Deschutes County Priority Bills - Calendar Phil Scheuers noted that the schedule is changing quickly due to the one-hour notice schedule. • HB 2001, regarding duplexes in land zoned for single-family dwellings, has a public hearing and work session scheduled today. • HB 2053, regarding long term incentives for rural enterprise zones and business development tax exemption, has a work session scheduled for tomorrow. • HB 2130, regarding the creation and extension of sunsets for certain property tax exemptions, will have amendments presented. 3. Deschutes County Priority Bills - Bill list Ms. Ure provided updates on several bills from the list: • SB 365, regarding prohibition of imposing marijuana SDCs, was finalized and signed by the Governor on June 7th • HB 2600, regarding long term care facility disease outbreaks, passed out of the Subcommittee on Human Services on June 10th and is now in the full Ways and Means committee. • SB 27, regarding the Oregon Drinking Water Quality Act, had its third reading in the Senate on June 10th • SB 488, regarding immunizations for incarcerated persons, also had its third reading in the Senate on June 10th • SB 973, regarding the establishment of a Behavioral Health Justice Reinvestment Program, passed out of the Subcommittee on Public Safety. It has also now passed out of the full Ways and Means committee, although that is not reflected on the OLIS status page for the bill. Chair Henderson noted he and Commissioner Adair were at AOC in Salem yesterday and were able to speak with several legislators at the Capitol. He mentioned several items that were discussed at AOC, including bills regarding Family Medical Leave, HB 2123 for tobacco tax, HB 2020 for the carbon tax, and HB 2756 regarding DDA classification under PERS. Also, HB 2241 would establish fees charged for criminal filings. 4. Department Updates on Identified Bills • Dr. Conway, Health Services: inquired with Representative Helt about the immunization bill, and she stated she hopes it comes back next session. • Sara Crosswhite, 911: HB 2449, regarding increase of the 911 surcharge, is still moving forward but the future of the bill is unclear. Ms. Ure noted it received its first reading in the Senate yesterday. 5. Legislator Priorities • Representative Helt: Thanked Commissioners Henderson and Adair for their time spent at the Capitol. She dropped HB 3450 yesterday, which would allow mixed-use housing in employment use zones, to help toward affordable housing; she is also working on HB 3242, which would reduce the amount of time the State can hold a property before selling; also working on SB 21 which attempts to provide more funding for unaccompanied minors. She added that she plans to hold a blood drive in Bend over the summer, because blood donations decrease in the summer. Departments Administrative Services W`c E a d W 0 o :E' m ixE c a 0 2 Facilities, Administration 1r 1 11; Administration, Veteran's, Assessor v _ W'.... c -o W o ; 03 .2 0 a 4.1 W o0 o c o u ;1� LC 3680 which combines the provisions of SB 88 with the statewide wildfire risk mapping concept would impact the bill as follows: 1) No ADUs outside of RFPDs:(no change from previous versions); 2) No defensible space is requited outside of: ODF's protection districts (significant change from previous versions) (note, east of Sisters, Cloverdale, greater Redmond, Tumelo, north and east of Bend there would be no defensible space required); 3) I assume the intent is to require all ADUs to be built to the standard in R327 until Consumer and Business Services completes a map showing where R327 would/wouldn't be required for ADUS (in2021). However, my reading of Section 2 (2) (L) of page 2, lines 28 and 29 of the legislative concept would be that unless a County has adopted a Wildfire Hazard Zone to identify the "qualifying lots of record", R-327 is not applicable.: My suggestion would be that this is clarified. If they want to require that buildings are builtto the code then Section 2 (2)(L) might read: "The accessory dwelling unit complies with the Oregon residential specialty code R327.4.2 throughR327.4.8:. If they want counties to determine where the code applies, they can refer to the entire code as written, but it would still be good to have that clarified. One other item of note: If R327 applies to ADUs, l would assume that existing, non -permitted ADUs would be difficult to grandfather in without significant alteration. This is not an issue with the LC, but something I've heard come up in other conversations. (EK 2/26/19) Would allow expansion of courtouse to accommodate new judge position proposed in HB 2239. SDCs are fees charged to new development to offset the cost of: growth to infrastructure required by growth. Deschutes County charges SDCs to MJ grow operations. This bit will prohibit Deschutes County from collecting SDCs from MJ grow operations, thereby transferring the cost of their transportation impact to existing taxpayers. This bit exempts farm use (not just MJ) from SDCs, however the reality is that farm use in Deschutes County is dictated by irrigation water rights which have been allocated for decades and no farm use wit develop that is not currently in farm use - with the exception of MJ. This bit is specifically targeting` Deschutes County's practice. Passage of this bill will cost Deschutes County over $1M in revenue to mitigate the impact of MJ related traffic added to the '. transportation system via the 60+ grow operations throughout Deschutes County. The bill creates a Behavioral Health Justice Reinvestment Program. A Grant opportunity will be opened up to Counties and 5 pilot sites will be selected. The focus of the grants will be to reduce the number of individuals with a serious mental illness who are high utilizers of the criminal justice system (Holly Harris). Staffing them up will improve community safety. (JH) May be reprioritized to a #1 at a later date per Board of Commissioners on 4/3/19. This bill is to increase the current statewide 9-1-1 surcharge from 5.75 cents to $1.50. The current concern amongst some 9- 1-1 PSAPS 1-1'PSAPS with this bill as proposed is the change in the quarterly distribution formula from PSAP to PSAP. The proposed change in the distribution formula woutd'increase funds to smaller counties with potential to increase their current operating budget by as much as 300%. We are in support of the increase to $1.50, but the change in the distribution formula going forward no additional administrative cost to implement and maintain If this passes, and if the Courts charge public bodies for use of court electronic services, the impact on the District Attomey's budget will be significant as we access court documents on a daily basis. Modifies provisions relating to immunization records required for children attending schools and children's facilities. Requires licensed health care provider to provide vaccine information packet to patient to whom licensed health care provider administers vaccine. Requires parent who declines immunization for child to submit to administrator document including health care practitioner signature verifying practitioner reviewed immunization information with parent and certificate verifying parent completed vaccine educational module as condition of child's attendance at school or other children's facility. For purposes of qualifying for enterprise zone benefits, expands definition of "eligible business firm" to include business firm engaged in providing services to general public as medical clinic, health care facility, substance abuse treatment provider or alcohol or drug rehabilitation center. Directs Oregon Health Authority and specified professional regulatory boards to require licensees regulated by authority or board to complete six hours of continuing education related to suicide risk assessment, treatment and management every six years and to report completion of continuing education to authority or board. Allows authority and boards to establish minimum requirements that licensee must meet to be exempt from requirement to complete continuing education.
