BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON
A Resolution Setting a Public Hearing for the
Proposed Jurisdictional Surrender of portions RESOLUTION NO. 2019-013
of NW Pershall Way, NW 10th St, and
Northwest Way to the City of Redmond,
Oregon Pursuant to ORS 373.270.
WHEREAS, by Redmond Resolution No. 2019-09, attached hereto as Exhibit "A" and by this
reference incorporated herein, the City of Redmond has requested surrender of jurisdiction of portions of
NW Pershall Way, NW 10th St, and Northwest Way located within the Redmond city limits as depicted in
Exhibit "B" attached hereto and by this reference incorporated herein; now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES
COUNTY, OREGON, as follows:
Section 1. That on Wednesday, June 26, 2019, at 10:00 A.M. in the Barnes and Sawyer Rooms
of the Deschutes Services Center, 1300 NW Wall Street, Bend, Oregon, the Board of County
Commissioners will hold a hearing to determine whether jurisdiction over portions of NW Pershall Way,
NW 10th St, and Northwest Way located within the Redmond city limits as depicted in Exhibit "B"
attached hereto, will be surrendered to the City of Redmond.
Section 2. Notice of said hearing, in substantially the form marker Exhibit "C" attached hereto
and by this reference incorporated herein, shall be posted in no less than three (3) public places,
including within the city limits of Redmond, for no less than 20 calendar days before the hearing.

In the summer of 1998, the City of Redmond and Deschutes County entered into an Urban Area
Growth Boundary Management Agreement. Part of that Agreement was for the City to request
transfer of road jurisdiction when areas were annexed.
Attached is a copy of Redmond Resolution #2019-09 which was approved by the Redmond City
Council on March 12, 2019, requesting that Deschutes County surrender jurisdiction of certain
rights-of-way to the City of Redmond in conjunction with this annexation. The right-of-way
description can be found on Exhibit A -C of the Resolution.

RESOLUTION NO. 2019-09
A RESOLUTION OF THE CITY OF REDMOND REQUESTING THE TRANSFER OF
CERTAIN COUNTY RIGHTS-OF-WAY FROM DESCHUTES COUNTY.
WHEREAS, the City Council has agreed to take jurisdiction of certain County roads
within the City limits; and
WHEREAS, pursuant to ORS 373.270(6), the City Council wishes to initiate transfer of
such jurisdiction to the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
REDMOND, OREGON, AS FOLLOWS:
SECTION 1: That the City hereby requests that Deschutes County surrender
jurisdiction to the City of Redmond of certain County rights-of-way described in Exhibits
A, B and C attached hereto as of April 12, 2019,
SECTION 2: That the jurisdiction of Deschutes County over the rights-of-way described
in Section 1 hereof, and for the right-of-way improvements, construction, and repair
shall cease upon transfer of the property to the City of Redmond.
SECTION 3: This resolution shall be effective March 12, 2019.
ADOPTED by the City Council and SIGNED by the Council President this 12th day of
March 2019.

Located in the Southwest One -Quarter of Section 33, Township 14 South, Range 13 East,
Willamette Meridian, Deschutes County, Oregon, being more particularly described as follows:
Commencing at the center One -Quarter corner of said Section 33, thence along the East line of
the Southwest One -Quarter of Section 33, South 0°29'35" West 646.29 feet to the centerline of
NW Pershall Way; thence along said centerline, South 59°02'05" West 199.09 feet; thence
continuing along said centerline, South 59°55'05" West 293.62 feet to the TRUE POINT OF
BEGINNING; thence leaving said centerline South 30°04'55" East 40.00 feet to the South right
of -way line of NW Pershall Way; thence along said South right-of-way line South 59°55'05"
West 266.01 feet; thence along a curve to the right with a radius of 326.48 feet, a length of
147.24 feet, a central angle of 25°50'26", a chord that bears South 72°50'18" West 146.00 feet;
thence leaving said South right-of-way line, North 4°14'29" West 70.00 feet to the North right-
of-way line of NW Pershall Way; thence along said North right-of-way line, along a curve to the
left with a radius of 256.48 feet, a length of 115.67 feet, a central angle of 25°50'26", and a

RECOMMENDATION & ACTION REQUESTED:
Motion for approval of Resolution No. 2019-013, Setting a Public Hearing Date for the
Proposed jurisdictional Surrender of Portions of NW Pershall Way, NW 10th St, and
Northwest Way to the City of Redmond, Oregon for June 26, 2019, and for approval of
Chairman signature of Notice of jurisdictional Transfer Hearing.
BACKGROUND AND POLICY IMPLICATIONS:
The City of Redmond has annexed segments of NW Pershall Way, NW 10th St, and Northwest
Way. The City has submitted a request to the County to surrender jurisdiction of said road
segments.
Resolution No. 2019-013 will set the public hearing for the jurisdictional surrender for June 26,
2019. Subsequent to the public hearing, the Board will be presented with an Order to
surrender jurisdiction of said road segments to the City. If the Order is approved, said road
segments will cease to be a part of the County -maintained road system and will become City
roads.
