Also present were Tom Anderson, County Administrator; Erik Kropp, Deputy County Administrator; David Doyle, County Counsel; and Laura Skundrick, Board Administrative Assistant. Several citizens were in attendance. CALL TO ORDER: Chair Henderson reconvened the meeting to order at 3:30 p.m. This meeting is a continuation of the Work Session of Wednesday, February 6, 2019. AGENDA: • Consideration of Board Signature of Order No. 2019-006, Initiating Review of the Hearing Officer's Decision in Application No. 247-18-000545-CU/546- SP/811-MA Commissioners Adair and DeBone summarized their Wednesday discussion that necessitated participation (today) by Commissioner Henderson. Nick Lelack, Community Development Director, explained that an appeal was received yesterday, and he presented options for the Board to consider. Chris Doty, Road Department Director, provided a map of the US20/O.B. Riley - Cook roundabout and the US20/O.B. Riley - Cook half diamond single point interchange, and explained potential impacts. Chair Henderson inquired whether it appropriate to use a future plan for property during a current decision making process, and Legal Counsel Doyle stated that consideration of applicable criteria control all hearings BOCC WORK SESSION FEBRUARY 8, 2019 PAGE 1 OF 4 and appeals; Doyle did note that the Board might find that the proposed placement could trigger an analysis under the compatibility component considered by Community Development. Motion Carried OTHER ITEMS: • County Administrator Tom Anderson introduced Sara Crosswhite, 9-1-1 Director, and Will Mullins, 9-1-1 Technical Systems Deputy Director. Together they provided the draft report of Bit Error Rate (BER) testing done in January and summarized the results. Mr. Mullins stated the results contained no surprises and he presented an interactive map, showing various locations signal levels, pointing out where some shadow zones exist. Chair Henderson inquired about specific areas shown in red, which Mr. Mullins confirmed are not of concern as they are on the edge of the threshold. Chair Henderson stated he would want to ensure users of the system do not have concerns and users should be asked specifically for that verbal confirmation. County Administrator Anderson clarified that this is not the final 9-1-1 radio system, and it needs to be determined whether this is satisfactory. This provides a starting point to identify where improvements can still be made. • County Administrator Anderson noted a hearing scheduled Monday for House Bill 2336 regarding the affordable housing pilot program. Judith Ure, Deschutes County Management Analyst, provided a draft letter of support for Board review. The Commissioners discussed specific wording of the letter and proposed several small changes. Commissioners discussed schedules and plans to visit a Salem stabilization center on Monday. • Mr. Lelack provided revisions to Resolution 2019-001 for the Commissioners' joint meeting with City of Sisters on Wednesday. • Chair Henderson summarized his trip to Washington D.C. to attend the presidential State of the Union address. • Commissioner Adair attended her first COIC Board meeting, and updated the Commissioners on current funding and potential bylaws revisions. • Commissioner Adair attended a Terrebonne Refinement Plan meeting in Crooked River Ranch, which was well attended. Citizens continue to meet with ODOT every week. • Commissioner DeBone received a request from Judge Ashby for use of the courthouse facility for the high school mock trial competition on March 2nd. The record, including the hearings officer's decision will be provided to the Board prior to the work session on February 8, 2019 consistent with Deschutes County Code (DCC) 22.32.035(D).1 1. Application On July 5, 2018, applications were filed for Conditional Use (CU) and Site Plan Review (SP) to establish marijuana retail at 19855 8th Street, Bend (tax lot 16-12-31 D 302) in the Tumalo Commercial (TuC) District. Then, on October 4, 2018, the applicant filed a modification of application that changed elements of the proposal. II. Decision On November 28, 2018, a public hearing was held before the hearings officer. The hearings officer issued a decision on January 29, 2019, determining the applicant met the applicable criteria. Notice of the decision was sent to parties that provided testimony. The decision becomes final if not appealed or called up by the Board by 5:00 p.m. on February 11, 2019.2 1 DCC 22.28.050(C), Review by Board states, "Review shall be conducted in the same manner provided for in appeals except that an appeal fee and transcript shall not be required. DCC 22.32.35, states, "In determining whether to hear an appeal, the Board of County Commissioners may consider only: 1. The record developed before the lower Hearings Body; 2. The notice of appeal; and 3. Recommendations of staff." 