7:30 AM TUESDAY, FEBRUARY 11, 2020 ALLEN ROOM
A conference call was held on Tuesday, February 11, 2020 at 7,30 a.m. in the Deschutes County Allen
Room as a part of a weekly scheduled event during the 2020 Legislative Session. Present in addition to
county staff were Phil Scheuers (via phone). Chair Commissioner Adair called the meeting to order. One
identified representative of the media was in attendance.

Chair Adair called the meeting to order and asked for legislator input.
Legislator Priorities
- Representative Breese Iverson discussed the HB 4043 regarding water project piping and
explained she expects amendments. Commissioner DeBone stated AOC took a position of
opposition to that bill. She is working on HB 4092 regarding Bug Butte Creek; and HB 4093,
regarding secondary wood product manufacturers, which is scheduled for a work session.
Representative Zika stated HB 4095 to expand the UGB for affordable housing will go to a
task force to look at how to take a pilot project to a statewide policy. He also stated the Child
Care bill, HB 4096, has died but hopefully some of the language can be included in another
bill. Chair Adair inquired about the judges needed by Deschutes County and Rep. Zika had
no updates. Mr. Scheuers stated his team is having another meeting with Rep. Rayfield next
week.
Chair Adair asked for update on SB 1536. Mr. Keith stated that he attended the hearing with
Mr. Lelack and provided testimony regarding the counties being tasked with fire protection
for unprotected lands, but there still may be additional amendments. Mr. Lelack stated the
formal amendment has not been posted but is scheduled for work session, and he would
expect a public hearing today or tomorrow.
- Representative Helt expressed her thanks to the Commissioners and staff for their support
and presence in Salem. She stated that Commissioner Adair testified on behalf of Sheriff
Nelson on HB 4145 (school safety), and added that this bill may get moved to the Senate. For
HB 4111 (Search and Rescue technical funding), there is a hearing today at 3:00 p.m.
BOCC Review of Department Recommendations for Priority Bills
Ms. Hale read through the priority bill list and provided recent updates:
SB 1552: Ms. Hale stated that Ms. Garceau provided testimony on this bill and that Ms.
Skundrick had forwarded the media coverage from that.
HB 4065: Ms. Hale explained that Commissioner Henderson had requested a letter be
drafted in opposition to this bill in preparation for Wednesday's hearing. judge Fadeley had
reviewed the letter and provided feedback on the letter as well. Commissioner DeBone
stated he would like to review the letter but is supportive of sending one. Ms. Skundrick
confirmed she would email the letter after this meeting. County Administrator Anderson
stated the Bulletin recently ran an editorial supporting this bill.
HB 4012: This bill is being watched as a potential to include ADU language. Mr. Lelack stated
the hearing yesterday much have happened very quickly as it was finished by the time he'd
gotten there. He will continue to follow and is waiting to see amendments.
Cap -And -Trade bills are being tracked, HB 4159, SB 1504, SB 1530 and SB 1574. Mr. Scheuers
stated there is a potential option that would only affect metro areas with an eastern Oregon
opt -out, but need to be aware whether Deschutes County gets included with eastern Oregon

