Harper Bridge: Continued Discussion Chris Doty, Road Department Director presented an update on the work done at Harper Bridge to improve safety measures. Mr. Doty reviewed options for additional improvements/changes to the area. Commissioner DeBone offered to meet with the Sunriver Owners Association and Crosswater Home Owners Association, and Deschutes River Recreation Homesite Association to discuss options. The Board supported a further discussion on the sun -setting ordinance relative to bridge jumping. County Administrator recommended scheduling a joint meeting with the Sunriver organizations to review options. The Board expressed support. BOCC MEETING OCTOBER 14, 2020 PAGE 2 OF 6 9. Consideration of Grant Application - Basins to Buttes All Lands Project County Forester Ed Keith (via Zoom conference call) presented the grant opportunity in partnership with the joint Chiefs program to work on all lands issues to address fuel reduction and increase fire resiliency. The global funding package is approximately $13 million with funding for Deschutes County designated at $140,000. The majority of the award goes to Forest Service lands based on land ownership. The grant award is for a period of three years however, Mr. Keith requested the full funding for Deschutes County in the first year. Discussion held on prescribed burns. Motion Carried 10.Deschutes County Stabilization Center update Holly Harris, Health Services presented an update of activity and service provided at the stabilization center. Handout presented and attached to the record. Ms. Harris will present the next update in January. Ms. Harris will also provide estimates for the cost of a mental health call for law enforcement, emergency department, and health staff. 11.Preparation for Public Hearing: Request of Waiver of the DCC 22.32.024 - Transcript Requirements and Consideration of Order No. 2020-058 to Hear an Appeal of Hearings Officer Decision Community Development Department Planner Kyle Collins (via Zoom conference call) presented the background on the public hearing that is scheduled for the BOCC meeting of November 9, 2020. Mr. Collins explained a Board Order is required in order to waive transcript requirements. RECESS: At the time of 12:09 p.m., the Board went into recess and reconvened the meeting at 1:01 p.m. 13.CARES Act Funding Update Chief Financial Officer Greg Munn (via Zoom conference call) presented the update on the CARES Act funding allocations. Mr. Munn reported on additional funding requests that are being held in pending status. Commissioner DeBone commented on the Association of Oregon Counties ask if there were any disconnects for funding through the end of the year and if Deschutes County needs additional resources. 14.Consideration of Board Acceptance of 2020 TGM Grant Award for 1) Tumalo Community Plan Update and 2) Implement Rural Trails of Sisters County Vision Act Plan Senior Transportation Planner Peter Russell (via Zoom conference call) presented information on the grant awarded in the amount of $75,000 and asked the Board for consideration of acceptance. Mr. Russell explained the work that will be completed by use of the funding. There were 13 applications received. Applications were reviewed and the Board expressed various levels of support of the applications. The Board had questions requesting clarification from several applicants. 16.Consideration of Appointments for the Facility Project Review Committee Deputy County Administrator Erik Kropp presented the list of applicants. Commissioner DeBone participated in the interviews and the selection process. There were seven candidates presented to the Board for consideration of appointment. The Board supported the recommendations. Letters of appointment will be sent to the candidates. The attached memo identifies various options for Board discussion and consideration. FISCAL IMPLICATIONS: Cost estimates have yet to be prepared for the noted options. ATTENDANCE: Chris Doty, Road Department, Tom Anderson, County Administrator CO G� MEMORANDUM Date: October 5, 2020 To: Board of County Commissioners From: Tom Anderson, County Administrator; Chris Doty Road Department Director RE: Harper Bridge 2020 Recap and Future Considerations The purpose of this memorandum is to recap issues related to Harper Bridge in Sunriver during the 2020 season and discuss potential options for future consideration. Background: The use of Harper Bridge as a river access point has been growing exponentially within the past decade as the popularity of recreational floating has increased on various stretches of the Deschutes River. Options for improvement have been reviewed and studied over the years — most recently in 20181. Parking improvements (50 spaces with buffered bike lanes) constructed in 2019 were well received, and by most accounts, the summer of 2019 was successful with regard to conflict reduction and added safety. In the summer of 2020, many recreational activities were impacted by COVID-19 restrictions, however "floating the river" was not. By observation, this led to another significant increase in use at Harper Bridge. Concerns were communicated to the Board from the Crosswater Homeowners Association and individual property owners within the Crosswater and DRRH Subdivisions. These comments ranged from concerns related to user safety, to residential street parking overflow, to impacts to their private property from users. Upon receipt of the concerns and a discussion with the Board, the following actions were immediately implemented: 1. Emergency speed reduction for Spring River Road (from 35 mph to 25 mph). 