Commissioner DeBone supports possibly discussing this afternoon. Legal Counsel Doyle noted that the item had been pulled from the Agenda and that citizen input is restricted to items not otherwise on the Agenda. Mr. Pahlisch noted conflicting statements on County forms. CONSENT AGENDA: Before the Board was Consideration of Approval of the Consent Agenda. Commissioner Adair thanked members serving on the Public Health Advisory Board for the work they do. Motion Carried RECONVENE AS THE GOVERNING BODY OF DESCHUTES COUNTY 2. Wildfire Mitigation Advisory Committee Application Review and Mapping Progress Zechariah Heck, Associate Planner, handed out an addendum to the packet materials correcting an error. He requested Board direction to appoint new members. He added they received great interest, with additional applications received after the deadline, which he can provide if the Board chooses. Commissioner DeBone inquired about items the committee plans to discuss. Mr. Heck explained they may discuss a potential amendment to building code R327.4 regarding review of new dwellings; also looking for the committee to consider a 2015 audit, by University of Oregon's Community Service team, about the code surrounding natural hazards, reducing potential losses around the County based on land use standards. Commissioner DeBone added this committee would be charged with updating the wildfire hazard map to include zone designations. Nick Lelack, Community Development Director, wanted to note that the hazard zone map will be based on the Oregon Department of Forestry's four criteria outlined in State law. These will be outlined in a charter for the committee, to confirm expectations around decision-making and ensure no other influences are taken into account. Commissioners Adair and DeBone support the charter. Commissioner Adair inquired whether the map takes structures into account, and County Forester Ed Keith named the four factors: weather, topography, and two vegetation factors: fuel type and fuel continuity. Commissioner DeBone suggested postponing the discussion to allow for review of applications, and Chair Adair suggested that staff prepare a draft of the charter as well. Mr. Lelack confirmed they will schedule a future meeting time when all Commissioners are present for application consideration and review of the draft charter. Commissioner DeBone supports adding applications submitted after the deadline, and Chair Adair does not. She suggested those late applications only be considered if needed after BOCC MEETING SEPTEMBER 4, 2019 PAGE 3 OF 5 consideration of the initial pool of applicants. 3. Consideration of Board Signature of Resolution No. 2019-040 and Document No. 2019-610, Pollution Reduction Credit Amendments and Partnership Agreement This item was pulled from the agenda for discussion at a future meeting. 4. Continued Discussion of the Solid Waste Management Plan Timm Schimke, Solid Waste Director, offered to address any questions or concerns regarding the plan before moving toward formal adoption. Commissioner DeBone proposed the addition of a position paper regarding the private sector, the County's current stance and how it has been utilized. The specific question of privatization has come up and it would help to document the frame of mind at this time as we are go through this process. Chair Adair suggested Solid Waste will need to look at privatization on some level. Commissioner DeBone added that showing the history is also important, and in the past there was no Solid Waste Advisory Committee (SWAG), so it would show where the County is at during this point in time and to provide context for future decisions. There is also a great history of cost savings. Mr. Schimke suggested writing a recommendation as an administrative chapter, or just a one or two page position paper as an appendix. Commissioner DeBone has read through the detailed plan, and with the additional information suggested today, the guidance of SWAC, and active staff and leadership, he is closer to being ready to adopt the plan. Chair Adair agreed those additions are important ones, and suggested Mr. Schimke return on September 18th for further review and consideration. Mr. Schimke confirmed he will draft an appendix item as discussed today and send to the Board prior to his return on September 18tH OTHER ITEMS: BOCC MEETING SEPTEMBER 4, 2019 PAGE 4 OF 5 Commissioner DeBone stated the Project Wildfire team is in attendance today. The Board is working to potentially add resources and take the committee to the next level. I have a keen interest in wildfire mitigation, and community development as our residential areas pushes further