A Resolution amending the Pollution Reduction
Credits part of the Transferable Development
Credit Program required for developing the La
Pine Neighborhood Receiving Area

WHEREAS, on June 6, 2006, the Board of County Commissioners ("Board") adopted Ordinance 2006-
016 amending Deschutes County Code Chapter 11.12 to define a Transferable Development Credit ("TDC") as
including a Pollution Reduction Credit ("PRC") for the retrofitting of existing wastewater treatment systems or
for the payment in lieu of retrofits, and
WHEREAS, Ordinance 2006-016 also amended Chapter 11.12 allowing for developers to contribute to
the County's Groundwater Partnership Fund for TDCs and PRCs instead of installing retrofits in order to
develop in the TDC program's "Receiving Area;" and
WHEREAS, the Board of County Commissioners adopted Resolution No. 2006-43 on June 5, 2006 to
establish TDC and PRC requirements to complete the development of Quadrants la, lb, Id, 2a, 2b, 2c, and
Neighborhoods 3 and 4 in the Newberry Neighborhood; and
WHEREAS, DCC 11.12.020 states that the Board may, by Resolution, adjust the number of
Transferable Development Credits required in the Receiving Area or alter the factors for which Transferable
Development Credits are required in the Receiving Area; and
WHEREAS, the Board of County Commissioners supports efforts to increase the supply of housing in
the City of La Pine and throughout Deschutes County; now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES
COUNTY, OREGON, as follows:
Section 1. This Resolution replaces Resolution No. 2006-043 in its entirety.
Section 2. The number of Pollution Reduction Credits needed to develop Quadrants la, lb, and Id
is 194.
Section 3. The Transferable Development Credits and/or Pollution Reduction Credits needed to
develop Quadrants 2c and 2b have been met.
Section 4. Transferable Development Credits or Pollution Reduction Credits are not required to
develop Quadrants 2a, 2d, and Neighborhoods 3 and 4.

Section 4. Payment by developers of Newberry Neighborhood Quadrants la, 1b, and Id into the
Deschutes County Groundwater Partnership Fund of $1,500.00 shall equal one PRC. The Board of County
Commissioners and developers may establish a Pollution Reduction Credit (PRC) Partnership Agreement to
provide financial incentives to achieve housing goals.
