Present were Commissioners Tammy Baney, Phil Henderson and Anthony DeBone. Also present were
Tom Anderson, County Administrator; Erik Kropp, Deputy County Administrator; David Doyle, County
Counsel; and Sharon Keith, Board Executive Assistant. No identified representatives of the media were
in attendance.

CALL TO ORDER: Chair DeBone called the meeting to order at 10:02 a.m.

16.PUBLIC HEARING: Appeal of a Marijuana Production Approval for High
Desert Nectar LLC at 62266 Byram Road
Jacob Ripper, Community Development Department outlined the hearing
procedures. Hearing no conflicts of interest or challenges, Commissioner
DeBone opened the public hearing. Mr. Ripper provided the staff report.
Danielle Caruso, applicant presented testimony and information on the
submitted application.
Liz Dickson represents the appellants Sean and Lyssa Bell and provided
testimony. The Bells are adjacent property owners. Ms. Dickson commented
on the concern of compatibility. Mr. Bell works in law enforcement and
commented on his experience with these types of operations bring crime.
Youth activities are held and hosted at their property for 4H, Future Farmers
of America, and others. There are bus stops on the road and the marijuana
grow operation would provide an unsafe situation for the kids. Rose Bell,
Mr. Bell's daughter provided testimony and explained her responsibility to
voice her opinion the application for the marijuana grow operation on Byram
Road. Ms. Dickson feels the application does not meet the burden of proof.
Ms. Dickson requests the record remain open to allow for additional
information regarding youth activity centers.

Tammy Threlkeld lives in Alfalfa and provided testimony. She commented on
the importance of 4H in teaching our children and in keeping them safe.
Joel Newman lives on Byram Road next to the proposed marijuana grow and
spoke on the family's history and of their home.
Dr. Robert Burnside provided testimony and spoke on drug related
environments and the health concerns.
Tracy Burnside provided testimony and expressed her concerns of the
proposed operation.
II Johnston is a Sunriver Firefighter and Paramedic and is a neighboring
property owner. He stated this is an illegal grow operation as there is too
much supply in our state.
Amy Johnston is a nurse and is a neighboring property owner and expressed
her concern of this proposed grow operation.
Steve Hannas is a neighboring property owner and expressed his opposition
and his opinion this should be in a commercial zone.
Tyler Nagelhout is a neighboring property owner and expressed his
opposition and spoke on traffic and safety concerns.
Kevin McCormack is a neighboring property owner and spoke on the
uncertain impacts of marijuana. Mr. McCormick expressed his concern of
the proposed operation coming into their neighborhood.
Nuzie Gould presented testimony and encouraged the Board to look at the
County website DIAL site to look at the development documents for this
property's application. Ms. Gould expressed concern on water rights.
Corey Brown lives directly north of the subject property and expressed his
concerns of this operation proposed for their community. Mr. Brown works
at a pharmaceutical company and commented on the process for this
product that does not have adequate medical study support.

Ms. Caruso, applicant explained she will provide written rebuttal.
Commissioner Baney requested information on water sources, compatibility
criteria, and response on youth activity centers. Ms. Caruso stated water
hauling is an option and would not tap into well water or irrigation.
Commissioner Henderson asked for information on the product prediction
for business.
Mr. Ripper explained the guidelines for the record period. A two week open
written record period will be allowed for new evidence and testimony.
Commissioner Baney suggested a possible Work Session to review fact
finding prior to deliberations which would be audio recorded.
Commissioner DeBone closed the oral portion of the hearing.

Re: Public Hearing on an appeal of an Administrative Determination for Marijuana
Production. File No. 247-18-000792-A (appeal of 247 -18 -000051 -AD).
I. Purpose
The Deschutes Board of County Commissioners ("Board") will hold a public hearing on October 29,
2018, to consider an appeal filed by appellants Sean and Lyssa Bell, represented by Attorney Liz
Dickson (together "Appellants") in response to an Administrative Determination approving a
marijuana production facility proposed by High Desert Nectar, LLC ("Applicant"). The subject
property is located at 62266 Byram Road and is zoned Exclusive Farm Use. The appeal materials
identify numerous concerns regarding County regulations and impacts to the surrounding area. The
Board issued an order on September 26, 20181, to call up the matter for their review if an appeal
was filed. The appeal was timely filed the same day.
This memorandum only intends to provide discussion and clarification from staff for the Board to
consider in respect to the appellants' objections to the administrative approval.
11. Record
The record, in its entirety, was presented to the Board as attachments to the September 18, 2018
Staff Memo regarding the work session held on September 26, 2018 to consider an order to hear a
potential appeal of this application. Only those record items that have not been presented to the
Board previously are attached to this memo. A binder containing copies of all materials in the record
has also been prepared for the Board. It is located in the Board offices so that it is accessible at any
time and the Board may reference it at the public hearing.

