Commissioner Anthony DeBone was present at 10:55 a.m. Also present were Tom Anderson, County Administrator; Erik Kropp, Deputy County Administrator; David Doyle, County Counsel; and Sharon Keith, Board Executive Assistant, Several citizens and identified representatives of the media were in attendance. PRESENTATION: Habitat Conservation Plan - Central Oregon Irrigation District Presentation was given by Mike Britton, Manager at North Unit Irrigation District and President of Deschutes Basin Board of Control and Craig Horrell, District Manager for Central Oregon Irrigation District and Vice Chair of Deschutes Basin Board of Control. A copy of the presentation is attached to BOCC MEETING APRIL 10, 2019 PAGE 2 OF 7 the record. The irrigation districts and their partners have committed during the past decade to developing a multi -species Deschutes Basin Habitat Conservation Plan which represents a proactive and collaborative approach to balance fish and wildlife conservation with water use in the Deschutes Basin. 8. Memoranda of Understanding Janice Garceau of Health Services presented the item for consideration as a continuation of discussion from the Tuesday, April 9th Board Meeting. Document No. 2019-198 is a Memorandum of Understanding between PacificSource Community Solutions and Deschutes County as the Local Mental Health Authority. Document No. 2019-199 is a Memorandum of Understanding between PacificSource Community Solutions and Deschutes County as the Local Public Health Authority. Both MOUs are required by PacificSource as part of the process to submit an application to the Oregon Health Authority to be awarded the contract to continue operating as the Coordinated Care Organization (CCO) for Deschutes, Crook, and Jefferson Counties. The Board offered direction for a minor amendment; Ms. Garceau will work with County Counsel Dave Doyle. Motion Carried BOCC MEETING APRIL 10, 2019 PAGE 3 OF 7 9. 9-1-1 User Board 911 Interim Director Sara Crosswhite and Deputy Director Will Mullins were present via conference call and Project Manager Rick Allen was present in person for the discussion. A copy of a handout titled "Deschutes County 9-1- 1 Service District User Board Agreement Recommendations" was reviewed for potential improvements. The meeting structure and authority of the User Board was discussed. The Board will review the current User Agreement and the discussion will continue at the BOCC Meeting on Monday, April 15th RECESS: At the time of 12:08 p.m. a recess was taken and the meeting was reconvened at 2:03 p.m. in the Allen Conference Room. OTHER ITEMS: 1. Committee Appointments: • Audit Committee Interviews were conducted last week by Commissioner Adair, Internal Auditor David Givans, and Audit Committee Chair Daryl Parrish. The Board supported appointing Stan Turel and Scott Reich. Mr. Givans will submit letters for the Board to consider. • Investment Advisory Committee interviews were conducted last week by Commissioner DeBone and Finance Director Wayne Lowry. Commissioner DeBone recommends appointing both candidates. The Board supported appointment of Craig Renkert. • Central Oregon Cohesive Strategies: Commissioner Henderson has not made all contacts that he intended. BOCC MEETING APRIL 10, 2019 PAGE 4 OF 7 • Local Public Safety Coordinating Council: Commissioner Henderson asks what type of membership we are trying to fill. Nine applications were received for two vacancies for citizen members. The Board requested letters of interest from the candidates. 2. Crisis Stabilization Center Follow-up: County Administrator Anderson asked for direction on a follow-up discussion for Health Services regarding Crisis Stabilization Center facility tours. Commissioner Adair has met with Chief Porter regarding a partnership (financial contribution) with the City of Bend Police Department. Commissioner Henderson wants something in writing from Health Services that show specifics of the concerns of the Health Department, that further delay will result in lost grant funding. County Administrator Anderson reported Health Services is creating a revised memo to the Board explaining the scope and at risk status of the grants involved. Commissioner DeBone pointed out that the jurisdiction of Deschutes County includes those residing within Bend and that the BOCC serves as the public health and mental health authority in support of all of the citizens. Commissioner Henderson recommends a meeting to discuss the design concept. COMMISSIONER UPDATES • Commissioner DeBone commented on a procedural concern where meeting minutes were revised by Commissioner Henderson at 9:00 a.m. on Wednesday morning that were on the agenda at 10:00 a.m. for consideration of approval and acknowledged he did not see the revisions until after the meeting. • Commissioner DeBone attended the Terrebonne water meeting from last night. Peter Gutowsky, Planning Manager reported