or not, and the opt -out would not include the fuel portion. This will continue to change with
amendments and a walkout may affect outcomes.
HB 4079: Ms. Hale explained Commissioner DeBone had requested tracking for this bill
regarding a universal service surcharge. Commissioner DeBone has questions about the
need for broadband expansion in rural areas, and stated that it would be a big tax.
Administrator Anderson offered that he discussed this issue with I.T. Director Joe Sadony
who stated Deschutes County is covered at about 96% through our franchise provider.
Commissioner DeBone stated he likes the idea of fiber optic and high speed internet being
available in schools and public facilities, which it is.
SB 1559 is dead and will come off the list.
Mr. Kuhn stated that SB 1577 was supported heavily by Public Health last week, with both
written and oral testimony.
Hemp bills are being tracked, HB 4051, HB 4072 and HB 4158. Mr. Lelack did not have
updates on these, and Commissioner DeBone stated that hemp was not discussed at AOC.
Mr. Scheuers explained HB 4051 received no opposition and he expects it will move out.
Similarly, HB 4072 received no opposition. HB 4158 however, was contentious with a lot of
testimony. The issues will go to work group during the interim and come back in long
session.
- Ms. Hale asked Mr. Scheuers about SB 1561, and he did not have an update but would follow
up.
Mr. Scheuers stated the budget bills were introduced, and that he will keep an eye on the
capital construction reconciliation bill for language including additional judges for Deschutes
County.
- Chair Adair asked about HB 4001, and Mr. Scheuers explained they are waiting on additional
amendments, and Mr. Lelack added there is a work session and public hearing scheduled for
tomorrow.
HB 4145: Ms. Hale explained varying feedback was received by D.A. Hummel and also from
Ms. Garceau, who was on the phone and stated there is some concern from Behavioral
Health about youth and adults being put in the same category, where funding would come
from, as well as further stigmatizing those with a mental health disorder. Ms. Garceau stated
she is hopeful for amendments.
- SB 1545: Mr. Scheuers explained there are two potential avenues for this bill, either passing
in bill form or being added to an omnibus budget bill.
Chair Adair inquired about several bills
- HB 4085: The Board agrees to move the position from neutral to support.

HB 4013: Dr. Conway explained that Kratom is not currently regulated it has become an
issue. Chair Adair asked to elevate the priority level to a 2. Mr. Kuhn stated he would follow
up with CHLO to get information regarding their position.
- HB 4102: Ms. Garceau is monitoring this bill with a priority 3 recommendation.
HB 4002: Chair Adair stated the priority level does not need to be elevated, but people
should be aware of this bill.
HB 4039: Mr. Scheuers explained this may be funded by TRT, he will flag this bill and follow.
- HB 4040: Chair Adair requested this bill be elevated to a priority 3, position of support.
SB 1542: Chair Adair requested this bill be added to the list as a priority 2, support.
- HB 4083: Chair Adair requested this bill be added to the listed as a priority 2.

Unless the state legislature passes SB 1552, Oregon's Certified Community Behavioral Health Clinics (CCBHCs)
could be forced to end their operations, lay off staff, and turn vulnerable patients away from care.
Passage of SB 1552 will leverage $62 million in federal dollars through an Oregon legislative investment of $15
million this fiscal year. Without this investment, most CCBHCs will close, up to 52,000 Oregonians' will lose access
to lifesaving services, and many of the 250 professionals added by CCBHCs will lose their jobs.
Since launching in 2017, Oregon has leveraged new funding to dramatically improve access to community -based
addiction and mental health care, particularly opioid addiction services. Oregon's CCBHCs have:
• Seen more than 52,000 patients.
• Increased availability of same -day access appointments to 75%.
• Increased the number of veterans receiving care.
• Improved screening for depression, substance use and suicide and health risks.
• Enrolled nearly 700 behavioral health clients in primary care in one year, improving quality of life and
keeping individuals out of costly emergency departments.
In Deschutes County, our local CCBHC has generated more than $11 million in the past two years, which has
increased access to mental health and addiction services for our most vulnerable citizens. Locally, we've seen the
following positive outcomes:
107% increase in mental health services to veterans.
31 % decrease in emergency department use by high utilizers group - saving health care dollars
96% of adults screened for suicide risk, 90% of adults screened for alcohol use disorders
The federal demonstration prospective payment model has enhanced revenue, allowing CCBHCs to finance the
infrastructure needed to provide these comprehensive services. Please support SB 1552 and help maintain our
CCBHCs' good progress.

