Also present were Tom Anderson, County Administrator; David Doyle, County Counsel (via Zoom conference call); and Sharon Keith, Board Executive Assistant (via Zoom conference call). Attendance was limited due to Governor's Virus Orders. This meeting was audio and video recorded and can be accessed at the Deschutes County Meeting Portal website http://deschutescountyor.igm2.com/Citizens/Default.aspx CALL TO ORDER: Chair Adair called the meeting to order at 10:00 a.m. PLEDGE OF ALLEGIANCE: CITIZEN INPUT: Commissioner Henderson commented on some of the comments he has heard regarding Deschutes County's handling of COVID. Commissioner Henderson stated that he is supportive of the work and efforts of the health department, health care providers, and the community. Commissioner DeBone spoke on the collective efforts of the community and all that they are doing to prevent the spread of COVID. Commissioner Adair commented on the excellent medical providers that are keeping our community aware and protected and encouraged the public to make use of the resources posted on our website. Motion Carried RECONVENE AS THE GOVERNING BODY OF DESCHUTES COUNTY 11.Consideration of Document No. 2020-180, a License Agreement with Tumalo Property Owners Association to Use Right -of -Way for Wastewater Collection. County Engineer Cody Smith and Assistant Legal Counsel Adam Smith (via Zoom conference call), Community Development Department Director Nick Lelack, Environmental Soils Supervisor Todd Cleveland presented the item for consideration. Discussion held on the possible need for public information & outreach for area property owners. Commissioner DeBone suggested sending the license agreement to the applicant to review, having a discussion with the Department of Environmental Quality, and then have a community discussion. Recommended revisions were made for the license BOCC MEETING OCTOBER 28, 2020 PAGE 3 OF 7 agreement. Commissioner Henderson spoke to the performance bond. Cody Smith will require the applicant to provide an engineer's estimate as well. The Board is supportive of requiring a performance bond. Risk Manager Erik Kropp explained the requirements for liability insurance; Assistant Legal Counsel Adam Smith and County Counsel Dave Doyle explained associated tort issues. Staff will proceed as discussed/directed by the Board. Subsequent public outreach and information will be addressed. The license agreement and will be brought back to the Board at a future meeting. 12.Consideration of Board Approval of Reclassification of Health Services Position Health Services staff via Zoom conference call were Jessica Jacks, Tom Kuhn, and Cheryl Smallman to present this item for consideration. The current suicide presentation coordinator has resigned and this position has been considered for additional roles within the department. County Administrator Anderson commented on the position reclassification and asked the Board to consider whether a lead position is required. The Board recommended this item brought back with clarity on staffing and budget requirements. Commissioner DeBone excused himself for another meeting at 11:43 a.m. County Administrator Anderson recommended having Human Resources provide the structure of staffing report for the department and will work with Ms. Jacks regarding the creation of the information. 13.Consideration of Board Signature of Order No. 2020-055 Naming a Private Road as Verheyden Ranch Drive Senior Transportation Planner Peter Russell (via Zoom conference call) presented the item for consideration. The property owners were notified and no opposition was received. Motion Carried LUNCH RECESS: At the time of 11:50 a.m., the Board went into recess and reconvened the meeting at 1:00 p.m. Commissioner DeBone was present at this time. 14.COVID19 Update Present via Zoom conference call were Health Services staff Dr. George Conway, Nahad Sadr-Azodi and Morgan Emerson reported on the COVID19 update. Presentations are attached to the record. 15.CARES Act Funding Update Chief Financial Officer Greg Munn (via Zoom conference call) presented the weekly CARES fund update. Katy Brooks of the Bend Chamber (via Zoom conference call) reported on $50,000 funding allocated by the Board for the micro center child care program. Due to rising COVID cases, providers are finding it difficult to find staffing; employee -parents are hesitant to bring their children to child care in light of increased virus counts. Ms. Brooks is requesting to transfer the allocated funding to the Bend Resiliency program instead. County Administrator Anderson will contact the City. • Commissioner Henderson read into the record his proposed revisions to the draft Whistleblower Policy. The Board indicated agreement with the revisions. County Administrator Anderson will make the revisions and present it to the Board at a future meeting for approval. • Commissioner Henderson presented the draft Deschutes Basin Water Collaborative Charter for review and consideration. Deschutes County is being requested to have a representative on the collaborative. County Administrator Anderson will contact them for next steps of a formal document. BACKGROUND AND POLICY IMPLICATIONS: During their October 19, 2020 meeting, the Board of County Commissioners considered a