BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON
An Order Declaring Certain Deschutes
County Personal Property Surplus and
Authorizing Donation.

WHEREAS, certain personal property described in Exhibit A, attached hereto by this reference
incorporated herein, is no longer needed for public use by the County; and
WHEREAS, it is necessary to dispose of this surplus personal property; and
WHEREAS, it is appropriate to dispose of such property by donation; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
HEREBY ORDERS as follows:
Section 1. The Deschutes County Sheriff, or his designee, is hereby authorized and directed
to dispose of the personal property described in Exhibit A to this order.
Section 2. The Chair is authorized on behalf of the County to execute any and all documents
necessary to complete the transfer of any personal roperty in accordance with this order.

The Deschutes County Sheriff's Office agrees to donate, and the Harney County Sheriff's Office
agrees to accept the following used transport van:

The vehicles are donated "as is" and "with all faults, if any." The Deschutes County Sheriffs
Office disclaims all warranties or guarantees, expressed or implied, as to the conditions, quality,
completeness or fitness for any particular or general purpose or compliance to safety regulations
of the vehicle being donated.
The Deschutes County Sheriff's Office offers no guarantees or warranties. Determination of
conditions, function and perceived or assumed value is the sole responsibility of the Harney
County Sheriff's Office.
The Harney County Sheriff's Office agrees to indemnify and hold harmless the Deschutes County
Sheriff's Office and Deschutes County for any and all damages, claims or liability of any nature,
lawsuits, judgments, including attorney's fees and costs, from the donation and use of the
vehicle. Harney County, its predecessors, successors and assignees hereby release, relinquish
and discharge the Deschutes County Sheriff's Office, its former, present and future agents,
employees, officers, officials and legal representative from any liability arising out of the transfer
and use of the vehicles and/or concurrent negligence of Deschutes County for any injury,
including death or damage to persons or property, or other claims of damage where such
damage is sustained in connection with, or arising out of, the sale of the vehicles or the use of
the vehicles.

Background & History: The Deschutes County Sheriff's Office 2012 Chevy Express
3500 Van that has been used for transporting inmates has reached its end of use life for
our needs. In recent conversation with the Harney County Sheriff's Office Corrections, it
was determined that they are in need of an additional inmate transport van. The
donation our 2012 Chevy Van to Harney County Corrections is agreed to be beneficial
to both Sheriff's Offices.