2 The 12th day of the appeal period is Sunday, February 10, 2019. Pursuant to DCC 22.08.070, the final day to act is Monday, February 11, 2019. DCC 22.08.070 states "Except when otherwise provided, the time within which an act is required to be done shall be computed by excluding the first day and including the last day, unless the last day is a Saturday, Sunday, legal holiday or any day on which the County is not open for business pursuant to a county ordinance, in which case it shall also be excluded." III. Board Options DCC 22.28.050 authorizes the Board to initiate review of a hearings body's (hearings officer) decision within 12 days of the date of mailing of the final written decision of the lower hearings body. ADCOMM Engineering Company, user agency, and DC9-1-1 staff had previously performed subjective audio tests using Harvard sentences and speakers and listeners from law enforcement, fire, and dispatch. The subjective audio testing showed generally good results in most of the county. The next phase of the testing process was to perform an objective bit error rate test, which uses radio equipment connected to a computer to measure BER of the received signal. The drive test route was the same for both tests. Digital radios work differently than analog radios. The system operated by Deschutes County prior to the current system was an analog system. In an analog system, the user voices are transmitted in a way that retains the basic voice wave patterns through the transmission process. The voice is then decoded by the human ear in essentially the same form as it was spoken. While analog audio can become impaired by noise and distortion, the human ear has a remarkable ability to hear and understand a voice message in the presence of analog noise and distortion. Digital radios convert the human voice to a digital bit stream, then transmit the bit stream across whatever transport elements there are, and finally convert the digital signal back into a partial copy of the original human voice. The conversion process used by all digital land mobile radio systems is based on a standard voice coding process or vocoder. Virtually all digital land mobile radio systems today use the AMBE1 vocoder family. The radio channel width is very small compared to the bandwidth needed to transmit digital voice at full fidelity. As a result, the AMBE vocoder reduces the bandwidth required by heavily processing the voice. This results in a somewhat digital sound even in the best of conditions and the potential for errors in the digital bit stream causing voice distortion. Audio quality is graded by a scoring system called delivered audio quality (DAQ). The range for DAQ values is as shown in the table below. This is the criteria used in the previous subjective drive testing evaluation. For reference, a DAQ of 3.4 is considered public service grade for public works type applications. The transmission of the digital signal through the transport network, including over -the -air radio link, can introduce errors into the digital signal. The greatest source of errors will be the actual over -the -air portion, which is related to radio coverage. As the BER goes up, the voice quality goes down. The highest BER a radio can tolerate is a 5 percent BER above which the radio will no longer decode any audio. This defines the basic sensitivity of the receiver. Conversely, a BER of 0 percent is the best a signal can be. For a 3.0 DAQ, the BER defined in the standards is 2.0 percent. For a DAQ of 3.4 the BER is 2.6 percent. ADCOMM ENGINEERING COMPANY COMMUNICATIONS CONSULTING Paget Drive Testing Process The advantage of BER testing is it takes the subjective aspect of the audio quality and converts the testing to an equipment based process. This process eliminates the potential for hearing impairments, feelings about the digital quality of the voice, and any other subjective factors affecting the results. The drive testing is done by generating a known test pattern at the base station, receiving it with a standard receiver, and recording the BER and the location on a computer. This process is automated so there is no potential for subjectivity to enter into the grading process. The BER testing is accomplished by measuring the outbound signal from a base station to a mobile unit. Unfortunately, there is no easy way to measure the talk -back from a portable or mobile back to the base station. As a result, the drive testing radios have to be adjusted to be equivalent to transmitting back to the base station. For mobile testing, this is no problem as the mobile unit test configuration is essentially the same as a user's actual radio installation. In addition, for mobiles, the system is talk out limited. This means if the mobiles can hear the base station the mobiles will always be able to be heard by the base station. So BER testing is simply a matter of connecting a mobile to a vehicular mounted antenna and recording received BER. Portables are another problem. Portable coverage for the Deschutes County system is defined as a portable radio on the hip. It would not be practical to have a user run alongside the drive test vehicle with their portable on their hip connected to the computer. How this is accomplished is by degrading the received signal level of the mobile being used to simulate a portable radio. The mobile radio can simulate a portable radio if the portable radio degradations are added to the "simulated portable" mobile unit. Some of those degradations are lower portable transmitter power, portable radio antenna, and user body attenuation. In addition, some radio sites, notably the Oregon Department of Transportation (ODOT) sites, were designed primarily for mobile use so an additional factor needs to be added