license agreement with the Tumalo Property Owners Association ("Association") for the construction of a wastewater collection system within public rights -of -way throughout the Tumalo Unincorporated Community. During the meeting, County staff and a representative of the Association made presentations to the Board regarding the draft agreement and, specifically, the following disputed provisions of the draft agreement: Item 7AA: Performance Bond: The Road Department has requested a Performance Bond such that the work that is authorized within the right-of-way is completed as proposed and that the County is not left with any expense associated with the repair or restoration of the right-of- way should things not go as planned. The Association is opposed to this provision. Item 7C: Right-of-way permit requirement: The Association requests that the County issues permits within five (5) business days. The Road Department has asserted that this proposed provision would impact the review and approval of other right of way permit applications, in essence allowing the Association to perpetually jump to the front of the line in the right of way activity permit queue. As such, the Road Department is opposed to this provision. Item 9B: Insurance: County Risk Management has requested commercial general liability insurance in the amount of $2M per occurrence and $4M in general aggregate. The Association requests amounts of $1 M per occurrence and $2M in general aggregate. Item 11: Performance Bond Release: Per request associated with Item 7A.4, the Association is opposed to this provision. Item 15 B: Termination: Per DCC 12.40.40 and general legal definition, a License Agreement is revocable by the County. A non -revocable license equates to an easement and the County does not have easement authority for public right-of-way. The Association is opposed to this provision. The Road Department is now presenting the license agreement in a form recommended by Road Department and Legal Counsel staff to the Board of County Commissioners for further consideration. If the agreement as presented is approved by the Board, the agreement will be sent to the Association for signatures, then returned to the Board for signatures administratively. FISCAL IMPLICATIONS: None ATTENDANCE: Cody Smith, County Engineer REVIEWED LEGAL COUNSEL REVOCABLE LICENSE (TO USE RIGHT OF WAY) For Recording Stamp Only DESCHUTES COUNTY, a political subdivision of the State of Oregon ("Licensor") hereby grants to TUMALO PROPERTY OWNERS ASSOCIATION, an Oregon nonprofit corporation ("Licensee"), a non- exclusive Revocable License (License) to use public right of way, as shown in Exhibit "A," attached hereto and by this reference incorporated herein and together referred to as the "Right of Way," for the purpose of installation, operation, maintenance, and repair of the Laidlaw Sanitary Sewer wastewater collection system, referred to herein as the "Underground Facilities". RECITALS Pursuant to ORS 368.036, ORS 374.305, ORS 374.309, and ORS 374.315 and Deschutes County Code Title 12, Chapters 4, 12, 16, and 24, Licensor has authority to permit construction and uses within public right of ways under the jurisdiction and control of Licensor. 2. The Right of Way shown in the attached Exhibit "A" is comprised of public right of ways under the jurisdiction and control of Licensor. NOW THEREFORE, this nonexclusive, revocable license is granted upon the following terms and conditions: Term. The term of this License shall commence upon signature of all parties and continue until terminated or abandoned as provided herein. 2. Possession. Licensee's right to utilize the Right of Way and obligations contained herein shall commence as of the date of this License. Pursuant to the terms and limitations of this license, Licensee shall have use of the Right of Way described in Exhibit "A" for the purposes set forth herein. 3. Condition of Right of Way. Licensor represents that it has full right, power, and authority to enter into this License for the term herein granted and that the licensed Right of Way may be used by the Licensee during the entire term for the purposes herein set forth. If it is determined that Licensor did not have the right, power or authority to enter into this License because of Licensor's failure to have properly acquired jurisdiction over, or the Right of Way is under lease or license to another and Licensee has not acquired the leasehold interest of such other person(s), firm, or corporation, this License shall automatically terminate. In the event of termination under the circumstances set forth in this paragraph, Licensee shall waive any and all claims or causes of action against Licensor. Page 1 of 8 — License to Use Right of Way — Document No. 2020-180 4. Consideration. The Right of Way herein licensed is held by Licensor for the purpose of public interest. The consideration for said license is other than payment. 5. Additional License Fees. As additional license fees, Licensee shall pay the following amounts: A. All amounts which Licensee is required to reimburse Licensor for expenses incurred by Licensor in discharging Licensee's obligations. B. All other amounts, which the Licensee is required to pay by any other provisions of this License. 