Three bids were received and the apparent low bidder was Marcum and Sons, LLC. The Sisemore bridge was originally built in 1914. Motion Carried COVID-19 Update 10.Public Health Update DCSO Captain Paul Garrison reported on activity through the Sheriffs Office. Sheriff Office Legal Counsel Cary Colliaini reported on the COVID-19 Response Team that has been formed by Sheriff Nelson. Sgt. Nathan Garibay gave an update on the Incident Management Team and coordination of resources. Public Health Director Nahad Sadr-Azodi provided a community update regarding the COVID-19. Commissioner DeBone inquired on the status of restaurant inspections and if they are continuing. Mr. Sadr- Azodi will report back to the Commissioners. Guidelines and precautionary steps have been shared with local restaurants. Health Services SupervisorJill Johnson presented an update from the Communicable Disease Team. BOCC MEETING AP RIL15, 2020 PAGE 3 OF 10 11. Fire Free Cost Analysis and Discussion Solid Waste Operations Director Timm Schmike provided an update on the plans for the 2020 Fire Free Event. His report includes cost assumptions and impacts of lost revenue. Temporary employment will be required to provide additional staffing for the event. County Administrator Anderson reported on options for covering the cost of Fire Free this May. Commissioner DeBone commented on the positives of community involvement. Four scenarios were reviewed for the yard debris collection. Commissioner Adair feels Deschutes County needs to step up and take responsibility and act on reducing the risk of wildfires. County Forester Ed Keith was present via conference line and reported on Fire Free over the past 15 years to promote a prepared community to create defensible space. The firewise communities and homeowners associations have been planning and preparing for fire fuels reduction. Mr. Keith acknowledged the need to recognize that prescribed burning is not open this year. Media partners are ready to send out communications. Mr. Schimke stated the original suggestion was in context with COVID-19 response; Schimke questioned if by expanding this event we open ourselves up for criticism and identifies an option of postponing the event due to COVID-19 social distancing mandates. Commissioner Henderson sees the challenge but suggests maybe limiting traffic with an on-line system. Commissioner DeBone proposes starting this program early and allow people to pay for the promotional fuel reduction effort. Commissioner Adair supports Fire Free during May 9th - 30th. Commissioner DeBone recommends load balancing and advocates for Fire Free weekends but also offer during the week. Commissioner Adair supports 21 days of Fire Free from May 9th through May 30th. Commissioner DeBone supports the effort but is concerned about opening the program up for three weeks at no charge. Mr. Keith will work with the media and communities. Commissioner Henderson offered a two full week suggestion of May 9th _ 24th and then reassess the need. Mr. Schimke supported that proposal. Options for covering expenditures were reviewed. Mr. Schimke advocated reimbursing Deschutes Recylcing for any revenues lost due to the no charge collection. Discussions for cost coverage will be reviewed with County Administrator Anderson. Motion Carried 12.Discussion and Possible Action on Event Permits Deputy County Administrator Erik Kropp introduced the discussion and recommended options. Mr. Kropp stated special events are different than outdoor mass gatherings in that events do not last as long as OMG, and generally impact only county roads or rights of way. Most occur primarily on private property. Some events do not require an event permit based on allowable land use. Event permits are submitted through the Risk Management Department and are reviewed by various County departments. Approximately 55 event permit applications are received annually. Mr. Kropp's options include retaining status quo, informing event organizer of the Governor's Orders, or to require event organizers to submit an event plan for social distancing. Sheriffs Office Captain Paul Garrison recommends cancelling all events for a rolling 90-day period. Mr. Kropp thinks that our insurance requirements could include the coverage for social distancing claims. County Counsel Dave Doyle stated infectious disease claims are generally not covered under standard insurance policy. Captain Garrison stated there is no prediction of the impact on staffing during an event when they may need to be used for resources elsewhere, including the COVID-19 response. Commissioner Henderson supports canceling events through June. Commissioner DeBone supports a sliding window. Commissioner Adair supports requiring a social distance plan. Commissioner DeBone supported events are canceled through a certain date until the state of emergency order is cancelled. Discussion held on the length of event cancellations. Commissioner DeBone stated this is a change in our society. Captain Garrison acknowledged the event applications take ground work and considered monitoring the BOCC. MEETING APRIL15, 2020 PAGE 5 OF 10 anticipated peak of the COVID-19. Commissioner DeBone supports having the event organizer present an organized social distancing plan. There are two applications for events in May. The Board supported requiring the event organizer to submit a social distancing plan. County Administrator Anderson reported that in response to Commissioner's discussion that County Counsel can prepare a draft order requiring an approved social distancing plan as part of the event permit process. Legal will present the draft order this afternoon. Mr. Kropp will contact all event organizers regarding the new requirements. The event permit applications for 2020 will be included on the agenda of BOCC April 22, 2020 COVID-19 Update. 13.Short Term Rental Restriction Update Captain Garrison reported the Sheriff's Office has not received any complaints regarding short term rental violations. Mr. Anderson reported on emails coming in through the community. RECESS: At the time of 12:45 p.m. the Board went into recess and reconvened the meeting at 1:32 p.m. Communication Director Whitney Hale provided an update on the short term rental restrictions. Media releases and social media messages were sent out and the Deschutes County website has a page on Frequently Asked Questions. The messaging was also sent to destination resorts. Ms. Hale reviewed examples of questions coming from property owners. Commissioner DeBone supports reviewing various types of exemptions. County Administrator Anderson explained there is no way to verify if the person submitted the request for an exemption is truthful. The current Board Order is in effect until May 15t" Follow-up: County Administrator Anderson presented the Board Order prepared by County Counsel relative to special event permits and the necessity for social distancing plans. 