BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON
An Order for the Sale of Certain Real
Property Acquired by Deschutes County ORDER NO. 2019-035
WHEREAS, Deschutes County has acquired title to certain real property, described in Exhibit
"A," attached and incorporated by this reference, pursuant to real property tax foreclosure proceedings
on file in the Circuit Court of the State of Oregon for Deschutes County and by other means, and
WHEREAS, foreclosure proceedings are completed, and tax deeds in the regular form have
been executed by the Deschutes County Tax Collector and recorded in the Deed Records of Deschutes
County pursuant to ORS 312.200 with respect to real properties acquired by tax foreclosure, and
WHEREAS. ORS 271.310, 271.340, 271.350, and 275.090 authorize the sale and/or exchange
by the Board of County Commissioners of the real property acquired through real property tax
foreclosure and other means, and
WHEREAS, the real property described in Exhibit "A," attached, is not needed for County
purposes and, thus, surplus, and
WHEREAS, the real property Deschutes County will receive in exchange forthe surplus property
is better suited for specific public purpose, that being potential street right of way to aid the overall
transportation system in the City of La Pine, and
WHEREAS, it is in the best interests of the County to sell and exchange the real property
described in Exhibit "A", and that the price set forth after the description of shall be the price for said
sale and exchange, and
WHEREAS, ORS 275.275 requires proceeds arising from the sale of county foreclosed property
to be applied in the following order: any state taxes, penalties and fees incurred in the foreclosure for
delinquent taxes by a county, then any costs in the maintenance and supervision of such property; and
WHEREAS, pursuant to ORS 275.275 and ORS 311, any proceeds received for the sale of
properties foreclosed for delinquent taxes and not necessary for the above listed activities are to be
distributed to the taxing districts; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
HEREBY ORDERS as follows:
Section 1. That the described in Exhibit "A", attached hereto and by this reference incorporated
herein, is deemed surplus and ordered to be sold and exchanged pursuant to ORS 271.310, 271.340,
271.350, and 275.090.

Section 2. The property received in exchange for the surplus property is suited for consideration
of dedication of public right of way to aid the overall transportation system in the City of La Pine,
including the intersection of Highway 97 and Drafter Road, and such property shall be retained for such
consideration.
Section 3. The Deschutes County Treasurer shall distribute the revenue from the sale to the
applicable taxing districts following any required distribution for state taxes, penalties and fees incurred
in the foreclosure for delinquent taxes by a county, and any costs for the maintenance and supervision
of such property.
