REVI"D LEGAL COUNSEL Recorded in Deschutes County CJ2020-190 Nancy Blankenship, County Clerk commissioners' Journal 06/16/2020 10:46:02 AM ES 2020-190 BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON An Order Setting a Public Hearing on a Petition to * ORDER NO. 2020-019 Annex Land into West La Pine Livestock District WHEREAS, the Board of County Commissioners of Deschutes County (`Board") on or about June 14, 2019 received a petition to annex land into the West La Pine Livestock District ("District") as referenced in Exhibit A attached hereto to and incorporated by reference into this Order; and WHEREAS, Oregon Revised Statutes 607.010 et al. (2017 version) governs this petition because it was filed with the County and pending before the January 1, 2020 effective date of the 2019 Act revising applicable state law; and WHEREAS, ORS 607.013 (2017) requires this Board to set a public hearing on the petition not less than 30 days of the date of this order; and WHEREAS, at this hearing any interested person may appear and present evidence relating to the petition for annexation and the Board may consider such testimony in deciding whether the District's boundaries should be changed; Now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, HEREBY ORDERS as follows: Section 1. The Board declares its intention to hold a public hearing on July 15, 2020 to consider testimony and evidence on the petition to annex into the West La Pine Livestock District that area of land described in Exhibit A hereto. Section 2. The County Clerk shall publish notice of this public hearing in the County's newspaper of record once a week for two successive weeks prior to the hearing, and forward said notice to the Oregon Department of Agriculture by certified mail, in accordance with ORS 607.013 (2017). Section 3. Within 15 days after the hearing and if the Board is of the opinion that the boundaries of the District should be changed, the Board shall call an election to be conducted in accordance with ORS chapter 255. Each petition is for a different area of land. The Clerk has certified the petitions, and staff has corresponded with the chief petitioner (Ron Thompson) extensively over the last nine (9) months regarding how to move forward. Initially, Mr. Thompson indicated that he intended to gather the requisite number of signatures in support of the petitions so as to avoid the need for an election on the petitions. However he has recently determined that collecting the necessary signatures is not feasible. So, an election will be required. For each petition, the electors will be those individuals registered to vote within the area to be annexed. The 2017 version of ORS Chapter 607 governs these petitions because they were filed with the County before the January 1, 2020 effective date of the 2019 Act that revised applicable state law. Under that Chapter, the Board is required to set public hearings on the annexation petitions and, if the Board approves the petitions, to call an election. The next available time for that election will be November 2020. The purpose of proposed orders 2020-018 and 2020-19 is to declare the Board's intention to hold public hearings on the petitions, and to direct that notice of the hearings be given in accordance with state law.