III. Decision, Notice, and Timeline
The Planning Division issued the administrative decision on September 14, 2018, determining the
proposal met the approval criteria. A Notice of Decision was sent to neighboring property owners
and those who submitted comments and provided a mailing address. The administrative decision
was timely appealed on September 26, 2018. A Notice of Public Hearing was mailed on October 3,
2018 to those parties with standings. The 150 -day deadline for issuance of a final local decision is
December 13, 2018, unless this period is extended by the applicant.
IV. Objection Summary
The appellants state several reasons for their appeal, which are fully described in the Notice of
Appeal. The central arguments are summarized below:

The objections listed in the Notice of Appeal are addressed in the order they are summarized above.
A. Incompatibility with surrounding uses
Compatibility with surrounding uses is not an approval criterion for this proposal, apart from odor
and noise control, for which the appellants have not objected to.
1. Parcel is too small for EFU Zone
The appellants assert the property should be zoned Multiple Use Agricultural (MUA-10) instead of
Exclusive Farm Use (EFU) based on the size of the parcel and other MUA-10-zoned properties
nearby. The subject property was lawfully established at its present size and lawfully assigned to
the EFU zone. Many properties in the County were established prior to current zoning regulations

and smaller acreage than the modern minimum lot size. This is expressly recognized in the code
where a lot or parcel that is smaller than the minimum area required in any zone may be occupied
by an allowed use in that zone, pursuant to 18.120.020(C).
In any regard, this argument is not relevant because the property would have to be approved for
Plan Amendment, Zone Change, and Statewide Goal Exception applications before it could be
regulated as an MUA-10-zoned property. There is no basis in County Code or case law to require
that a lawfully zoned property be rezoned, hostile to the owner of the property, prior to the
development of a lawful use in the existing zone.
2. Definition of a youth activity center
"Youth activity center", is not defined in the DCC. Appellant disagrees with staff's analysis. Not being
a defined term, staff elected to search the surrounding areas for land use permits for any type of.
use that would allow or accommodate a youth activity -focused center or facility (e.g. church,
recreation or nature center, campground, etc.) and found none. Only residential uses have been
approved. To the extent that 4H, FFA, and homeschooling activities occur on residential properties,
they are permitted as accessory to the residential use of the property and do not rise to the level of
a "youth activity center". Although staff understood the concerns and comments submitted to the
record concerning homeschooled children, the act of homeschooling one's child or children does
not constitute a school or licensed childcare center as described in subsections DCC
18.116.330(B)(7)(a)(i)-(iii).
The appellants alleged that staff was not authorized to perform this detailed analysis and
interpretation of an undefined term and that staff is limited to ministerial review only. The appellant
did not support this statement with evidence. Staff respectfully disagrees and believes the
appellants' statements are incorrect. Land use permits are defined as a review "under the standards
in the County zoning ordinances [...] involving the exercise of significant discretion in applying those
standards" 2. Ministerial review involves fact -based, prescriptive determinations without the exercise
of discretion. Title 22 of the Deschutes County Code clearly does not limit the Community
Development Department to ministerial review only. Marijuana production in the EFU Zone is a land
use permit involving discretion, and the application was processed in accordance with DCC Title 22.
In the Notice of Appeal, the appellants describe the 4H and FFA group as, "Children and teens meet
as a group at the neighbor's property at least monthly throughout the spring, summer, and fall, as
they raise their animals for fair and other competitions" but did not submit any supporting evidence.
Staff defers to the Board to determine if this described activity rises to the level of a "youth activity
center" and to provide any further interpretation the Board deems necessary.

B. Proposal evades legal intent
1. Incompatibility with the Bend Airport
The appellants seem to argue that exterior lighting should be shielded because the property is
within the Airport Safety (AS) Combining Zone and there is a security camera planned for the
exterior of the building. The appellant goes on to speculate that the camera will not be able to record
at night without outdoor lighting. Since, allegedly, outdoor lighting to illuminate the area that the
camera will be recording is required, the appellants state it is inconsistent with the AS Combining
Zone and would "intrude into areas used by aircraft" and the proposal should be denied. No
evidence was submitted to the record to support these assumptions.
The appellants state the property is within the Horizontal and Conical Surfaces. Staff clarifies, as
described in the decision findings, the property is beneath those surfaces. The requirements for
lighting pursuant to DCC 18.80.044(B) are:
No new or expanded industrial, commercial or recreational use shall project lighting directly onto
an existing runway or taxiway or into existing airport approach surfaces except where necessary
for safe and convenient air travel. Lighting for these uses shall incorporate shielding in their
designs to reflect light away from airport approach surfaces.
The runway is over 9,700 feet (1.83 miles) from the subject property. The property is not below the
Approach Surface, but is approximately 130 feet to the east of it. Staff found the prosed use was
not reasonably expected to cause interference with the airport and pilots. Regardless of applicability
of the AS Combining Zone to outdoor lighting, the approval was conditioned based on marijuana
production criteria found in DCC 18.116(6)(9) and outdoor lighting control criteria found in DCC
15.10, which can ensure compliance with the AS Combining Zone. The condition of approval #6
states (pertinent subsections underlined):
Lighting: The following lighting standards shall be met at all times:
a. Inside building lighting used for marijuana production shall not be visible outside the
building from 7:00 p.m. to 7:00 a.m. on the following day;
b. Lighting fixtures shall be fully shielded in such a manner that all light emitted directly by
the lamp or a diffusing element, or indirectly by reflection or refraction, is projected
below the horizontal plane through the lowest light -emitting part: and
c. The light cast by exterior light fixtures other than marijuana growing lights shall comply
with DCC 15.10, Outdoor Lighting Control.
If there is indeed outdoor lighting that will not already be shielded as required by condition of
approval #6, staff suggests the following amendment to the condition of approval #6:

d. No outdoor lighting shall project into the existing airport approach surface. Lighting shall
incorporate shielding in the design to reflect light away from airport approach surfaces.
2. Nonfarm dwelling in conjunction with marijuana crop
The appellants argue that because the current property owners finalized the purchase of the subject
property, a nonfarm dwelling was approved, and the applicant applied for marijuana production
within an approximate six month time period, that the approved nonfarm dwelling is a "new
dwelling used in conjunction with a marijuana crop" and is prohibited by DCC 18.116.330(B)(20),
which mirrors ORS 475B.526(2)(a).
Staff explained the "new dwelling" term in the DCC and ORS in the administrative decision. Staff
referenced the DLCD's Guide to Recreational Marijuana in EFU Zones and the Board's interpretation
in the Rubio appeal decision, both of which state a nonfarm dwelling is not a prohibited dwelling
under DCC 18.116.330(B)(2) and ORS 4756.5263. In Rubio, the Board concluded:

The prohibition in DCC 18.116.330(20)(a)(i) of a new dwelling in conjunction with a
marijuana crop does not prohibit the previously approved non-farm dwelling for this
site on or about May 12, 20144 in file 247 -15 -000103 -CU.
Here, the appellant argues for a novel interpretation of the prohibition of a "new dwelling used in
conjunction with a marijuana crop" based on the relatively recent lawful approval of the dwelling as
a nonfarm dwelling. However, staff understands that, from the legislative history, this provision was
intended to preclude marijuana income from being used to meet farm income tests required for "a
dwelling customarily provided in conjunction with farm use". Thus, this limit on farm dwellings in
conjunction with a marijuana crop (a farm use) prevents this high-value crop being used to easily
qualify for an income -based farm dwelling and have the unintended consequence of allowing a
great deal of residential development on EFU land across the state.
C. Electrical supply is not met
The appellants argue that CEC's February 12, 2018 email response to the Notice of Application
invalidates the earlier October 3, 2017 "will -serve" letter. The October "will -serve" letter details the
location, use, and service load of the proposal and states that CEC is willing and able to serve the
property. It is signed by Robert E. Fowler, Engineering Service Representative. The February email
response to the mailed Notice of Application instructs the applicant to contact Mr. Fowler to provide
Toad and demand requirements so that he may determine if capacity is available. The February
email was sent by Parneli Perkins, Lands Specialist for CEC. Mr. Perkins receives all of the County's
Notices of Application and typically responds to those notices with these general statements that
are not site-specific. It appears to staff that reliance on the site-specific letter was appropriate.
'At the time of the DLCD publication, these rules were found in House Bill 3400. Since then, they have been incorporated
into the ORS.

D. Risk to public health and safety
1. County Sheriff discourages marijuana grows
The appellants refer to a letter they submitted from the Deschutes County Sheriff in regards to
another, unrelated marijuana production application. In the letter, the Sheriff addresses concern
over impacts from odor, sights, sounds, setbacks, and federal laws, and states the Sheriffs Office is
experiencing an increase in calls related to marijuana grows. The Sherriff's letter does not identify
any way the present application does not comply with applicable criteria.
2. Overproduction and crime
The appellants discuss overproduction of recreational marijuana in the Oregon market and illegal
sales but do not cite a related review criterion. Staff is not aware of any DCC section that would
allow approval or denial based on these statements.
VI. CONCLUSION & NEXT STEPS
The 150th day on which the county must take final action on this application is December 13, 2018.
As of the date of the public hearing (October 29), there will be 45 days on the timeline.
At the conclusion of the hearing, the Board may choose to:
1. CInce the record and begin deliharatinnc.
2. Leave the record open until a date certain for additional written evidence or testimony.