14.COVID-19 Budget Impact County Administrator Anderson reported that the Association of Oregon Counties has requested financial impact and revenue loss information from all Oregon counties. Chief Financial Officer Gregg Munn prepared a report of estimated financial impact of COVID-19. Mr. Anderson will also comment on long-term plans for Deschutes County. Commissioner Henderson stated the Commissioners also have detail to include in the conversation. Mr. Munn reviewed the categories identified for increased expenses and decreased revenue. Commissioner Henderson requested detail on the expenses occuring from the Emergency Operations Center. Mr. Munn explained the department is doing their best with estimating expenses through the fiscal year in response to COVID-19. The average cost per month is $25,000 for labor for Deschutes County since January. The recommendation was to include additional information under the decrease in revenue from lottery proceeds. Discussion held on room tax and decreased revenue based on fewer rentals. County Administrator Anderson spoke on tourism during the 2008 Recession. Commissioner Henderson commented this crisis is different as it is a health crisis leading into a Recession. Commissioner Henderson requested a column that shows the Deschutes County departments that are impacted directly by the decreased revenues. Cheryl Smallman, Health Services reported on the decreased workload within the Health Services departments and services that are provided by staff in reassigned areas. The Fair and Expo has significant impacts to revenue due to the loss of events, food & beverage, horse stalls, and RV park fees. County Administrator Anderson reported that staff at Fair and Expo are being BOCC MEETING APRILI5, 2020 PAGE 7 OF 10 reassigned to various County departments. Mr. Anderson reported Geoff Hinds is working with the Fair Board and the Fair Association to consider options for the Annual Fair. Mr. Anderson stated some elements of the Annual Fair can most likely continue and recommends the Commissioner's participation in that discussion. The Community Development Department has seen a decrease in revenue in all but two of their divisions related to decreased applications during the next six months. The Board requested an analysis on the ongoing impact to gas tax revenue. Mr. Munn will provide that information. Commissioner DeBone reported a letter was requested from the Association of Oregon Counties relative to Deschutes County's COVID-19 response which would include the financial impacts including unexpected costs and lost revenue. Recommended revisions were made. Communications Director Whitney Hale will prepare a revised letter. County Administrator Anderson also noted the Budget Committee is scheduled to undertake a preliminary review the budgets of the District Attorney, Health Services and the general revenue impacts of COVID-19 for Deschutes County as a whole. SPecial Events Discussion Continued: County Counsel Dave Doyle prepared Board Order 2020-023, a Public Health Emergency Order Mandating an Approved Distancing Plan for All County Permitted Events Through May 31, 2020. The Board reviewed the Order. Mr. Kropp recommended that Environmental Health review the submitted social distancing plans. Commissioner DeBone expressed support acknowledging review. This item can be reviewed at the next BOCC meeting. • The Board has a conference call with Congressman Walden from 12:30 to 1:30 p.m. tomorrow and requested to delay the Budget Committee Meeting to 1:30 p.m. tomorrow. The attached analysis includes actual costs from 2019, cost estimates for a modest expansion of days at transfer stations (2 weekends rather than 1), and cost estimates for a month long event at all locations. The month long proposal was made as a possible solution to the high number of participants we usually get, which raises a concern about holding large events during the COVID-19 crisis. Weekend days of the events tend to attract 1200 or more cars a day. It will be difficult to process that many customers and maintain the social distancing guidelines that are in place in Oregon. It is hoped that a longer event would result in less cars per day. That may or may not be realized. The attached spreadsheet shows the cost analysis. A brief explanation of our assumptions and impacts include: 1. It is not possible to predict exactly how much material might be collected for a full month event. Certainly, we will see more material in a 30-day event than our normal event, but we do not anticipate seeing 3 times as much material even though having many people idled due to the virus situation may drive up participation. We assumed volumes received at Knott Landfill would double the amount received in 2019, and that the transfer stations would receive the volume received in May 2019 for both the fire free weekend as well as all materials received during the rest of that month. Grinding cost estimates reflect these assumptions and include transport costs from transfer stations to Knott. 2. A full month event will result in personnel and equipment from Deschutes Recycling to help staff the event at Knott. We have discussed this with Deschutes Recycling and they have quoted a price for equipment and personnel that would be available. They will not be able to meet all of the requirements for the event, but their assistance will be valuable. 3. A month long event will significantly impact Deschutes Recycling revenue. It is estimated that they will lose about $85,000. This will be partially offset with our use of their assets at the Knott event, but will not completely cover their loss. 4. Our costs for temporary help are based on rates we routinely pay for this type of labor. We estimate the need for 16 people from outside the Department in order to safely conduct a 30-day event. We have not attempted to determine the ease of obtaining this number of people, or if a higher cost will be required. S. Our estimates show our costs will roughly double for a 30-day event. Approved administratively by the County's Deputy County Administrator/Risk Manager, events are reviewed by the Sheriff's Office, Road Department, CDD, Environmental Health, etc. Events must submit proper insurance to protect the County. At the Board's April 6th, meeting, there was a discussion about permitting events during the COVID-19 pandemic. List below are several options for Board consideration: 1. Status quo. 2. Inform organizers the requirements related to events from the Governor's Order (social distancing). 3. Require organizers to submit a social distancing plan for their event that is compliant with the Governor's Order. 4. Sheriff's Office recommendation: Rolling 90-day (3-month) cancellation of events from the date the Board declared a State of Emergency: Cancellation only applies to events that require a County event permit - (issued administratively through Risk Management). Events occurring in April - June 30, 2020 will not be issued a permit. If the State of the Emergency remains in place on May 1, July events will be cancelled; if the State of Emergency is in place on June 1, August events will be cancelled; and so on. The rolling 90-day moratorium will continue until the State of Emergency is lifted. Attached is a list of upcoming events for 2020.