6. Permitted Use. The Licensee may utilize the licensed Right of Way described in Exhibit "A" attached hereto and by this reference incorporated herein, for the purpose of installation, operation, maintenance, and repair of a municipal wastewater collection system in accordance with the laws of the State of Oregon, Deschutes County Code (DCC) and all applicable regulatory requirements. 7. Restrictions on Use. In connection with the use of the Right of Way, Licensee shall: A. Prior to construction of the Underground Facilities: 1. Subscribe to the Oregon Utility Notification Center as an Operator, as defined in ORS 757.542(5). 2. Obtain plan approval from the Deschutes County Road Department. Plans shall be prepared in accordance with applicable sections of DCC 12.20 and 17.48. 3. Obtain a right of way activity permit from the Deschutes County Road Department. 4. Furnish to the Deschutes County Road Department a performance surety instrument executed by a surety company authorized to transact business in the State of Oregon in a form approved by Deschutes County Legal Department in an amount equal to 120% percent of the estimated cost for construction of the Underground Facilities, less the cost of pipe, fittings, and valves. The estimated cost of construction of the Underground Facilities shall be provided by the Licensee to the Road Department and shall be subject to approval by the Road Department. B. Submit to the Deschutes County Road Department as -built drawings for the Underground Facilities. C. Obtain a right of way activity permit from the Deschutes County Road Department for every occurrence of traffic control, excavation, repair, or other work associated with the Underground Facilities within the Right of Way. D. Contact the Oregon Utility Notification Center to obtain utility locates for every occurrence of excavation within the Right of Way. E. Obtain all necessary legal and regulatory approvals or permits prior to any uses of the Right of Way. F. Maintain the Right of Way to standards of repair, orderliness, neatness, sanitation and safety acceptable to Licensor. G. Conform to all applicable laws and regulations of any public authority affecting the Right of Way and Underground Facilities and the use after the date of this License, and correct at Licensee's own expense any failure of compliance created through Licensee's fault or by reason of Licensee's use if such failure of compliance arises as a result of conditions occurring after the date of this License. H. Refrain from any use which would be reasonably offensive to the Licensor, or owners or users of adjoining real property, or which would tend to create a nuisance or damage the Right of Way. I. Refrain from making any unlawful or offensive use of said Right of Way or to suffer or Page 2 of 8 — License to Use Right of Way — Document No. 2020-180 permit any waste or strip thereof. Exercise diligence in protecting from damage the Right of Way covered by and used in connection with this License. 8. Licensee's Obligations. The following shall be the responsibility of the Licensee: A. Any repairs necessitated by the negligence of Licensee, its agents, employees and invitees to the licensed Right of Way. B. Any repairs or alterations required under Licensee's obligation to comply with laws and regulations as set forth in "Restrictions on Use" above. C. Right of Way at end of License period shall be in as good condition as it was in at the beginning of the term, reasonable wear and tear excepted. D. Pay Licensor for any damage resulting from Licensee's negligence or from the violation of the terms of this License. E. Upon order by Licensor, remove or relocate any portion of Underground Facilities within Right of Way when Licensor deems it expedient. F. In the event, Licensor is required to perform any work required of Licensee under this License, or perform work to restore its right-of-way to its original condition following any work by Licensee, Licensee shall be required to reimburse Licensor for the cost of any such work within 30 days of Licensor providing documents establishing the scope of work performed and the cost associated with that work. 9. Insurance A. It is expressly understood that Licensor shall not be responsible for carrying insurance on any property owned by Licensee. B. Licensee shall carry commercial general liability insurance, on an occurrence basis with a combined single limit of not less than $2,000,000 per occurrence and $4,000,000 in general aggregate. Licensee shall provide Licensor with a certificate of insurance, as well as an endorsement, naming Deschutes County, its officers, agents, employees and volunteers as an additional insured. There shall be no cancellation, termination, material change, or reduction of limits of the insurance coverage during the term of this License. 10. Inspection of Right of Way. Licensor shall have the right to inspect the Right of Way at any reasonable time without need for formal notice. 