BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON
A Resolution to Initiate the Dissolution of the * RESOLUTION NO. 2019-030
Sisters Library County Service District
WHEREAS, the Deschutes County Board of County Commissioners ("County") created the
Sisters Library County Service District ("District") on December 21, 1994 in Order No. 94-162 to
provide library services; and
WHEREAS the District did not include a tax base in its formation and never issued debts or
acquired assets or interest in real property, and never organized to provide library services; and
WHEREAS, in 1997 the County initiated formation of the Deschutes Public Library District
and by Order 98-022 intended to transfer to the Deschutes Public Library District all library county
service district assets and services; and
WHEREAS in 1998, voters approved the Deschutes Public Library District to provide library
services to the entire County; and
WHEREAS pursuant to ORS 198.920 the County is authorized to dissolve a district by
resolution; and
WHEREAS, pursuant to ORS 198.940(2) and (4), the Board of County Commissioners may
declare a County service district dissolved when the Board finds that dissolution of the service district
is in the interest of the people of the County and "the district has failed regularly to elect district board
members in accordance with the principal Act of the district" or "the district is no longer necessary for
the purpose for which it was formed...".
THEREFORE, the County finds as follows:
a. There are no qualified board members of the District, as none were elected as required
by the principal Act (ORS 357.216 to 357.286), and thus the Board may act on behalf of
the District;
b. The District is no longer necessary, and never served the purpose for which it was
intended;
c. It is in the best interests of the people of Deschutes County that the District be dissolved
and, if necessary, liquidated;
d. There are no outstanding bonds, coupons, or other indebtedness incurred or owed by the
District;

e. The District has no interest in any parcel of real property and owes no outstanding or
delinquent taxes or assessments;
f The District has not levied taxes in the last ten (10) years, and no uncollected taxes
remain;
g. The District has no personal property or other assets;
h. Other than staff time, there are no costs associated with dissolution of the District;
i. As there are no assets, obligations, or debts of the District, no liquidation of assets or
resolution of debts or other obligations is necessary.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF DESCHUTES COUNTY, OREGON, as follows:
Section 1. Resolution 2019-030 is intended as and shall be the dissolution plan for the District.
Section 2. The Board has the authority to act on behalf of the District, and therefore a copy of
Resolution 2019-030 need not be filed with the district secretary pursuant to ORS 198.920(2).
Section 3. Within 30 days of execution of Resolution 2019-030, the Deschutes County Legal
Counsel shall file a copy of it with the County Clerk as the dissolution plan for the District, and it shall
remain available for inspection by any interested person as required by ORS 198.925(3).
Section 4. Upon filing of Resolution 2019-030with the County Clerk, the Board will enter an
order dissolving the District.
Section 5. This resolution shall take effect immediately upon adoption.

Consideration of Board Signatures of Resolutions 2019-030 and 2019-031 for Dissolution
of the Sisters Library District and La Pine Library Districts
RECOMMENDATION & ACTION REQUESTED:
Motion and approval of Resolutions 2019-030 and 2019-031
Background and policy implications: On December 21, 1994 the Board of County Commissioners ("BOCC")
approved forming the Sisters Library and La Pine Library County Service Districts in Orders 94-162 and 94-163
respectively. However, the districts never fully formed or organized, never elected any board members, never
held any financial assets or obligations and have not levied any taxes. Additionally, on January 21, 1998 the
BOCC approved Order 98-022 forming the countywide Deschutes Public Library District with the intent of
eliminating all funding of library services with general fund resources after the 1998-99 fiscal year and
transferring any and all assets and services of County library service districts to the new district. Resolutions
2019-030 and 2019-031 are a follow up housekeeping measure to initiate dissolution of the La Pine and Sisters
Library Districts. These resolutions provide the dissolution plan for these districts. Dissolutions will allow the
Assessor's Office to remove the districts from its tax statements and allow the Clerk's Office to clean up its
special district election records. The Districts never provided library services and as such no longer are necessary
for the purposes they were created.