2. An ordinance prohibiting jumping from Harper Bridge was passed by the Board. 3. Enforcement of illegal parking and other illegal activities was increased by the Sheriff's Office. The Board directed staff to return at the conclusion of the 2020 river use season to further discuss the future of Harper Bridge and river access in the Sunriver area. Primary Issues of Concern: The primary safety concerns related to river access at Harper Bridge continue to include safety concerns associated with pedestrians haphazardly crossing Spring River Road as well as the general proximity to pedestrians adjacent to higher 1 https://www.deschutes.org/bcc/page/harper-bridge 61 150 SE 27th Street Bend, Oregon 97702 (5 41 ) 388-6581 road@deschutes.org www.deschutes.org speed traffic on Spring River Road. Secondary concerns include issues associated with trespassing on private property, illegal parking (including blocking emergency fire access), overflow parking, litter and bridge jumping. Alternative Site Discussion other than Harper Bridge. The 2018 Harper Bridge Study concluded that few, if any, alternative access points exist to replace the level of access provided at Harper Bridge. • Alternative private development sites have significant land use hurdles (wetlands, etc). o The Brynwood site (wetlands) and the DRRH site are candidate sites but with significant development issues and complicating factors. • Alternative federal land sites have significant regulatory issues (Wild/Scenic River designation, etc) and funding challenges. o Besson Day Use and Cardinal Bridge are two locations that could be considered; however many hurdles exist to their potential development. o Note: New leadership at the Deschutes National Forest may provide for a fresh set of eyes on the issues and restrictions within the corridor; however it is unlikely that development or improvement of any federal site could be considered in the near -term. Existing Site Improvement at Harper Bridge: The parking improvements constructed in 2019 were constructed within the existing right-of-way of Spring River Road. Both Crosswater and the Sunriver Owners Association were not amenable to working with the County to acquire right- of-way given the complexities of purchasing common area and/or the general disapproval of public access at Harper Bridge. As stated throughout the process, the goal of the buffered and painted bike lanes was to improve safety within the existing constraints— not ensure safety. Improvement options to specifically eliminate pedestrians crossing Spring River Road Option 1: Elimination of parking and river access on one side of Spring River: The elimination of parking and river access on one side of Spring River Road will most likely need to occur on the north side given the established river access and boat launch that exists at the southeast corner of the bridge. Option 2: Construction of a median/barricade in the center of Spring River Road: Installation of a median barricade down the middle of Spring River Road will require widening Spring River Road by approximately 3-feet on each side to shift traffic away from the centerline obstruction. Typical barricade, such as a Jersey barrier, will be of insufficient height to fully restrict crossings unless a fence is attached. While restricting pedestrian crossing movements, the barricade would also channelize traffic and potentially move traffic in some circumstances closer to the pedestrians by removing the ability to cross the center line when opposing traffic is not present. Staff does not recommend consideration of this option. Improvement options to improve general pedestrian safety., Option 3: Construction of paved paths separated from the roadway: The County could purchase or lease additional right-of-way to install a wide (8 to 10 feet) paved path on each side of the road to attract and accommodate pedestrian movement from parked cars to the river and vice versa. A widened crosswalk with a rapid -flash beacon pedestrian crossing could also be installed near the bridge to accommodate pedestrian crossings with the channelization of 61 150 SF_ 27th Street Fiend, Oregon 97702 (541) 388-6581 road@deschutes.org www.deschutes.org pedestrians provided by the paths. An additional 20 to 30-feet of right-of-way would need to be acquired on each side. ADA accessibility requirements for parking, loading zones, street crossing, and pedestrian access routes will need to be addressed if paved paths are implemented. s As experienced with prior attempts to work with Crosswater and SROA, the acquisition of right-of- /4;� way is complicated by issues related to acquisition of common area which may need to be approved by the membership, as well as a general lack of support from these associations for improvements at Harper Bridge. However, given the degree of concern expressed by Crosswater and SROA for the safety of users, perhaps amicable acquisition via purchase of a pedestrian access easement would be considered by their board leadership. Aside from a change of heart, pursuit of this concept or any concept which would require right-of-way acquisition would most likely require the application of eminent