11. Approval of Work and Release of Performance Bond. At such time when Licensee completes the installation of the Underground Facilities and any other work subject to the performance bond described in Section 7.A.4 above, Licensee shall notify the County of the completion of the work. The County shall have ten (10) business days after receiving Licensee's notice to complete any and all inspections it deems required. After completing the inspection and within the ten (10) business day period, the County shall either issue a punch list, or the County shall approve the work covered under the performance bond and issue documentation sufficient to release the performance bond. If a punch list was issued by the County, Licensee shall notify the County of completion of the punch list items, and the inspection process shall proceed as stated above. 12. Liens. A. Except with respect to activities for which the Licensor is responsible, the Licensee shall pay as due all claims for work done on and for services rendered or material furnished to the licensed Right of Way and shall keep the Right of Way free from any liens. If Licensee fails to pay any such claims or to discharge any lien, Licensor may do so and Page 3 of 8 — License to Use Right of Way — Document No. 2020-180 collect the cost as additional license fees. Any amount so added shall bear interest at the rate of nine percent (9%) per annum from the date expended by Licensor and shall be payable on demand. Such action by Licensor shall not constitute a waiver of any right or remedy, which Licensor may have on account of Licensee's default. B. Licensee may withhold payment of any claim in connection with a good faith dispute over the obligation to pay, so long as Licensor's Right of Way interests are not jeopardized. If a lien is filed as a result of nonpayment, Licensee shall, within thirty (30) days after knowledge of the filing, secure the discharge of the lien or deposit with Licensor cash or a sufficient corporate surety bond or other surety satisfactory to Licensor in an amount sufficient to discharge the lien plus any costs, attorney fees and other charges that could accrue as a result of a foreclosure or sale under a lien. 13. Continuing Obligation. Said License shall be an ongoing, continuous and binding obligation and privilege for Licensee. The protections, rights and authority reserved to the Licensor herein shall inure to the benefit of any successor governmental authority. 14. Default. The following shall be events of default: A. Abandonment of the licensed Right of Way or the cessation of use of the Right of Way described in Exhibits "A". B. Upon sale or abandonment of the personal property owned and occupied by the Licensee, C. Failure of Licensee to pay any license fees or other charge within thirty (30) days after it is due and written notice is given by Licensor to Licensee. D. Failure of Licensee to comply with any term or condition or fulfill any obligation of the License within thirty (30) days after written notice by Licensor specifying the nature of the default with reasonable particularity. If the default is in such a nature that it cannot be completely remedied within the thirty (30) day period, this provision shall be complied with if Licensee begins correction of the default within the thirty (30) day period and thereafter proceeds with reasonable diligence and in good faith to effect the remedy as soon as practicable. 15. Termination. Said License shall terminate: A. By mutual agreement of the parties; B. Upon 30 days' written notice by Licensor; C. Immediately upon written notice by Licensor identifying existing public health and safety issue(s) associated with the Underground Facilities; D. Upon Licensee's written notice to Licensor to include mutually agreed upon schedule for removal and/or secure capping of Underground Facilities; E. Upon default which is not cured in accordance with the paragraph above entitled "Default"; F. Automatically upon vacation of the Right of Way. 16. Remedies on Default. A. In the event of a default, the License may be terminated at the option of the Licensor by notice in writing to Licensee. Except in the instance of an existing public health and safety issue(s) associated with the Underground Facilities, the notice may be given at any time after the thirty (30) days grace period for default given under the paragraph entitled "Default." If the Right of Way is abandoned by Licensee in connection with a default, termination shall be automatic and without notice. B. In any of the above set out cases or events, the Licensor, or those having the Licensor's estate in the Right of Way, lawfully at its option may enter into and upon said Right of Page 4 of 8 — License to Use Right of Way — Document No. 2020-180 Way and every part thereof, and repossess the same of Licensor's former estate, and expel said Licensee and those claiming by and through or under Licensee, and remove Licensee's effects at Licensee's expense, forcibly if necessary, and store the same, without being deemed guilty of trespass and without prejudice to any remedy which otherwise might be used for arrears of license fees or preceding breach of covenant. C. The foregoing remedies shall be in addition to, and shall not exclude, any other remedy available to Licensor under applicable law and/or regulatory provisions. 