Also present were Tom Anderson, County Administrator; David Doyle, County Counsel (via Zoom conference call); and Sharon Keith, Board Executive Assistant (via Zoom conference call). Attendance was limited due to the Governor's Virus Orders. Commissioner Henderson explained the background of the agreement listed on Consent Agenda Item #3 as well as the announcement of the real property auction this October. Approval of Minutes of the August 12, 2020 BOCC Meeting Commissioner DeBone reported that the 100 year anniversary of women voting was celebrated yesterday and a ceremony was held in the County Clerk's Office. Commissioner Adair attended a ceremony in Sisters. Commissioner DeBone commented on the history of voting in the state of Oregon and offered to the public the Clerk's Office or Commissioners are willing to answer any questions regarding voting. Commissioner Henderson commented on the public misconceptions regarding mail -in ballots. BOCC MEETING AUGUST 19, 2020 PAGE 2 OF 9 ACTION ITEMS: 9. Consideration and Second Reading of Ordinance No. 2020-009, Amending the Deschutes County Transportation System Plan (TSP) Text to 1) Add J-Turns as an Option to Frontage Roads for US97 Bend - Redmond Raised Median and 2) Leave Vandevert Road Connected to US97 Senior Transportation Planner Peter Russell (via Zoom conference call) presented the Ordinance for the second reading. Commissioner Henderson expressed his concern for emergency response vehicles usingj-Turns. Commissioner DeBone asked what type of scenario is involved for considering traffic flow during an emergency. Mr. Russell will raise the Board's concerns with ODOT. Motion Carried 10.PUBLIC HEARING: Consideration of Board Signature of Order No. 2020- 011, Surrendering Jurisdiction of Various Roads to the City of Bend, Oregon County Engineer Cody Smith (via Zoom conference call) explained the BOCC MEETING AUGUST 19, 2020 PAGE 3 OF 9 process to surrender jurisdiction. Maps of the county roads within the urban growth boundary of the City of Bend to be annexed are attached to the record. Commissioner Adair opened the public hearing. Mr. Smith reported on the roads involved in this item. Hearing no public testimony, Commissioner Adair closed the hearing. Commissioner DeBone supports moving forward. Road department staff have reviewed the road annex process with the City of Bend staff. Motion Carried 11.PUBLIC HEARING: Consideration of Order No. 2020-015, Approving Annexation into Crooked River Ranch Special Road District Count Counsel Dave Doyle (via Zoom conference call) presented the staff report for the hearing. Commissioner Adair opened the public hearing. Road Department Director Chris Doty (via Zoom conference call) reviewed the annexation process for the special road district. John Stevens, resident, presented testimony and expressed his dissatisfaction of the process for public input, conflicts of interest on the road district board, and explained why a lawsuit was filed against the special road district. Garrett Chrostek, attorney representing the road district (via Zoom conference call) presented testimony in support of the annexation. Hearing no further testimony, Commissioner Adair closed the public hearing. Motion Carried 12.COVID19 Update Public Health Director, Nahad Sadr-Azodi, Dr. Richard Fawcett, and Dr. George Conway (via Zoom conference call) provided the update. Presentation attached for the record. Mr. Sadr-Azodi praised the community for their efforts of choices and protection from the spread of COVID19. Dr. Fawcett reported on hospitalization cases as well as school age metrics. Mr. Sadr-Azodi commented on the importance of up to date vaccines for our children. The Board expressed importance of education on vaccines and reminded the community to talk with their health care providers. Dr. Conway provided an update on the status of long-term health care facilities and stated there have not been any new infections. RECESS: At the time of 11:36 a.m., the Board took a recess and reconvened the meeting at 1:00 p.m. Commissioner Adair announced the evacuation notice posted due to the Green Ridge fire. Commissioner Adair noted the change of the remainder of the agenda to switch the remaining items in consideration of staff availability. 13.Statewide Transportation Improvement Fund Update Whitney Hale, Communications Director introduced the update on project BOCC MEETING AUGUST 19, 2020 PAGE 5 OF 9 status. Andrea Breault, Interim Transportation Director for Cascades East Transit (via Zoom conference call) reported on the projects and STIF allocation estimates. Ms. Breault reviewed the project categories including service enhancements, technology, and program administration/safety. The estimated time of delivery of the new fleet is February/March 2021. Ms. Breault reported increased security has been implemented at the bus stop at the Hawthorne station and has decreased crime related incidents at the station. Ms. Breault reported on the impacts to transportation services due to COVID19. Fares have not been charged during the pandemic due to the need to eliminate cash transactions and there is a decrease in ridership. Ms. Breault reported the master plan is in final stages to serve for the next STIF cycle. This item will be brought to the Board later this year to review the next project cycle. 14. FY 2020 Quarter 4 Performance Measure Update Communications Director Whitney Hale introduced the item for review by departments. Holly Harris, Behavioral Health Services and Dan Hopper (via Zoom conference call) presented an update on the stabilization center and services provided. Ms. Hale reported there is a virtual tour of the facility available through the Deschutes County website. Mr. Hopper reported the project was completed under budget and able to be timely completed even with the setbacks of the COVID19 pandemic. Deevy Holcomb and Trevor Stephens, Community justice (via Zoom conference call) presented an update on the goal of safe communities through their criminal justice treatment center. Ms. Hale presented the update on behalf of the Clerk's Office and noted County Clerk Blankenship would provide an overview of the response to COVID19 for the upcoming primary election. Ms. Hale presented the update on behalf of the Sheriff's Office relative to patrol contacts. B©CC MEETING AUGUST 19, 2020 PAGE 6 OF 9 COMMISSIONER UPDATES: • Commissioner DeBone reported next week is the Blues Intergovernmental Council meeting and the