were carefully selected to ensure that smaller licensed establishments were not disproportionately impacted. Also, in some cases, we proposed a tiered fee structure that other counties were using instead of the flat fee schedule currently in effect. The following tables contain fee comparisons with other counties, with our proposed increase percentage in parentheses at the top of each column. Also included is our current fee highlighted in yellow and our proposed fee in green. Only the five major fee categories were used for comparison, as there are numerous miscellaneous categories that substantiate only a minor portion of total fee revenue. Currently, Deschutes does have some of the higher restaurant fees in Oregon; however, there will still be at least three or more counties, that we are aware of, that will have higher fees. Mobile Unit Licenses Potential additional revenue with proposed increases: $11,940 Deschutes County has had a relatively lower fee for mobile units compared to other counties. The same approach was used in determining these fee increases as with restaurants; smaller mobile units were assigned a lower increase than larger ones. Deschutes is approaching 200 licensed mobile units, which is an unprecedented amount and will require increased staff time as this number continues to increase.