17. Facilities, Structures, and Equipment. A. All equipment or other personal property associated with the Underground Facilities during the term by Licensee shall remain the property of Licensee except as otherwise provided herein. B. Upon abandonment, termination, revocation, or cancellation of this License, the Licensee shall remove, within a reasonable time, all equipment and other personal property associated with the Underground Facilities except those owned by Licensor. If Licensee fails to remove all or part of such personal property and equipment within thirty (30) days, and such additional time as is reasonable and necessary to effect such removal as may be agreed upon by the parties, then upon election of Licensor they shall become the property of Licensor. 18. Notices. Any notice by Licensee to Licensor or Licensor to Licensee must be served by certified or registered mail, postage prepaid, addressed to the other at the address given below or at such other address as either may designate by written notice. This License does not constitute a land use permit or regulatory authorization, nor does issuance of this License by Licensor constitute approval of any legal, regulatory, legislative or quasi-judicial action required as a condition precedent to use of the land for the intended purpose. 22. Licensor's Right to Cure Defaults. If the Licensee fails to perform any obligations under this License, the Licensor shall have the option to do so after thirty (30) days' written notice to the Licensee. All of the Licensor's expenditures to correct the default shall be reimbursed by the Licensee on demand with interest at the rate of nine percent (9%) per annum from the date of expenditures by the Licensor. 23. Licensee Not An Agent of Licensor. Litigation Fees and Expenses. Indemnification. There are three staff, two CHS's and one Supervisor at varying FTE levels. The suicide prevention program area is supported by three different funding streams, described below. In the 2019-2021 biennium, the funding stream was made into a Service Element (referred to as MHS 10) to more efficiently transfer resources between OHA and local government through an IGA. The State Service Element document shares the following as a description of these resources. Mental Health Promotion and Prevention Services are directed at changing common influences on the development of Individuals across their lifespan, reducing risk factors, and increasing protective factors, and is designed to target universal, selected, and indicated populations based on risk. MHS 10 Services are interventions that aim to enhance and Individual's abilities to achieve developmentally appropriate tasks (competence), a positive sense of self-esteem, mastery, well-being, social inclusion, and strengthen their ability to cope with adversity. Services shall be trauma informed and support eh expansion of Mental Health Promotion and Prevention by strengthening the determinants of mental health and wellness, including the development of health communities, individual skill development, improved social emotional competence, and decreasing risk factors associated with negative mental health outcomes, such as adverse childhood experiences. Local Use of Resources: Funding is used to support suicide prevention efforts, namely recommended curriculum in schools, community education and mental health promotion through the Mind Your Mind Central Oregon regional partnership and initiative. Funding also support personnel costs. Local Allocation: DCHS acts as the fiscal agent on behalf of the regional partners (BestCare Treatment Services -Prevention Program, Crook County Public Health and Deschutes County Health Services). Annual allocation, since 2013, to DCHS is $133,333. Each entity receives $44,444. OHA indicates that this will continue upon continued successful local outcomes and adherence to the Service Element priorities. Program Element 60 I Funding Source: OHA Public Health Division Description: Program Element (PE) 60 began as a competitive request for grant proposal in February 2020 in which DCHS was a successful awardee. Awardees will be funded through Fiscal Year 24 at which time OHA's Federal grant ends. This Federal resource is the Garrett Lee Smith Youth Suicide Prevention and Early Intervention Grant. The PE description requires that Suicide Prevention, Intervention and Postvention Program be grounded in evidence -based best practices. The coordinated movement involves state and local programs working together to achieve sustainable policy, systems and environmental change in local communities that mobilize statewide. Suicide is one of the leading causes of death in Oregon. Suicide is the second leading cause of death among Oregonians aged 10 to 34 years, and the Sth leading cause of death among all Oregonians in 2017. Especially among Youth, Contagion related to suicide death or attempt can occur and needs to be protected against. Funds provided under this PE are to be used to reduce suicide deaths, promote evidence -based practice in Youth suicide Prevention, Intervention and Postvention, and implement training to persons working with Youth or staff in Youth serving organizations. Funds allocated are to complement the statewide movement toward population -level outcomes including elimination of Youth suicide disparities. Local Use of Resources: Funds provided under this PE may only be used to deliver Suicide Prevention, Intervention and Postvention Program activities funding personnel costs and materials and services in order