ORDER NO. 2019-025 WHEREAS, by Redmond Resolution No. 2019-09, attached hereto as Exhibit "A" and by this reference incorporated herein, the City of Redmond has requested surrender of jurisdiction of portions of NW Pershall Way, NW 10th St, and Northwest Way located within the Redmond city limits as depicted in Exhibit "B" attached hereto and by this reference incorporated herein; WHEREAS, on Wednesday, June 26, 2019, at 10:00 A.M.in the Barnes and Sawyer Rooms of the Deschutes Services Center, 1300 NW Wall Street, Bend, Oregon, the Board of County Commissioners held a hearing to determine whether jurisdiction over portions of NW Pershall Way, NW 10th St, and Northwest Way, located within the Redmond city limits as depicted in Exhibit "B" attached hereto, will be surrendered to the City of Redmond; WHEREAS, the Board of County Commissioners finds that it is in the public interest to surrender jurisdiction and accept the request set forth in Redmond Resolution No. 2019-09, dated the 12th day of March, 2019; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, HEREBY ORDERS as follows: Section 1. That effective as of 12:00 AM, June 27, 2019, the Board of County Commissioners hereby surrenders jurisdiction of portions of NW Pershall Way, NW 10th St, and Northwest Way as depicted in Exhibit "B" attached hereto to the City of Redmond. Part of that Agreement was for the City to request transfer of road jurisdiction when areas were annexed. Attached is a copy of Redmond Resolution #2019-09 which was approved by the Redmond City Council on March 12, 2019, requesting that Deschutes County surrender jurisdiction of certain rights-of-way to the City of Redmond in conjunction with this annexation. WHEREAS, the City Council has agreed to take jurisdiction of certain County roads within the City limits; and WHEREAS, pursuant to ORS 373.270(6), the City Council wishes to initiate transfer of such jurisdiction to the City. The City has submitted a request to the County to surrender jurisdiction of said road segments in accordance with Redmond Urban Growth Area Joint Management Agreement (Document No. 2007-110). In accordance with ORS 373.270 and Resolution No. 2019-013, a Public Hearing is being held on June 26, 2019 for interested parties to offer testimony regarding the requested jurisdictional transfer. Upon closing the public hearing, the Board will consider Order No. 2019-025, which will surrender jurisdiction of said road segments to the City of Redmond.
