2018-310-Order No. 2018-047 Recorded 7/26/2018It I :n LEGAL COUNSEL Recorded in Deschutes County Nancy Blankenship, County Clerk Commissioners' Journal i 2018-310 CJ2018-310 07/26/2018 2;36.11 PM BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON Order Approving Pacific Cascade Heights Annexation into the Bend Park & Recreation * ORDER NO. 2018-047 District WHEREAS, Pacific Cascade Heights submitted a petition requesting annexation of property, identified in Exhibits A & B attached to this Order, into Bend Park & Recreation District ("District") on or about June 4, 2018; and WHEREAS, the Deschutes County Assessor's Office verified that the petition was signed by 100 percent of real property owners within the area to be annexed as indicated in Exhibit C attached to this Order; and WHEREAS, pursuant to ORS 198.857(4), the Deschutes County Community Development Department determined the petition is consistent with the Deschutes County Comprehensive Plan and any applicable service agreement between a local government and the District, as described in Exhibit D attached to this order; and WHEREAS, the Board held a public hearing on July 25, 2018, to determine whether, in accordance with the County Comprehensive Plan, any applicable service agreement between a local government and the affected district, and the criteria prescribed by ORS 197.175, the affected area would benefit by annexation of said territory into the District; now, therefore THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, HEREBY ORDAINS as follows: Section 1. The Petition for Annexation and all exhibits attached to this Order are hereby incorporated by reference. Section 2. The Petition for Annexation is hereby approved, and the property identified in Exhibits A & B is declared annexed and included in the District. Section 3. A copy of the signed Order will be forwarded to the Oregon Department of Revenue, Oregon Secretary of State Archives Division, Deschutes County Assessor's Office and County Clerk's Office, and the District. RECOMMENDATION & ACTION REQUESTED: Motion: Approval of Order No. 2018-047 as described above. BACKGROUND AND POLICY IMPLICATIONS: Pacific Cascade Heights submitted a petition to annex property into the Bend Park & Recreation District. The District has approved this petition. The Public Hearing is scheduled for July 25, 2018. All requirements set forth in Order 2018-047 have been met. FISCAL IMPLICATIONS: The County provides all the staff costs to process special district formations and boundaries changes. For district formations and other boundary changes that are approved, the County bills the district for the publication costs. For those that are not approved, the County bills the chief petitioners.