We have heard from Rob Bovett, Legislative Counsel and Acting Director of the Association of Oregon Counties,
that a rural Accessory Dwelling Unit (ADU) amendment may be added to HB 4014. We are very supportive of
seeing a rural ADU amendment move forward this year. As you know, Deschutes County is Oregon's fastest
growing county and we face a critical shortage of affordable housing options for our growing population. If this
topic is not addressed in this year's short session, we will be even further behind in addressing our region's the
growing housing needs, by the time the 2021 session arrives and we can re-engage this discussion.
A rural ADU amendment would allow us to:
• Provide housing without significant public resources;
• Increase the supply of rental, supportive and multigenerational housing;
• Legalize some existing, unpermitted second dwelling units; and
• Increase the affordability of housing by allowing property owners to purchase or maintain a home with
rental income from the ADU or from the primary dwelling if living in the ADU.
If an amendment is considered, we encourage the Committee to provide local control to counties to determine
development standards and limitations governing ADUs. While Deschutes County supports more local control
than was drafted in SB 88, the proposed standards are workable and address issues of statewide interest.
We know that in other parts of the state, there has been concern that allowing rural ADUs will negatively impact
the rural nature of Oregon's farmland. That is not the case in Deschutes County. We have a large number of rural
home sites not connected to farm use. Also, substantial support for this measure exists in our County. Allowing
rural ADUs could be a valuable tool in helping us alleviate the housing shortage we are currently experiencing.

The Deschutes County Board of Commissioners opposes Senate Bill 1530 and asks that members of the Oregon
Legislature not pass it during the 2020 session. All of us Commissioners have long supported efforts at clean
water, clean air and smart energy options for our state and nation. However, we also believe that any measure
this divisive should be passed only by a vote of the people of Oregon. The anticipated costs and debated benefits
are both too significant.
Senate Bill 1530 mandates a "climate change" policy that will raise prices for transportation fuels, natural gas and
propane. These costs will force financial hardship on our region's small business owners, rural citizens, local
manufacturers, farmers and trucking companies. We worry that Central Oregon will suffer and see jobs lost as
local businesses close and move out of state. Creating this competitive disadvantage, especially in our state's rural
and non -metro areas, doesn't make sense.
We also have concerns about the impact Senate Bill 1530 will have on gas taxes for day to day living. Adding an
additional 22 cents to each gallon of gas (which would grow to $3.00 per gallon) -- on top of the 36 cents
Oregonians pay now -- will create unnecessary hardship for many, including young families, fixed -income seniors,
and so many other County residents who are already struggling with our region's high cost of living. It is more
difficult to calculate the impacts from increases planned to natural gas and propane sources. We also worry that
recently introduced amendments that would affect Bend but exempt other areas of Deschutes County from
certain regulations will cause undue confusion and serious economic distortions.
Senate Bill 1530 will impact the cost of doing business for our County and counties and cities around the state.
For instance we estimate a financial impact of more than $109,317 on our County fleet, in annual costs due to
impacts from the increasing cost of fuel. More significantly, the bill will tax non -County auto and truck traffic in
our County between $10 to $11 million annually.
We strongly encourage you to oppose Senate Bill 1530. We think all Oregonians can agree that a policy that puts
Oregon's businesses on an un-level playing field with their out-of-state competitors elsewhere is simply not good
policy.

WHEREAS, The Deschutes County Board of Commissioners supports caring for our
common home, with education and industry advances by lowering carbon intensity of energy;
and
WHEREAS, The Deschutes County Board of Commissioners represents an estimated
181,307 people; and
WHEREAS, Deschutes County provides a wide range of critically needed services to its
residents including health and human services, roads, solid waste disposal, and public safety;
and
WHEREAS, Senate Bill 1530 will mandate a "climate change" policy that will raise prices for
transportation fuels, natural gas and propane, forcing financial hardship onto our region's small
business owners, rural citizens, local manufacturers, farmers and trucking companies; and
WHEREAS, Senate Bill 1530 will directly impact the cost to Deschutes County and the
residents of Deschutes County in significant increases in the costs to provide services, through
increased utility costs and increased costs in fuel related to providing those critically needed

unnecessary hardships for many, including young families, fixed -income seniors, and so many
other County residents who are already struggling with the high costs of living in our region; and
WHEREAS, Deschutes County estimates Senate Bill 1530 will tax auto and truck traffic in
our County between $10 to $11 million annually; and
WHEREAS, Any benefits derived through Senate Bill 1530, many of which are in dispute,
do not justify the penalties and costs imposed by the Bill; now, therefore,
