BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON
A Resolution Authorizing Inspection,
Analysis, and Scoping of Certain Local
Access Road Bridges
RESOLUTION NO. 2021-047
WHEREAS, River Road, Mountain Sheep Lane, and Wood Duck Court are local access roads
located within Deschutes County, Oregon and are subject to the exercise of jurisdiction by the Board of
County Commissioners of Deschutes County, Oregon pursuant to Oregon Revised Statute (ORS)
368.031; and
WHEREAS, said roads include bridges, the locations of which are depicted in the attached
Exhibit "A", attached hereto and incorporated herein by reference, that are not maintained by Deschutes
County pursuant to ORS 368.031; and
WHEREAS, the Road Department Director has recommended that County funds be expended
to perform inspection, analysis, and scoping for potential County maintenance, repair, or replacement
of said local access road bridges; and
WHEREAS, public use of said roads justifies expenditure of County funds for the inspection,
analysis, and scoping for potential maintenance, repair, or replacement of bridges on said roads; now,
therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES
COUNTY, OREGON, as follows:
Section 1. The Road Department is directed to perform inspection, analysis, and scoping for
potential maintenance, repair, or replacement of the local access road bridges identified in Exhibit "A".
Section 2. The work described in Section 1 shall comprise a single project.
Section 3. Upon completion of the work described in Section 1, the Road Department shall
present its findings and recommendations to the Board of County Commissioners for consideration of
potential County maintenance, repair, or replacement of said local access road bridges.

BACKGROUND AND POLICY IMPLICATIONS:
Local access roads are public roads which are not maintained by the County but over which
the County has jurisdictional authority. Oregon Revised Statute (ORS) 368.031 prescribes that
a county governing body shall not spend county funds on local access roads under their
jurisdiction unless it determines that the work is an emergency or:
• The county road official recommends the expenditure;
• The public use of the road justifies the expenditure proposed; and
• The county governing body enacts an order or resolution authorizing the work and
designating the work to be either a single project or a continuing program.
Maintenance and improvement of local access roads is generally the responsibility of users of
a given road and is typically delivered through private development of adjacent lands (subject
to land use approval), collaboration of neighboring property owners, homeowner or property
owner associations, or special road districts. Department staff believe that, while local road
maintenance and ownership responsibility by these entities is appropriate for matters such as
road grading, resurfacing, and other general roadway maintenance activities, maintenance and
ownership responsibilities regarding bridges on local access roads is not appropriate for these
entities, as bridge ownership and maintenance is significantly more costly and technical than
roadway ownership and maintenance. Although ORS 368.031 exempts the County from any
bridge maintenance or repair obligation on a local access road , a bridge failure on a local
access road would most likely result in a request to the County to provide assistance.
Out of the 380 miles of local access roads in Deschutes County, Road Department staff have
identified three local access road bridges:
0 River Rd, crossing Tumalo Creek in the Skyline Subdivision ("Thunder Bridge")
• Mountain Sheep Lane, crossing the Deschutes River in Deschutes River Recreation
Homesites Unit 6 (Special Road District)
• Wood Duck CT, crossing a side channel of the Deschutes River in Oregon Water
Wonderland Unit 2
The Department is recommending that the Board of County Commissioners adopt Resolution
No. 2021-047, which would authorize the Department to begin conducting safety inspections,
load rating analysis, maintenance and replacement recommendations, and cost estimating for
recommended maintenance and replacement work for these three bridges. The Department
anticipates that this work would be completed no later than December 31, 2021. Upon
completion of this work, the Department would present its findings and recommendations to
the Board of County Commissioners for consideration of further action regarding County -
funded maintenance and/or replacement of the local access road bridges.
FISCAL IMPLICATIONS: Road Department anticipates the inspection, analysis, and scoping
work will cost $45,000.00, which is included in the Department's Engineering budget line item
for Fiscal Year 2022.