into the Wildland-Urban Interface (WUI) zone. As a local resident and first responder, I am very concerned with the patterns of development that have increased our vulnerability to natural hazards, particularly the threat of catastrophic wildfire. I attend the monthly Project Wildfire meetings and took part in the April 2019 Wildland Fire Cohesive Strategy Workshop. I am a part-time graduate student at the University of Washington's Infrastructure Planning and Management program. My research focuses on the areas of emergency management, critical infrastructure protection, and community resilience. I have conducted coursework in the areas of infrastructure planning and finance, as well as emergency management, community resilience, and GIS. I have had the opportunity to study numerous case studies of the Camp Fire in Paradise, CA, as well as interviewing FEMA officials involved in managing the recovery operation. I believe this incident holds many valuable lessons for our community that we must integrate into our planning for development, building codes, and mitigation activities. Before moving to Bend, I served for twenty-five years as an officer in the United States Army. I live in a wildland urban interface, have been a SB360 evaluator for my HOA, was on the Planning Commission when the 2015 study was done and have been readied for evacuation several times. The County does need some updating of both its land use and code considerations. I am not certain all of those suggested by the UO study are practical. Colorado has done extensive work on design and code, at least that is what I found the last time I researched this. They have not seemed to have become too restrictive in "approved" building products as compared to California where one approved soffit vent may cost 50.00. A balanced approach to this issue is important, particularly for remodels - otherwise owners will avoid pulling permits to avoid well intentioned but onerous and expensive requirements. The recent Bend Transect Zone for development density transition allegedly having the initial application be for a 17,000 sq ft structure suggests the need for a common sense approach for land use patterns, structure density and size, evacuation routes and site/development design in the more wildfire prone areas. The program is not currently working as intended to facilitate the development of Quadrant 1 and sell County - owned land in the New Neighborhood, and generate revenues for the Groundwater Partnership Fund. The proposed Board Resolution 2019-040 amends the Pollution Reduction Credit (PRC) program to facilitate the development of Quadrant 1 and sell County -owned land the Neighborhood Planning Area, and generate revenues for the Groundwater Partnership Fund. The PRC Partnership Agreement implements Resolution 2019-040 facilitate development of New Neighborhood Quadrants 1 a, 1 b, and 1 d, provide financial resources to the Groundwater Partnership Fund, and provide financial incentives to achieve affordable housing goals. FISCAL IMPLICATIONS: Generate up to $291,000 to the Groundwater Partnership Fund over the buildout of Quadrant 1. BACKGROUND Deschutes County adopted a "Transferable Development Credit" (TDC) program in 2004. It was developed as the result of several years of collaboration between federal, state and local governments to address water quality issues in southern Deschutes County. The intent was to transfer rural development pressure from rural areas into a master planned community in La Pine that possessed available public water and sewer systems. A TDC is produced one of two ways, a restrictive covenant or pollution reduction credits. Restrictive Covenant A Restrictive Covenant is a recorded document restricting the placement of a septic system on an eligible, vacant rural property, south of Sunriver.' An eligible lot or parcel upon which a restrictive covenant is recorded is assigned one (1) TDC. If the eligible lot or parcel is located in the High Priority Deer Migration Corridor Area, it receives an additional one-half (1/2) TDC. Rural properties with a restrictive covenant are located in the "Sending Area." The "Receiving Area" is the NPA in the city of La Pine. To subdivide in the NPA, a developer must first acquire a certain number of restrictive covenants prior to final plat (subdivision) approval. The amount and sale of a TDC is between a property owner and the purchaser, not Deschutes County.z Pollution Reduction Credits Deschutes County established a Pollution Reduction Credit (PRC) program in 2006. A PRC is assigned when an existing onsite wastewater treatment (septic) system, located in rural southern Deschutes County