WHEREAS, by Redmond Resolution No. 2019-09, attached hereto as Exhibit "A" and by this reference incorporated herein, the City of Redmond has requested surrender of jurisdiction of portions of NW Pershall Way, NW 10th St, and Northwest Way located within the Redmond city limits as depicted in Exhibit "B" attached hereto and by this reference incorporated herein; now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, as follows: Section 1. That on Wednesday, June 26, 2019, at 10:00 A.M. in the Barnes and Sawyer Rooms of the Deschutes Services Center, 1300 NW Wall Street, Bend, Oregon, the Board of County Commissioners will hold a hearing to determine whether jurisdiction over portions of NW Pershall Way, NW 10th St, and Northwest Way located within the Redmond city limits as depicted in Exhibit "B" attached hereto, will be surrendered to the City of Redmond. Section 2. Notice of said hearing, in substantially the form marker Exhibit "C" attached hereto and by this reference incorporated herein, shall be posted in no less than three (3) public places, including within the city limits of Redmond, for no less than 20 calendar days before the hearing. Part of that Agreement was for the City to request transfer of road jurisdiction when areas were annexed. Attached is a copy of Redmond Resolution #2019-09 which was approved by the Redmond City Council on March 12, 2019, requesting that Deschutes County surrender jurisdiction of certain rights-of-way to the City of Redmond in conjunction with this annexation. WHEREAS, the City Council has agreed to take jurisdiction of certain County roads within the City limits; and WHEREAS, pursuant to ORS 373.270(6), the City Council wishes to initiate transfer of such jurisdiction to the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDMOND, OREGON, AS FOLLOWS: SECTION 1: That the City hereby requests that Deschutes County surrender jurisdiction to the City of Redmond of certain County rights-of-way described in Exhibits A, B and C attached hereto as of April 12, 2019, SECTION 2: That the jurisdiction of Deschutes County over the rights-of-way described in Section 1 hereof, and for the right-of-way improvements, construction, and repair shall cease upon transfer of the property to the City of Redmond. BACKGROUND AND POLICY IMPLICATIONS: The City of Redmond has annexed segments of NW Pershall Way, NW 10th St, and Northwest Way. The City has submitted a request to the County to surrender jurisdiction of said road segments. Resolution No. 2019-013 will set the public hearing for the jurisdictional surrender for June 26, 2019. Subsequent to the public hearing, the Board will be presented with an Order to surrender jurisdiction of said road segments to the City.