EDCO Made in Bend Tour is also next week. • Commissioner Henderson reported on an emergency meeting with Deschutes Collaborative Forest Project this morning and the discussion on the Forest Service comment period on the Forest Management Direction for Large Diameter Trees in Eastern Oregon. Commissioner Henderson reported he received materials requesting support for the reopening of local schools. Commissioner Henderson spoke on increasing testing capacity and the Board discussed the cost of the testing. Commissioner DeBone supports providing resources for the community and stressed the fact there are a variety of testing options. Commissioner Henderson is supportive of moving forward with a contract for testing services. • Commissioner Adair explained she had a meeting regarding a BLM access road that is existing in McKenzie Canyon to allow for another exit in case of fire emergencies. OTHER ITEMS: CARES Act Funding: A continued discussion was held regarding options for CRF funding opportunities. Commissioner Adair reported on additional options through FEMA for reimbursement opportunities. County Administrator Tom Anderson and Chief Financial Officer Greg Munn (via Zoom conference call) presented an updated option sheet including COVID Direct Response, Housing and Basic Needs, Economic Assistance, and Other items. The Board made recommendations for acceptable funding for the listed items. A revised list of possible items for reimbursement under the CARES Act based on response to the impacts of COVID19 will be QOCC MEETING AUGUST 19, 2020 PAGE 7 OF 9 presented for consideration of next steps. Continued from Monday's BOCC meeting's discussion. County Counsel Dave Doyle presented the revised Order for the Board's consideration. The Board made recommendations for further revisions. At the time of 4:00 p.m., the Board came out of Executive Session to direct staff to proceed as discussed. BACKGROUND AND POLICY IMPLICATIONS: Pursuant to the Revised Joint Management Agreement Regarding the Area Within the Bend Urban Growth Boundary ("JMA") (Document No. 2017-423), county roads within the urban growth boundary of the Clty of Bend are to be annexed contiguously and jurisdiction of those roads is to be transferred to the City upon annexation. Since 2007, the City has executed at least eight annexations that included or impacted a total of portions of the following county roads (4.32 miles total): • NE 18t" Street • Yeoman Road • Cole Road • Deschutes Market Road • Butler Market Road • NE Purcell Boulevard • Skyliners Road • O.B. Riley Road • Cooley Road Pursuant to the JMA, jurisdictional transfer of said roads to the City is required. The jurisdictional transfer shall be administered according to ORS 373.270. In accordance with ORS 373.270 and Resolution No. 2020-013, a Public Hearing is being held on August 19, 2020 for interested parties to offer testimony regarding the jurisdictional transfer. Upon closing the public hearing, the Board will consider Order No. 2020-011, which will surrender jurisdiction of said roads to the City of Bend. FISCAL IMPLICATIONS: Upon adoption of appropriate legislation by the Bend City Council, said roads will become city roads and Deschutes County will no longer operate, maintain, or hold jurisdiction over said roads. BACKGROUND AND POLICY IMPLICATIONS: Crooked River Ranch Special Road District passed a resolution to initiate annexation of NW Quail Road into the District. The U.S. Bureau of Land Management, manager of the underlying public land, has no issue with the annexation. The Community Development Department has determined this annexation is consistent with the County's Comprehensive Plan. The Board approved Order 2020-046 setting the public hearing on this annexation and notice was duly provided pursuant to ORS 198. Approving Order 2020-015 will approve the annexation of the area described in the resolution into the District. Because there is not a transit district in Deschutes County, local Public Transportation Service Providers apply for STIF funds through the County. Staff from Cascade East Transit (CET) will provide an update on implementation of 2019-21 Deschutes County STIF projects. The attached matrix outlines STIF project status and next steps. CET Staff will also provide an update on the Oregon Department of Transportation (ODOT)'s updated STIF allocation estimates (attached), which were updated in response to concerns about COVID-19 impacts. Deschutes County's estimated forecast for FY 2020 STIF funds is $35,320 more than what ODOT originally projected in December 2019. The updated forecast for FY 2021 reflects an anticipated decrease of $535,434 in STIF funding. Staff will discuss the anticipated decrease in funding and any potential impact on STIF projects. This update is outside of the normal annual revenue forecast schedule, and is shared in response to concerns about the impact of COVID-19 on the economy. We will continue to update forecasts as we receive revised economic data. At the time of this forecast, many different pandemic - related mitigation efforts have been made, such as Governor Brown's Stay Home, Save Lives order which can be found at this link: Stay Home, Save Lives, a mandate to wear face coverings which can be found at this link: Statewide Mask Face Shield, Face Covering Guidance, and delayed or phased timing for counties entering preliminary reopening phases. Additionally, a number of other factors contribute to tax collection impacts such as company policies on working from home and vacation time payouts versus layoffs. July's forecasted revenue is still 2.93 percent higher than the December 2018 revenue estimate used to build the 19-21 STIF Formula Plans. As more economic data become available, this estimate is likely to be adjusted. Estimate Assumptions The majority of the FY 19-21 STIF Formula distributions have already been disbursed by ODOT. As a reminder, ODOT can distribute only the tax revenue it receives, which may be more or less than this estimate, up to each individual Qualified Entity's (QE) approved STIF Plan funding limit for STIF Formula. Distributions typically represent tax collections from two quarters prior; for example, the July distribution (FY 21 Q1) is largely comprised of taxes collected from January through March (FY 20 Q3). Updated estimates for the Formula, Discretionary, and Intercommunity Discretionary funds for FY 19-21 and updated forecasts for FY 22-23 are summarized in the table below.