is upgraded to become a nitrogen reducing system that meets the standards necessary to protect the region's drinking water supply. Any developer working in the NPA uses PRCs as part of the subdivision process. Similar to the restrictive covenant explained above, a developer must first acquire a certain number of PRCs prior to final plat (subdivision) approval. In general, any property owner in southern Deschutes County with an existing onsite wastewater treatment system that was in use on or before May 31, 2006 is eligible to create a PRC if the system is upgraded. III. POLLUTION REDUCTION CREDIT AMENDMENTS Applicable Deschutes County Code Deschutes County Code (DCC) 11.12 implements the TDC program summarized above. DCC 11.12.020(C) and (D) provide the Board of County Commissioners (Board) the authority to establish and amend the PRC payment in lieu fee and the number of PRCs required to develop in the NPA.' Quadrants 1a, lb, and 1d Amendments Resolution 2019-040 reduces the PRCs required to develop Quadrants 1a, 1b, and 1d from 325 to 194. Initially, the County established the required number of PRCs based on the anticipated number septic system retrofits in rural South Deschutes, and allocated across quadrants in the NPA based on acreage.4 This amendment changes 1 Unsewered areas from Sunriver south to the Klamath County border in Townships 19, 20, 21, 22 and Ranges 9, 10, 11, from Sunriver south to the Klamath County border are eligible to create a TDC. 2 As discussed at the August 21, 2019 meeting, a restrictive covenant is no longer viable due to the market value of south county real estate, which far exceeded Deschutes County's initial offer of a $3,000 TDC credit, $4,500 if the property is located in a high priority deer migration area. ' C. PRC. 3. The County shall grant a PRC to a developer in the Receiving Area if the developer provides one of the following: a. A Retrofit, in cooperation with the property owner of a property eligible for a PRC, Existing Wastewater Treatment System and documentation submitted to the County that includes proof of ownership of the subject property, proof of consent of the property owner for the Retrofit, and final County inspection of the Retrofit; or b. Payment into the County's Financial Assistance Fund the proportional cost established by Board of County Commissioner Resolution for a Retrofit. The County's fund shall be used to aid property owners in reducing the overall discharge of nitrogen into the basin groundwater in south Deschutes County. D. Assignment of TDCs to the Receiving Area. 4. PRCs shall be assigned to a tract at a rate established by Board of County Commissioner resolution. 5. The Board may, by resolution, adjust the number of TDCs required per acre or alter the factors for which TDCs are required in the Receiving Area. 4 DCC 11.12.010 Definitions: "Retrofit" means to upgrade or replace an Existing Wastewater Treatment System ... with a Nitrogen Reducing System approved by the County. -2- the allocation of PRC requirements from an acreage to a per lot calculation. In the present situation, 194 lots are proposed to be developed in Quadrants 1a, 1b, and 1d. Payment in Lieu Fee Amendments Per DCC 11.12.020(C)(1)(b), a developer in the NPA may pay into the County's Financial Assistance Fund ("Groundwater Partnership Fund") the proportional cost for a retrofit established by the Board for a retrofit, otherwise known as "a payment in lieu fee." The original payment -in -lieu fee of $7,500 was estimated to cover the wholesale cost of a nitrogen reducing treatment unit to retrofit an Existing Wastewater Treatment Systems The amount was also established at a high amount to incentivize developers to retrofit units rather than pay the in -lieu fee.' Quadrants 2c and 2b Amendments Resolution 2019-040 confirms the TDC and PRC obligations have been met for these quadrants. The County provided most of the TDCs to Elk Horn Development/Elk Horn Land Development as part of land sale and related agreements.' ' Quadrants 2a, 2d, and Neighborhood 3 and 4 Amendments The County owns Quadrants 2a, 2d, and Neighborhoods 3 and 4. Resolution 2019-040 eliminates the TDC/PRC requirements for these properties. With the TDC/PRC requirements in place, the County would be required to sell the land at significant discounts to account for the TDC/PRC financial or retrofit obligations on the purchaser. The result of eliminating the TDC/PRC requirements allows the County to sell the land at market rate, generating the same revenues for the Groundwater Partnership Fund as the discounted sales price plus the payment -in -lieu fees. Hence, there is no impact to the Groundwater Partnership Fund. IV. PRC PARTNERSHIP AGREEMENT The PRC Partnership Agreement between Deschutes County and Vic Russell Construction, Inc. and Sagebrush Development, LLC implements Resolution 2019-040 for Quadrants 1a, 1b, and 1d, and provides incentives to build affordable housing. Recent real estate reports indicate the median price of a home in La Pine ranges from $255,000 to $303,000.