to maintain the following required components: (a) facilitation of community partnerships (e.g. Central Oregon Suicide Prevention Alliance); (b) targeted outreach, training and services (e.g. QPR, SafeTalk, RESPONSE); (c) coordination with Community Mental Health Program (CMHP) on implementation of system -wide crisis response plans; (d) collaboration on providing Suicide Safe Care and Continuity of Care among service area healthcare systems; (e) provide Gatekeeper Training and clinical training (e.g. ASIST and AMSR); and (f) collection and analysis of suicide related data for program planning and management (e.g. recent Deschutes County data report and ongoing postvention monitoring). Local Allocation: DCHS receives an allocation of $117,003 per year for four years through Fiscal Year 24. Fund 270 Behavioral Health I Funding Source: DCHS Behavioral Health Division Description: DCHS provides behavioral health services for Oregon Health Plan (OHP) members on an at -risk, capitated and fee -for -service basis. Revenues to cover operating expenses are applied directly to the department operating fund and revenue in excess of operating requirements is applied to the funds which also hold reserves from this at -risk contractual agreement. These can be used to address potential claims of overpayment or to invest in programs, services and operations that benefit OHP members. Local Use of Resources: Funding is used to support personnel costs and support suicide prevention efforts named in Service Element 10 and Program Element 60 descriptions above. In addition, these resources allow expansion of suicide prevention efforts to include activities that focus on persons 25 years of age and older as well as compliance with legislative mandates regarding suicide death. Local Allocation: DCHS Public Health has received ongoing financial support and partnership for the past several years in order to maintain the suicide prevention program. The annual resource allocation has changed over the years with most years increasing except for this current fiscal year in which a $19,521 reduction was made. The current allocation is $116,400 and we this to continue. Other essential duties or requirements this position has been performing that match the level three classification are: + Is versed in the privacy protection laws for deceased individuals and perform the rules set by Senate Bill 918 which requires the Local Mental Health Authority to provide notification of a suicide death or suspected suicide death of an individual 24 years of age or younger to systems that had contact with the deceased individual (i.e. current and/or former schools(s), juvenile department, employer, child welfare, etc). • The Suicide Prevention Coordinator performs all data abstraction and entry for the program, as well as: plans, leads, monitors and manages surveillance projects for the purpose of addressing suicide; uses database and other documents to identify and monitor suicide attempt and death data and other related risk factors as well as health disparities in the County; interprets and applies national, state, county and local data sources for use addressing suicide prevention, intervention, and postvention; implements statistical analysis techniques to address problems and develop recommendations and reports. • Acts as the point of contact for the Local Mental Health Authority for all public schools districts, public universities, and private education institutions to inform of a suicide death or suspected suicide death of an individual 24 years of age or younger per Senate Bill 485. • Facilitates community members, agencies, leaders and other partners for high priority community planning in order to reduce and prevent suicide death and attempts, improve health status indicators and equitable service. • Specified training is required to support skill and knowledge areas of Incident Command Systems and Suicide Prevention, Intervention and Postvention. Other essential duties the Department would like this position to take on that match the level three classification are: • Expanding oversight of the role beyond Suicide Prevention to include Mental Health Promotion • Leading, coordinating and assuring alignment across these content areas which involve two other staff and numerous volunteers. • Provision of input of staff evaluations • Development of policies and procedures to support mental health promotion and suicide prevention, working with Health Services leadership to make policy recommendations within the agency as well as locally and regionally PCR Form: Position #2347 (Suicide Prevention) 9.19.20 • Direct momentum within the program area by developing timelines in order to adhere to output and outcome goals; anticipate and trouble -shoot challenges and support staff and community partners This position is unique in the Department as it is housed in Public Health but in part financially supported by Behavioral Health. Support for this position is shared across the Health Services and is an example of excellence in service coordination and integration. Lastly, this reclassification will assist the Supervisor's workload by helping to shift some of the Supervisors current duties to the Mental Health Promotion and Suicide Prevention Program Coordinator.