on the community drain field in Terrebonne. BOCC MEETING APRIL 10, 2019 PAGE 5 OF 7 • Commissioner DeBone noted the Central Oregon Health Council meeting is scheduled for Thursday April 11. • Commissioner DeBone reported the La Pine Band of Brothers has asked for a commitment for funding for the traveling veterans wall. The Board supported bringing this item back for consideration of discretionary grant funding. • Commissioner DeBone reported on his trip to Salem and his conversation with the Farm Bureau and their suggestion to rezone lands that do not actually qualify as EFU. • Commissioner Adair reported on the status of the many gun bills at the Legislature. The Board is supportive of submitting a letter in support of basic Second Amendment rights. • Commissioner Adair is tracking the veteran's bill and the vaccination bill. • Commissioner Adair attended the COIC meeting and the COACT meeting last week. • Commissioner Henderson met with ODOT and City of Bend on the INFRA Grant. Congressman Walden is in town next week and will be involved in the discussions as well. EXECUTIVE SESSION At the time of 3:15 p.m. the Board under ORS 192.660 (2) (e) Real Property Negotiations. The irrigation districts and their partners have committed the past decade to developing a multi -species Deschutes Basin Habitat Conservation Plan (DBHCP), which represents a proactive, collaborative approach to balance fish and wildlife conservation with water use in the Deschutes Basin through innovative, science -based solutions. National Marine Fisheries Service (NMFS) and the U. S. Fish and Wildlife Service (USFWS) evaluate the potential impacts of permit issuance on the human environment. For large and complex actions like the DBHCP, the National Environmental Policy Act (NEPA) requires the completion of an Environmental Impact Statement (EIS). The DBHCP EIS is being prepared by an independent third -party consultant under the direction of USFWS, concurrent with completion of the DBHCP. The DBHCP, once approved, will result in long-term benefits to Deschutes River -dependent species, the region's water resources, and the social and economic health of communities. The DBHCP will also provide ESA -related liability protection to the districts. The irrigation districts recognize that the DBHCP does not permanently resolve potential concerns related to the reservoirs' impacts on the Oregon spotted frog or provide long-term liability protection to the districts. BOCC Involvement in 9-1-1 User Board meetings la. Commissioner Liaison The currently written agreement calls for this under section 2.f 1b. Status Quo without appointing a liaison (Would require amendment to current agreement) Current agreement under 2.f states the governing body SHALL appoint a liaison to the User Board. 2. User Board Meeting Structure (Chairmanship) 2a.` County Administrator or designee The currently written agreement calls for this under section 3.b 2b. Sheriff, Police Chief or Fire Chief (Agency Head) -Yearly Rotation, voted on by User Board 2c. Commissioner 2d. 9-1-1 Director (currently in place) 3. Authority Existing Agreement 2015 —Section 3.c 3a. Section 3.c identifies authority being granted to the User Board by a quorum, but does not define that authority. Further define decisions that impact operations of the user agencies and their operations so that these decisions can be voted on by the User Board. Previous Agreement 2013 3b. Executive Board of the User Board. Consisted of five permanent members the Sheriff, Bend Police Chief, Redmond Police Chief, Bend Fire Chief, Redmond Fire Chief and two additional Executive Board members from the smaller Districts that will alternate membership on the Executive Board. Voting was done by a quorum of the Executive Board. Previous Agreement 2010 3c. The Executive Board shall review all proposed operational rules, policies and procedures of the District. (Changed 2013 to "provide input") 3d. The Executive Board shall review and approve the annual proposed budget for the District prior to the submission of the budget to the District budget committee. (Changed in 2013 to "provide advisory input") 4. Suggested Modification on current language Current Agreement Section 9.a calls for individual agency responsibility for subscriber purchase, management, and maintenance. Recommend amending language to allow agencies to utilize the technical capabilities of DC911 radio staff to provide a maintenance program 5. Addition to Section 3 User Board -Add Alfalfa Fire District Each section above captures areas that may want to be reviewed for modification. The recommended path is identified as the first bullet under each section and requires minimal modification to the agreement that is currently in place. By adding more operational structure to the meetings and understanding of expectations and roles, the efficiency of the User Board can be increased.
