2020-128-Order No. 2020-021 Recorded 4/7/2020REVIEWED LEGA C6U1,AEL Recorded in Deschutes County Nancy Blankenship, County Clerk Commissioners' Journal `�v'fES.CpG IIIII�I aj 2020-128 CJ2020-128 04/07/2020 7:22:15 AM For Recording Stamp Only BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON An Order Amending Order No. 2020-017 Regarding Prohibition of Tourist Travel * ORDER NO. 2020-021 and Lodging within Unincorporated Deschutes County WHEREAS, on April 1, 2020, the Board of County Commissioners enacted Order 2020-017 which prohibits certain types of short term lodging within unincorporated Deschutes County; and WHEREAS, in order to clarify and designate enforcement processes the Board of County Commissioners intends for this Order to provide additional relevant information; and WHEREAS, to insure that the mandates in Order 2020-017 are fully adhered to, the County makes this additional Order; now therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, HEREBY ORDERS as follows: 1. Pursuant to the Governor's Executive Order 20-12, ORS 431A.010 authorizes local public health administrators to enforce "public health laws," including (but not limited to) issuing administrative orders to enforce compliance. Governor's Executive Order 20-12, itself designated as a "public health law," is thus subject to enforcement pursuant to BOCC Order 2020-017, as amended herein. Accordingly, violation of BOCC Order 2020-017, as amended, constitutes a violation of Governor's Executive Order 20-12, and is subject to the penalties described in ORS 401.990. 2. In addition to enforcement as authorized by Section 1 above, violations of BOCC Order 2020- 017 may be enforced by actions instituted by county code enforcement processes, providing a daily civil penalty of up to $1000 per day, imposed incrementally against each adult maintaining occupancy in violation of Order 2020-017, and/or also imposed incrementally against each adult vested with any ownership interest (other than a security interest) in the subject housing unit. Order 2020-021 Page 1 3. This Order is effective at 12:01 a.m., on April 10, 2020, and will remain in effect until May 15, 2020, unless sooner terminated or extended by Board Order.