to account for those stations' higher transmitter power since there will be locations where the portable might be able to hear the site but not be able to transmit back. Appendix A has the drive testing base station and radio configuration listed. The four radios were programmed to listen to two specific sites determined by where the radio was in the county. For example, in the southern end of the county, the sites were Wampus and Sugar Pine. In the Bend area, the Bend Simulcast system was listened to. Note in the case of the Bend simulcast system, while there are actually three sites, they all transmit at the same time on the same frequency. This appears to the radio as a single site. Two of the radios were programmed to one site and two to another site. For each site, one radio was simulating a mobile and had no attenuation. The other radio was simulating a portable radio and had the appropriate attenuation applied. If an area was covered by more than two sites, the radios' frequencies were changed and the area driven again to capture the data from that site. The data that includes BER results and GPS coordinates was gathered and sent to Tait for post processing. This data was received back in the form of both a Google Earth map file and a .CSV file with the information. The Google Earth maps were printed and are in Appendix B. The coverage was as expected with a few of the known problem areas, such as the northwest side of Awbry Butte, showing up clearly. In general, the coverage was very good. Note also, the red areas do not mean communications are not possible but that the BER was higher than 2.0 percent or a DAQ of 3.0. ADCOMM ENGINEERING COMPANY I COMMUNICATIONS CONSULTING Page4 Drive Test Results The drive testing does not generate a single composite coverage number as radio sites were tested in areas where that site is not designed to cover. For example, the test configuration was collecting data for HooDoo in areas northeast of Sisters where it is not designed to cover. Many of those areas are well covered by 5 Mile. This is especially true for portable coverage. Many areas were either driven twice or data was collected from two sites over the same area. For example, Bend Simulcast data and Powell Butte data were collected when driving around Bend. On the back side of Awbry Butte, there is little to no coverage from Powell Butte but there is drive testing data for those locations. The maps give a visual indication which sites cover which areas and these can be viewed either in the appendix or using the Google Earth files provided. Even with this overlap of good coverage with bad readings, there were approximately 120,000 test points of data with slightly less than 19,000 bad points. This works out to about 84 percent of the total readings better than a 2.0 percent BER. Given that many of these locations also had a less than 2.0 percent BER from another site, the actual coverage is significantly better than 84 percent for portable radios. The BER for the county -wide testing was almost 90.7 percent including the areas where there are both good signals and bad signals counted for in the same area. Henderson Patti Adair Anthony DeBone The Deschutes County Board of Commissioners wishes to express support for House Bill 2336, which removes the population requirement for the affordable housing pilot program enacted by House Bill 4079 in 2016 if no qualifying nomination is received for a city with a population of under 25,000. House Bill 4079 was authorized by the State Legislature as a means to increase the land supply for and encourage development of affordable housing projects. Within Deschutes County, the need for affordable housing is great. In recent years, housing prices have increased more than 52% while wages have only grown by an average of 2% to 3% per year. To help meet this challenge, both the City of Bend and the City of Redmond submitted applications for suitable projects in the first year the pilot program was initiated. While the City of Bend's project was selected at that time, our hope is that passage of HB 2336 will give the City of Redmond's project another opportunity for consideration. The cost of residential land in Redmond ranges from $40,000 to $100,000 per acre and the average sales price of a single family home in Redmond is currently approximately $289,000. The average annual wage in Redmond is approximately $40,000, significantly lower than the average median income of $69,900 for a family of four, and the poverty level is approximately 30 percent. For many of these families, the cost of a home is simply out of reach. The Skyline Village project, as conceived by the City of Redmond will go a long way toward addressing this problem by adding 450 new homes with half targeted for those with incomes of 80% of the Area Median Income (AMI) or less. Deschutes County is proud to be a strategic partner in this project and has committed to providing a 40 -acre parcel on which to construct the homes, along with amenities that include parks and trails, recreation, civic spaces, public art, and commercial and business uses. The project represents a sound investment in the pilot program as it exceeds the established minimum objectives by providing both affordable and market rate housing in a mixed -income, mixed-use setting.