domain (condemnation of property) by the Board. Option 4: Construction of a parking lot in the common area of Crosswater or SROA: The original proposal for improvements at Harper Bridge consisted of construction of parking lots with in the common areas of each adjacent development. These concepts were widely dismissed by both entities and it was clear that property could SROA parking and hand launch concept on north side of Spring River Road, 2011 Schematic parking lot concept on south side of Spring River Road not be amicably purchased or leased at that time. Construction of a parking lot on one side of Spring River Road, coupled with closure of parking and river access on the other side of the road, would provide safe access for river users and address the primary issues of concern (pedestrian safety and pedestrian crossing). Given the existing historic boat launch on the south side, the parking lot would most likely need to be considered on the south side of Spring River Road (Crosswater side). Option 5: Loading Zones Only (with and without shuttle service): In this concept parking would be removed and access would occur via the existing loading zones on one or both sides of Spring River Road. As proposed in Option 3, widened crosswalk with a rapid -flash beacon pedestrian crossing could also be installed near the bridge to accommodate pedestrian crossings. Shuttle service could potentially be provided with access to a nearby parking area, most likely the grade school (85 spaces). A loading zone without shuttle service will likely exacerbate parking impacts on surrounding neighborhoods. This option was included in the 2018 study and not selected by the Board for consideration. Option 6: Removing all parking and closing river access at the bridge: Removing or further limiting parking is fully within the authority of the County. Doing so would likely reduce river access demands at this location by a significant amount. However, it is not clear whether the County has legal authority to fully close river access from the public right- of-way. Rivers within Oregon are considered waters of the state and the general rule is that the public has unconditional right of access. Again, according to Legal, while the County is not obligated to encourage or assist with access, taking affirmative steps to bar access presents considerable legal risk. 61 150 SF_ 27th Street Bend, Oregon 97702 (541) 3 8 8 - 6 5 8 1 road@deschutes.org www.deschutes.org Low Cost Modifications Option 7: Status quo with recent modifications: The existing improvements constructed in 2019, coupled with recent modifications such as an emergency speed reduction to 25 mph and improved signage (and legislation) related to bridge jumping prohibition could remain. Additional signage and use of sign technology (variable message signage, etc) could bring further awareness to the necessity for traffic and users to maintain appropriate situational awareness during periods of seasonal use. Continued focused enforcement by the Sheriffs Office would also be a critical aspect of this option. Possible Next Steps A. Identify a preferred option. B. Bring back for further discussion with identified additional information. C. Schedule meetings with stakeholder homeowner groups — Crosswater, SROA, DRRH, etc. D. In the past a project in the Greater La Pine Basin was funded through this program. The two agencies are proposing a new project that generally stretches from Bend to Camp Sherman across all lands. Deschutes County has the opportunity to be a project partner and offer funding for defensible space fuel reduction. DCSC serves children and adults who are in need of short-term, mental health crisis assessment and stabilization but do not require the medical capabilities of an acute care hospital or longer -term residential care. The DCSC welcomes individuals to walk in when they are experiencing a mental health crisis, or they can be referred by local law enforcement and other community partners. The grant is to 1) update the Tumalo Community Plan and 2) implement the Sisters Country Vision Action plan regarding rural trails for bikes, pedestrians, and equestrians. The rural trails would involve amending the Deschutes County Transportation System Plan (TSP). The Board on June 29, 2020, approved staff applying for the TGM grant. The grant will fund public outreach, review of the current Tumalo Community Plan and the County TSP, and assessment of the Level of Traffic Stress (LTS) for cyclists and pedestrians in both Tumalo and potential rural connectors to Sisters. There will also be citizens advisory committees formed and coordination with the County's Bicycle and Pedestrian Advisory Committee (BPAC) as well as the US Forest Service (USFS) and the Sisters Transportation Alliance (STA). On June 22, 2020, staff provided the Board with a summary of the purpose of the grant and expected outcomes. The Board approved staff applying for the grant at its June 29, 2020 meeting. The Department of Land Conservation and Development (DLCD) sent an award letter on September 24, 2020, announcing the award and detailing various timelines required for the grant. The first step is completing the Grant Acceptance Form and returning it to the agency by October 30, 2020. At this time, staff seeks a general consensus from the Board so staff can inform DLCD the County will accept the $75,000 TGM grant.