$ The Agreement provides financial incentives to build homes less than $250,000 to address the city, county, and region's affordable housing and homeless crises. It is important to note that the Board has previously supported affordable housing developments in the NPA through land donations and other agreements, such as the Little Deschutes Lodges 1 and 2 and Habitat for Humanity developments. I live in a wildland urban interface, have been a SB360 evaluator for my HOA, was on the Planning Commission when the 2015 study was done and have been readied for evacuation several times. The County does need some updating of both its land use and code considerations. I am not certain all of those suggested by the UO study are practical. Colorado has done extensive work on design and code, at least that is what I found the last time I researched this. They have not seemed to have become too restrictive in "approved" building products as compared to California where one approved soffit vent may cost 50.00. A balanced approach to this issue is important, particularly for remodels - otherwise owners will avoid pulling permits to avoid well intentioned but onerous and expensive requirements. The recent Bend Transect Zone for development density transition allegedly having the initial application be for a 17,000 sq ft structure suggests the need for a common sense approach for land use patterns, structure density and size, evacuation routes and site/development design in the more wildfire prone areas. Since 2005, Pahlisch has worked with the county and individual homeowners in southern Deschutes County to protect the south county groundwater by retrofitting individual septic systems and purchasing Pollution Reduction Credits. Pahlisch's continued efforts in the La Pine area have led to the development of a new community. Presently, Pahlisch has entitled and developed over 150 lots, with 49 additional lots to be developed in the near term. Recently, Pahlisch was notified that the county plans to drastically modify the Pollution Reduction Credit program (the "Program"). The modifications are more particularly set forth in proposed Resolution No. 2019-040. Although Pahlisch agrees that modifications to the Program may be warranted, Pahlisch believes that the impacts of such a drastic change should be fully evaluated, with participation by Pahlisch and possibly the TDC Advisory Committee established by DCC 11.12.040. The proposed changes to the Program put Pahlisch at a competitive disadvantage and are simply unfair. Pahlisch has invested almost $1,500,000 into the Program. Those investments are necessarily factored into Pahlisch's pro forma and the purchase price of homes. We believe that the county should fully consider the impacts of the changes in the Program to Pahlisch and the future impacts of reducing the cost of Pollution Reduction Credits in Newberry Neighborhood Quadrants 1a, 1b and 1d and eliminating the credits in Quadrants 2a, 2d and Neighborhoods 3 and 4. From a legal standpoint, we do not believe that Resolution 2019-040 complies with the requirements of DCC 11.12.020(D)(4). While the county has the express authority to assign the rates associated with Pollution Control Credits under DCC 11.12.020(D)(4), the county does not have the authority to eliminate the requirement to purchase credits in Quadrants 2a, 2d and Neighborhoods 3 and 4. These "receiving areas" are "areas designated by the County where Transferable Development Credits are required in order to purchase and develop a tract of land." DCC 11.12.010 (emphasis added). Consequently, if the county desires to remove the obligation to purchase credits in these "receiving {00923336;1} Deschutes County Board of Commissioners September 4, 2019 Page 2 areas" the county must amend DCC 11.12.010 or the official maps of the "receiving areas." The county may not, by resolution, eliminate this obligation. Pahlisch again acknowledges that changes to the Program may be warranted and desires to work cooperatively with the county and other stakeholders to ensure that changes to the Program are fair to all parties. We urge the board to delay adoption of Resolution 2019-040 until the county has had an opportunity to work with Pahlisch and other stakeholders on reasonable changes to the Program.
